R73STON, CITY MANAGER REDEVELOPMENT AGENCY STAFF LAGUNA GARDENS PROJECT FINDING OF BENEFIT TO THE TOWN CENTER REDEVELOPMENT PROJECT AREA RECOMMENDATION It is recommended that the City Council adopt Resolution No. 96-89, finding that the Laguna Gardens project and DDA is of benefit to the Town Center Redevelopment Project Area. Sh~gl~ton Assistant City~anager CAS: kd\ccreport \ laguna, cas 1 RESOLUTION NO. 96-89 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE USE OF TAXES ALLOCATED FROM THE TOWN CENTER PROJECT AREA FOR THE PURPOSE OF REHABILITATING THE PROPERTY AT 1361 EL CAMINO REAL AND CONVERTING THE APARTMENTS INTO OWNERSHIP UNITS WILL BE OF BENEFIT TO THE PROJECT. The City Council of the City of Tustin, California, does hereby resolve as follows: WHEREAS, the Tustin Community Redevelopment Agency (the "Agency") has adopted a Redevelopment Plan (the "Redevelopment Plan") for the Town Center Project Area (the "Project"); and WHEREAS, the Redevelopment Plan provides for the allocation of taxes from the Project Area; and WHEREAS, Section 33445 of the Health and Safety Code provides that Redevelopment tax increment funds may be used outside of a project area if a finding is made by action of the Agency and the City Council that such use will be of benefit to the adjacent Project Area and there are no other reasonable means of financing the acquisition and cost of improvements; and WHEREAS, the City of Tustin has determined that rehabilitation of the property at 1361 E1 Camino Real and its conversion into ownership units would benefit the Town Center Project Area but is outside the Town Center Redevelopment Project Area; and WHEREAS, the Agency's Town Center Redevelopment Project Area, Five Year Town Center Project Implementation Plan and The Agency's Comprehensive Housing Affordability Strategy authorizes the rehabilitation of older housing units and encourages the creation of home ownership opportunities in the Town Center Project Area. NOW, THEREFORE, the City Council of the City of Tustin, California, does hereby find and resolve as follows: Section 1: The City Council hereby finds that the use of taxes allocated from the Town Center Project Area to be used outside the boundaries of the Project Area for the purpose of the rehabilitation of housing units at 1361 E1 Camino Real and its conversion to home ownership will be of direct benefit to the Town Center Project Area and that no other reasonable means of financing for said project are available in the Community. 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 96-89 Page 2 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, held on the 3rd day of September, 1996.
