JOINT MEETING- The City Council will hold a joint meeting with the Parks and Recreation Commission at 5:30 p.m. in the Community Center. This joint meeting is open to the public. CALL TO ORDER / PLEDGE OF ALLEGIANCE INVOCATION- The Invocation will be given by Pastor Dane Counts. ROLL CALL PROCLAMATIONS- Fire Prevention Week, October 6-12; Constitution Week, September 17-23; and Tustin Bobby Sox Team, National Champions PUBLIC INPUT- At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you 'wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. PUBLIC HEARINGS (ITEMS I THROUGH 2 ) I · U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT CONSOLIDATED PLAN ANNUAL PERFORMANCE REPORT As a Community Development Block Grant entitlement jurisdiction, the City of Tustin is required to submit to the U.S. Department of Housing and Urban Development an annual report detailing the City's performance in meeting goals and objectives of the Consolidated Plan. Recommendation by the Community Development Department' 1. Open and close the Public Hearing. e Adopt the following Resolution No. 96-93 authorizing submission of Tustin's. COMMUNITY DEVELOPMENT BLOCK GRANT GRANTEE PERFORMANCE REPORT As a Community Development Block Grant entitlement jurisdiction, the City of Tustin is required to submit to the U.S. Department of Housing and Urban Development an annual report containing a detailed accounting of Block Grant Funds expended during the 1995-96 fiscal year. The Grantee Performance Report fulfills the federal requirement. Recommendation by the Community Development Department: 1. Open and close the Public Hearing. . Adopt the following Resolution No. 96-94 approving the Community Development Block Grant Grantee Performance Report for Fiscal Year 1995-96 and authorizing submission of the report to the U.S. Department of Housing and Urban Development: RESOLUTION NO. 96-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE GRANTEE PERFORMANCE REPORT FOR FISCAL YEAR 1995-96 OF THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CONSENT CALENDAR (ITEMS 3 THROUGH 15 ) All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council', staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1 APPROVAL OF MINUTES - SEPTEMBER 3, 1996 REGULAR MEETING Recommendation: Approve the City Council Minutes of September 3, 1996. 4~ APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $838,511.74 and ratify Payroll in the amount of $330,604.34. So CONSULTANT AGREEMENT FOR UPDATE OF CITY-WIDE PAVEMENT MANAGEMENT SYSTEM Recommendation: Approve a consultant agreement with Infrastructure Management Services (IMS) for professional services to update the city-wide pavement management system, at a not to exceed fee of $61,250.00 for the current year's update and authorize the execution' of the consultant agreement by the Mayor and City Clerk, subject to the City Attorney's approval as recommended by the Public Works Department/Engineering Division. PLANNING COMMISSION ACTION AGENDA- SEPTEMBER 9, 1996 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of Sept. 9, 1996. 10. STATUS REPORT: HERITAGE WAY PARK AND TUSTIN RANCH TREE PARK Recommendation: Receive and file subject report as recommended by Community Services Department. the 11. CITIZEN'S OPTION FOR PUBLIC SAFETY (COPS) PROGRAM Recommendation: (1) Direct the Finance Director to establish a Supplemental Law Enforcement Services Fund, and (2) Set a Public Hearing for October 7, 1996 to consider use of the AB 3229 funds as recommended by the Police Department. 12. REJECTION OF CLAIM NO. 96-12, CLAIMANT: ROBERT WIMBUSH Recommendation: Reject subject claim and direct the City Clerk to provide appropriate notice to the claimant and to the claimant's attorney as recommended by the City Attorney. 13. REJECTION OF CLAIM NO. 96-33, CLAIMANT: DAVID KEEN Recommendation: Reject subject claim and direct the City Clerk to provide appropriate notice to the claimant and to the claimant's attorney as recommended by the City Attorney. 14. REJECTION OF CLAIM NO. 96-34, CLAIMANT: MERRICK HARLAN COOPERMAN Recommendation: Reject subject claim and direct the City Clerk to provide' appropriate notice to the claimant and to the claimant's attorney as recommended by the City Attorney. 15. U.S. COAST GUARD REQUEST FOR HOUSING AT MCAS-TUSTIN The proposed action would rescind $500,000 in previously agreed funding to the Coast Guard if their request for housing at Marine Corps Air Station, Tustin, is not withdrawn in 30 days. Recommendation: Pleasure of the City Council. 17. REPORT ON AUDIT COMMITTEE REVIEW OF ISSUES RAISED BY SARA PENN AND BERKLEE MAUGHAN The Audit Committee has prepared a report in response to issues raised by Ms. Penn and Mr. Maughan. Recommendation: Pleasure of the City Council. OTHER BUSINESS- City Manager, City Attorney, City Council COMMITTEE REPORTS-City.Council CLOSED SESSION- The City Council will convene in closed session to confer with Nick Nichols, the City's labor negotiator; the employee organization, involved in potential. negotiations, is the Tustin Municipal Employees Association. The City Council will-also confer with the City Attorney regarding: (1) the initiation of litigation (two cases); and (2) the Dale Elliotts claim (Claim No. 96-30). A copy of the claim may be reviewed in the City Clerk's office.
