RECOMMENDATION
It is recommended that the City Council, at their meeting of July 1, 1996, adopt Resolution No. 96-
71 approving Lot Line Adjustment No. 96-4.
FISCAL IMPACT
None.
DISCUSSION
This lot line adjustment is being requested by Shea Homes Limited, the developer of Tract No.
14934, located on the easterly side of the Newport Avenue cul-de-sac and adjacent to the northerly
right-of-way of the Santa Ana Santa Fe Flood Control Channel/OCWA SCRRA Railway. The
purpose of this lot line adjustment is to provide the minimum building set back from the property
line for larger size homes than originally planned on the lots in question. The lot line adjustments
are shown on the attached location map and involve, the lots from Tustin Grove Drive between
Sampson Court and Dove Tree Court.
This lot line adjustment is provided for in Section 66412 (d) of the Subdivision Map Act wherein
the act makes provisions for the local agency to approve lot line adjustments where the land taken
from one parcel is added to an adjacent parcel and where a greater number of parcels than
originally existed is not thereby created.
The attached documents, consisting of a resolution and eight (8) sheets of an application for lot line
adjustment, will provide this adjustment once the resolution has been adopted by Council and the
application approved by staff.
This application has been revieWed by both the Community Development Depamnent and the
Engineering Division of the Public Works Department and all proposed adjustments have been
found to be in compliance with all zoning and setback requirements of the City and the provisions
of the California Subdivision Map Act.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING LOT LINE
ADJUSTIVIENT NO. 96-4
WItERE~, Section 66412 (d) of the SubdMsion Map Act makes provisions for the local
agency to approve lot line adjustments where the land take from one parcel is added to an adjacent
parcel and where a greater number of parcel than originally existed is not thereby created; and
WIt-ERE~S, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 96-
4 and has made a finding that the real property described in Exhibit A and shown on Exhibit B
complies with the provisions of the California Subdivision Map Act and applicable City of Tustin
ordinances and regulations including the requirements for building sites; and
WHEREAS, the City Council of the City of Tustin has made the following findings:
1. That the proposal is eligible for processing as a lot line adjustment pursuant to Section
66412 of the Subdivision Map Act;
2. That the requirements of the California Environmental Quality Act has been met;
3. That the proposal is consistent with the General Plan; and
4. That the resultant parcels will meet the requirements of the Zoning Code;
NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment No. 96-4
as shown on Exhibits A and B is hereby approved and that the parcel be considered building sites
upon recordation of this document.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held
on the 1" day of July, 1996.
