RECOMMENDATION:
Conduct the first of two public hearings to consider Resolution No..
96-81 placing charges for solid waste collection on the Tax Roll
for Fiscal Year 1996/97. Continue the hearing until the next
regular City Council meeting on Monday, August 19, 1996.
FISCAL IMPACT:
None.
DISCUSSION:
In accordance with our current Franchise Agreement, Waste
Management of Orange County, Inc., has submitted the attached
correspondence dated June 18, 1996 regarding a rate adjustment for
the fiscal year beginning July 1, 1996. They have submitted the
proper documentation to support their request and Staff has
confirmed the computations and source factors. Based on Staff's
review, rates as proposed in their Exhibit E are appropriate.
As pointed out in their letter, the calculated rate for 1996/97 is
a reduction of $0.51 per month, $6.12 for the year, from the
1995/96 rates. As'you are probably aware, the County reduced the
landfill fees by $8 per. ton effective April 1, 1996. Because of
the make-up of our rates, this fee reduction had a significant
impact on the rate calculations for the new year. Included in
their calculations is an additional one-time credit of 17 cents per
unit which is the value of the landfill savings for the period
April 1 - June 30, 1996.
In addition, Staff is presently projecting a surplus of $20,000 in
the trash fee clearing account. We usually experience minor
fluctuations in this account due to delinquencies, prior period
collections, etc., but the recent bankruptcy distribution of
withheld property taxes has brought the balance to the level
indicated. Because of the nature of the recent collections and the
purpose of the fees, Staff recommends that an additional $0.21 be
credited to residents when the rates are placed on the Tax Roll.
The Contractor will receive the full $11.74 per unit per month;
residents will be charged $11.53 of this amount and the balance
will come from the surplus currently on the City's books.

Based on the attached survey prepared by the City of Irvine last
May, the proposed City of Tustin rates for 1996/97 appear to be the
third lowest in the County.
Staff will be happy to respond to any questions regarding the
Franchise Agreement and methodology of the annual rate adjustments.

Enclosed herewith are the rate adjustment schedules in support of rate changes
effective July 1, 1996 for refuse collection and recycling service. These rate
schedules reflect an overall decrease in rates due primarily to the reduction in
county landfill tipping fees from $35.00/ton to $27/ton, effective April 1, 1996.
Residential rates will decrease 51 cents per month (4.2%) from $12.25/month to
$11.75/month. This includes a retro-active disposal adjustment credit for the
period April - June '96. This credit will be reflected in the '96/'97 rates at 17
cents per month or $2.04 in total (see Exhibit B).
Commercial rates will decrease 9% on the disposal component with each
customer receiving a one-time disposal credit for the period April - June '96 on
their July statement.
Residential and commercial service component rates reflect a 2.8% weighted CPI
increase in accordance with the formula specified in our contract.

PUBLIC NOTICE
NOTICE OF FILING OF REPORT
AND PUBLIC HEARING
Pursuant to the provisions of Section 5473, et seq. of the
Health and Safety Code of the State of California, the City 'of
Tustin has authorized and directed .the preparation of a written
report containing a description of each parcel of real property
receiving solid waste collection services and the amount of the
charge proposed to be levied upon each parcel for the
collection of solid waste for the fiscal year 1996-1997, and
the City Council has set August 5 and August 19, 1996 at 7:00
p.m., in the Council Chambers, located at 300 Centennial Way,
Tustin, California, as the times and place' when the City
Council will hear and consider all objections or protests, if
any, to the aforesaid report and proposed charges. If the
report is adopted by the City Council, the charges will be
placed on the tax roll and collected in the same manner, by the
same persons and at the same time as general property taxes. A
copy of said report is on file in the office of the City Clerk
and is available for inspection during regular business hours.
The City Council has authorized and directed the Chief Deputy
City Clerk to publish this notice at least once a week for two
consecutive weeks, on July 19 and July 26, 1996 in the Tustin
Weekly, a newspaper of general circulation in the City of
Tustin.

RESOLUTION 96-81
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF
SECTION 54?3 ET SEQ. OF THE HEALTH AND SAFETY CODE OF
THE STATE OF CALIFORNIA, APPROVING AND ADOPTING A
REPORT RELATIVE TO PARCELS OF REAL PROPERTY RECEIVING
SOLID WASTE COLLECTION SERVICES, DETERMINING THE
CHARGES FOR SOLID WASTE COLLECTION TO BE ASSESSED
AGAINST'THE RESPECTIVE LOTS OR PARCELS OF LAND AS THEY
APPEAR ON THE CURRENT ASSESSMENT ROLL.
The City Council of the City of Tustin does hereby
resolve as follows:
1. That proceedings were duly instituted, conducted
and completed pursuant to provisions of Section 5473 et seq.
of the Health and Safety Code of the State of California.
A. A written report dated July, 1996, containing a
description of each parcel of real property receiving solid
waste collection services and facilities and the amount of
the charge proposed to be levied upon each parcel for the
collection of solid waste for the fiscal year 1996-97 was
prepared and filed with the City Clerk of the City of Tustin
on July 29, 1996.
B. That Public Hearings to hear and consider all
objections or protests, if any, to the aforesaid report and
proposed charges were duly set for August 5 and August 19,
1996, at 7:00 o'clock p.m. in the Council Chambers of the
City of Tustin at 300 Centennial Way, Tustin, California.
C. Said hearings were duly noticed as required by
law, by publication once each week for two successive weeks
on July 25 and August 2, 1996 in the Tustin Weekly, a
newspaper of general circulation in the City of Tustin.
D. At the aforesaid time and place the duly noticed
hearings were held and all persons who were present were
heard and all comments, objections and protests to the
aforesaid report and proposed charges were duly heard and
considered by the City Council.
E. The charges proposed in the aforesaid report are
fair and reasonable, are commensurate with the services
provided, and the charge therefore should properly be
collected on the tax roll in the same manner, by the same
persons and at the same time as, together with and not
separately from, general taxes.

2. The City Council hereby elects to have the
charges set forth in the aforesaid report collected on
the tax roll in the same manner,.by the same persons, at the
same time as, and together with and not separately from its
general taxes, and hereby authorizes that such charges be
collected on the tax roll, as all prescribed to the
provisions of Health and Safety Code Section 5473 et seq.
3. The Resolution shall be effective following its
adoption by a two-thirds vote of the members of the City
Council and shall remain in force and effect and said
charges shall be collected in the manner as aforesaid for
the year 1996-97 and for each subsequent year as authorized
by the hereinabove referenced sections of the Health and
Safety Code.
4. The City Clerk is authorized and directed to
forthwith file a certified copy of this Resolution with the
Auditor of the County of Orange, together with a copy of the
hereinabove described report, and a statement endorsed
thereon over her signature that the said report has been
finally adopted by the City Council of the City of Tustin.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the
19th day of Auqust , 1996.
