BACKGROUND: The following Ordinance No. 1171 had first reading and introduction at the July 15, 1996 City Council meeting' ORDINANCE NO. 1171 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING SECTION 1626b(2)(c)3 TO THE TUSTIN CITY CODE TO AUTHORIZE THE CHIEF OF POLICE TO DONATE UNCLAIMED BICYCLES AND TOYS TO GOVERNMENTAL AND PRIVATE NON-PROFIT ORGANIZATIONS FOR THE PREVENTION OF JUVENILE DELINQUENCY Valerie Crabill Chief Deputy City Clerk 1 :ORDMEMO ! ORDINANCE NO. 1171 !2 16 17 !9 2O 2! 22 23 24 25 26 27 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING SECTION 1626b (2) (c) 3 TO THE TUSTIN CITY CODE TO AUTHORIZE THE CHIEF OF POLICE TO DONATE UNCLAIMED BICYCLES AND TOYS TO GOVERNMENTAL AND PRIVATE NON-PROFIT ORGANIZATIONS FOR THE PREVENTION OF JUVENILE DELINQUENCY The City Council of the City of Tustin hereby ordains as follows: Section 1. This ordinance is enacted under the authority of Government Code Section 37350, which enables the City to dispose of personal property in the possession of the City for the common benefit. Section 2. Part 2 of Chapter 6 of Article '1 of the Tustin City ~ode is hereby amended by adding Section 1626b(2) (c)3 to read as follows: 3. Where the property is a bicycle or toy in the possession of the Police Department, the property may, at the discretion of the Chief of Police, be given to the Welfare Department of the County, or to any charitable or non-profit organization authorized under its Articles of Incorporation to participate in a program or activity designed to prevent juvenile delinquency and which is exempt from income taxation under federal or state law, for use in any program or activity designed to prevent juvenile delinquency. Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect ~he validity of the remaining portions of this ordinance. The City Council of the City of Tustin hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
