ItlISTON, CITY MANAGER PUBLIC WORKS DEPARTMENT EXTENSION AND AMENDMENT TO CONTRACT WITH PACIFIC BUILDING CARE FOR CUSTODIAL MAINTENANCE SERVICES RECOMMENDATION Staffrecommends that the City Council amend the contract for custodial maintenance with Pacific Building Care of Irvine for $144,480, extend the contract for one year, and authorize the Mayor to execute the Contract amendment upon the approval of the City Attorney, FISCAL IMPACT The General Fund impact of this contract would be $144,480. Public Works Building Division for this purpose. Sufficient funds have been appropriated in the DISCUSSION In August of 1994, the City entered into a two year agreement with Pacific Building Care of Irvine to perform janitorial services for all City facilities. The comract was for the annual amount of $122,376 and allowed two one- year extensions at the City's discretion. Several facilities have been informally added to the comract in the past two years. These include the Columbus Tustin Gymnasium, the Tustin Sports Park and a warehouse office at the Field Services Maintenance Facility. The additional maintenance of these facilities has added $19,620 annually. Attached is a listing of all City facilities and the proposed maintenance costs for each facility. Staff is recommending that this contract be extended for a one year period. Staff is also recommending that the contract be formally amended to include the new facilities and an adjustment for increases in materials costs. The annual increase in materials amounts to approximately $2,484. The increases have been documented by Pacific Building Care and staff believes that they are reasonable given the term of the agreement and the fact that no other cost adjustments have been allowed for labor or supplies for the past two years. Pacific Building Care has a demonstrated record of responsible care of City facilities and has been very responsive to various facility care issues. For example, Pacific Building Care was instrumental in assisting staff to establish a mixed paper recycling program in City Hall and the Police' Department. For these reasons, staff recommends that the contract be extended for one year with further review in July 1997. Director, Public Works/City Engineer. Administrative Assistant II; Public Works TDS:jm AMMEND~NT TO CONTRACT AGREEMENT THIS AMENDMENT is entered into this 12th day of July , 1996, by and between the City of Tustin, a Municipal Corporation (herein referred to as "Citf'), and Pacific Building Care, Inc., whose address is 17935 Skypark Circle, #BCD, Irvine, California, 92714 (herein referred to as "Contractor"). This Amendment is made with reference to. the following: .WHE~~, City and Contractor entered into an Agreement dated August 30, 1994, the "Agreement" wherein Contractor agreed to perform maintenance services for City buildings and facilities pursuant to Section C, Attachments F and G, Pages C-21 and C-22; B. WttEREAs, the terms, of the Agreement was for two years, initially, with the ability to be extended by written agreement of each of the parties; C. WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section C, Page C-11, Paragraph 9, Item A, to extend the Agreement for one year, NOTM, THEREFORE, it is mutually agreed by and between the undersigned parties as follows: TERM of the Agreement shall be mended to read as follows: The Term of this Agreement shall be for a period of one year, commencing August 1, 1996, unless terminated pursuant to Section B, Paragraph 5 and Section C, Page C-11, Paragraph 9, Items A and B of this Agreement. Attachment 'A' CUSTODIAL PROPOSAL SHEET shall be amended as indicated to include additional areas and revised Contract costs. City shall pay Contractor a sum not to exceed $144., 480. oo for services rendered for the one year term of this Agreement. Payment shall be made on a monthly basis. No other price adjustments will be made. Except as expressly amended by this Amendment to Agreement, all other terms and conditions of the August 30, 1994, Agreement and all Exhibits thereto, shall remain in full force and effect.
