FISCAL IMPACT The Final Map is an applicant initiated project. recover the cost of processing this application. DISCUSSION The applicant has paid application fees to On March 25, 1996 and August 26,. 1996, the Planning Commission recommended City Council approval of Tentative Tract Map 15055 and Final Map 15055 by adopting Resolutions Nos. 3426 and 3464, respectively. The City Council approved Tentative Tract Map 15055 on May 6, 1996, by adopting Resolution No. 96-51. City Council Report Final Tract Map 15055 September 3, 1996 Page 2 Final Map 15055 includes five (5) numbered lots and nine (9) lettered lots to accommodate a maximum future development of 350 apartment units, 94 condominium units, 89 single-family detached units and a 5 acre neighborhood park on a 40 acre site. The City Council finds and determines as follows: no That Final Tract Map 15055 has been submitted by The Irvine Company; . That public hearings were held by the Planning Commission on March 25, 1996 and by the City Council on May 6, 1996 at which time Tentative Tract 15055 was approved. ~On August 26, 1996, the Planning Commission recommended that the City Council approve Final Tract Map 15055; C o That the Final Map is considered ministerially exempt pursuant to Section 15268(b) of the California Environmental Quality Act; D . That the proposed subdivision is in conformance with the Tustin General~ Plan, the Tustin Zoning Code and Subdivision Map Act; E . That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Tentative Tract 15055 on School District facilities, and changes in state law. Impacts associated with this approval on School District facilities .are adequately addressed; F . That the site is physically suitable for the type of development proposed; Go That the site is physically suitable for the proposed density of development; That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 96-88 Page 2 I . That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision; J. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, K. That the Final Map is in substantial conformance with the Tentative Tract Map. II. The City Council hereby approves Final Tract Map 15055, subject to final approval by the City Engineer.
