The Pledge of Allegiance was led by Mayor Pro Tem Thomas. The Invocation was given by Councilmember Potts. Kathy Kelley and A1 Baker thanked Council for the proclamations. SARAH BIERY~ ANTI-GRAFFITI EFFORT Mayor Worley read and presented a proclamation to Sarah Biery commending her service to the community by organizing a graffiti "paint-out." Sarah Biery commented on the graffiti "paint-out" and thanked everyone who donated materials and volunteered their time to the project. CITY COUNCIL MINUTES Page 2, 7-15-96 FORMER WATER CORPORATION BOARD MEMBERS: JOHN BERINGER, REX COMBS, WILLIAM GUTHRIE, DEE HUNTER AND LLOYD ROBBINS Mayor Worley read and presented service recognition proclamations to former Water Corporation Board Members John Beringer, Rex Combs, William Guthrie, Dee'Hunter, and Lloyd Robbins. Rex Combs thanked Council for the proclamation. PUBLIC INPUT TUSTIN RANCH ROAD TRAFFIC Ray Andrus, 12255 Pevero, Tustin, complained about the increased traffic, speed violations, commercial truck usage, and ~uto Center test driving on Tustin Ranch Road between Irvine Boulevard and Jamboree Road. Councilmember Potts referred commercial truck enforcement to the Police Department and stated a letter would be forwarded to the Auto Center dealerships regarding test driving vehicles within the speed limit. RICOH ELECTRONICS - GRAND OPENING Kim Kline, Ricoh Electronics, noted Mayor Worley's attendance at their new facility grand opening, and thanked Council and staff for their responsiveness to the needs of the business community. PUBLIC ~RING - None CONSENT C2tnWNDAR ( ITEMS 1 THROUGH 10 ) Councilmember Potts announced he would abstain from voting on Consent Calendar Item No. 1 due to his absence from the July 1, 1996 Council meeting.. It was moved by Potts, seconded by Thomas, to approve the remainder of the Consent Calendar as recommended by staff. Motion carried 4-0, Saltarelli absent. APPROVAL OF MINUTES - JULY 1, 1996 REGULAR MEETING Council concurred to approve the City Council Minutes of July 1, 1996. APPROVAL OF DEMANDS AND'RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount 'of $5,180,455.63 and ratify Payroll in the amount of $327,901.52. REJECTION OF CLAIM NO. 96-22, CLAIMANT: JULIE EL-TAWIL Recommendation: Reject subject claim and direct the City Clerk to provide appropriate notice to the claimant and to the claimant's attorney as recommended by the City Attorney. · PLANNING COMMISSION ACTION AGENDA - JULY 8, 1996 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public. AWARD OF CONTRACTS FOR LANDSCAPEMAINTENANCE CITY-WIDEANDIN THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT ASSESSMENT AREA Recommendation: Award the following Landscape Maintenance Contracts and authorize the Mayor to execute the agreements upon approval of the City Attorney as recommended by the Public Works · Department: (1) Accurate Landscapes in the amount of $119,976.00 to maintain areas in the Tustin Landscape and Lighting District and (2) Plant Control in the amount of $109,643J16 for median and miscellaneous landscaping City-Wide and to maintain the grounds at the Civic Center, Senior Center and Field Services Maintenance Facility. PROFESSIONAL SERVICES AGREEMENT FOR DESIGN OF NEW RAWLINGS RESERVOIR BOOSTER STATION (PROJECT NO. 600115) Recommendation: Authorize the Mayor and City Clerk, subject to final City Attorney approval, to execute subject agreement with Daniel Boyle Engineering, Inc. for engineering services for the design of the new Rawlings Reservoir Booster Station as recommended by the Public Works Department/Water Services Division. PROFESSIONAL SERVICES AGREEMENT FOR DESIGN OF NEW MAIN STREET FACILITIES (PROJECT NOS. 600103 ~ 600108) RecommendatiOn: Authorize the Mayor and City Clerk, subject to final City Attorney approval, to execute subject agreement with Black & Veatch for engineering services for the design of the new facilities at the Main Street site, which include demolition and site preparation, a new reservoir and pumping station, a well head for Well No. 4, and chlorination facilities as recommended by the Public Works Department/Water Services Division. ASSET FORFEITURE APPROPRIATION Recommendation: Authorize the expenditure of asset forfeiture funds in the amount of $34,811.09 for purchase of Police Department equipment as recommended by the Police Department. CANINE SALES AGREEMENT Recommendation: Authorize the Mayor to execute Canine 'Sales Agreement between the City and Police Officer Keith Arrants releasing the City of any responsibility and/or liability concerning Police Canine Brit as recommended by the Police Department. RESOLUTION NO. 96-82 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS Recommendation: Adopt Resolution No. 96-82 authorizing the destruction of certain litigation files as recommended by the CitY Attorney. REVISION OF TUSTIN CITY CODE SECTION 1626 (DISPOSITION OF PROPERTY) It was moved by Thomas, seconded by Doyle, that Ordinance No. 1171 have first reading by title only. Motion carried 4-0, Saltarelli absent. Following first reading by title only of Ordinan6e No. 1171 by the City Clerk, it was moved by Thomas, seconded by Doyle, that the following Ordinance No. 1171 be introduced: ORDINANCE NO. 1171 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING SECTION 1626b(2)(c)3 TO THE TUSTIN CITY CODE TO AUTHORIZE THE CHIEF OF POLICE TO DONATE UNCLAIMED BICYCLES AND TOYS TO GOVERNMENTAL AND PRIVATE NON-PROFIT ORGANIZATIONS FOR THE PREVENTION OF JUVENILE DELINQUENCY Motion carried 4-0, Saltarelli absent. 12. POLICY FOR DEDICATING AND PLACING MEMORIAL PLAQUES AT PARK AND RECREATION FACILITIES Gary Magill, Recreation Superintendent, reported that at Council direction, the Parks and Recreation Commission appointed a sub- committee to work with staff to establish a policy for dedicating and placing memorial plaques at park and recreation facilities. He stated a policy had been developed and, in addition, the sub- committee reviewed and revised the Park Naming Guidelines. He said the Parks and Recreation Commission had requested Council remind the public that the Memorial Tree and Adopt-a-Park programs could also be used for memorial requests. Councilmember Potts stated that his request of placing a plaque dedicated to Carl Claes at the wishing well had not been addressed; stated three young individuals who had died recently should be memorialized; noted the wishing well was illustrated on local telephone books; requested the founder of the wishing well, Mary Kelly, be honored by a plaque at the site; would speak directly to staff regarding memorial ideas presented by Carl Claes' mother; and stated he supported the proposed policy. Mayor Worley stated that because, of the sensitive nature of memorializing individuals, the proposed policy Presented excellent guidelines; and she supported recognizing Mary Kelly with a plaque during the 20-year anniversary of the wishing well. It was moved by Thomas, seconded by Potts, to adopt Policy for Dedicating and Placing Memorial Plaques at Park and Recreation Facilities and revised Park Naming Guidelines. FEE WAIVER - DINOSAUR DASH Linda Jennings, Tustin Public Schools Foundation ExeCutive Director, reported the Dinosaur Dash had become the largest district-wide event for the Tustin Unified School District; 2,500 entrants participated in the race last year and approximately 5,000 people attended the event; many Tustin businesses sponsored the Dinosaur Dash; event profits were dispersed by the Tustin Schools Foundation grant program; over $500,000 in past event profits had been granted to schools in the Tustin Unified School District; thanked the City for past support; volunteers were needed for the event; and this year's Dinosaur Dash t-shirt logo had been designed by two Tustin High School students. Council/speaker discussion followed regarding how grant requests were submitted and the procedure for allocating grant funds. It was moved by Thomas, seconded by Potts, to waive fees for Police and'Public Works staff, permits, inspections, and approve use of City equipment for the 1996 Dinosaur Dash. Motion carried 4-0, Saltarelli absent. Council/speaker discussion follOwed approving use of the City seal on Dinosaur Dash t-shirts and brochure. PUBLIC INPUT - None OTHER BUSINESS/COMMITTEE REPORTS WISHING WELL PLAQUE - MARY KELLY Councilmember Potts clarified with staff that a Mary Kelly recognition plaque would be placed at the Civic Center wishing well. YOUTH SPORTS ACTIVITY FEES Councilmember Potts confirmed his belief that youth sports activity fees should not be increased and encouraged the school board not to raise the cost of participating in youth sports activities. Mayor Worley noted that the City's goal was to keep youth activity costs at a minimum. 4TH OF JULY CELEBRATIONS Mayor Pro Tem Thomas thanked the Tustin Meadows development for a successful 4th of July event and commended the Police Department for maintaining safety. Mayor Worley commended staff for an excellent 4th of July celebration at Tustin High School. CITY COUNCIL MINUTES Page 6, 7-15-96 CLOSED SESSION Mayor Worley announced the City Council would convene in closed session to confer with the City Attorney regarding: (1) Claim of Michael Ryerson, Claim No. 96-25, the claim may be reviewed at the City Clerk's office; and (2) Cindy Ann Baratta vs. City of TUstin, Junction T~eng, and Enda Tseng, OCSC-Case No. 758833. ADJO~ Mayor Worley adjourned the meeting at 7:37 p.m. The next regular meeting of the City Council was scheduled for Monday, August 5, 1996, at 7:00 p.m. in the Council Chambers at 300 Centennial Way. CLOSED SESSION STATEMENT It was moved and seconded to reject the claim of Michael Ryerson, Claim No. 96-25, and direct the City Clerk to provide appropriate notice to the claimant and to the claimant's attorney.
