HomeMy WebLinkAboutCC MINUTES 1985 12 02 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA DECEMBER 2, 1985 I, CALL TO ORDER/PLEDGE OF ALLEGIANCE/INVOCATION The meeting was called to order by Mayor Greinke at 7:01 p.m. in the City Council Chambers, 300 Centennial Way. Councilman Hoesterey led the Pledge of Allegiance, and the Invocation was given by Councilman Saltarelli. II. ROLL CALL Councilpersons Present: Frank H. Greinke, Mayor Donald j. TUSTIN URBAN WATER MANAGEMENT PLAN - RESOLUTION NO, 85-118 The staff report and recommendation were presented by the Adminis- trative Assistant as contained in her inter-com dated November 21, 1985. Councilman Edgar noted that the Tustin Urban Water Manage- ment Plan was not attached to subject report. Mayor Greinke opened the public hearing at 7:04 p.m. There were no speakers on the matter, and the public hearing was closed. It was then moved by Kennedy, seconded by Saltarelli, to continue consideration of the following to December 16, 1985, to allow Coun- cil review of subject Plan: RESOLUTION NO, 85-118 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE TUSTIN URBAN WATER MANAGE- MENT PLAN The motion carried 5-0. 107 2, STREET NAME CHANGE OF LAGUNA ROAD TO EL CAMINO REAL - RESOLUTION NO. 85-119 The Administrative Assistant presented the staff report and recom- mendation as contained in her inter-com dated November 22, 1985. The public hearing was opened by Mayor Greinke at 7:06 p.m. There were no speakers on the matter, and the public hearing was closed. It was moved by Hoesterey, seconded by Saltarelli, to adopt the following: RESOLUTION NO, 85-119 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CHANGING DESIGNATION OF LAGUNA ROAD BETWEEN 950 + FEET EASTERLY OF RED HILL AVENUE AND BROWNING AVENUE TO EL CAMINO'REAL Motion carried 5-0. 96 CITY COUNCIL MINUTES Page 2, 12-2-85 3. ABATEMENT OF PUBLIC NUISANCE AT 17592 AMAGANSET - RESOLUTION NO. 85-116 The staff report and recommendation were presented by the Community Development Director as contained in the inter-com dated December 2, 1985, prepared by the Community Development Department. Mayor Greinke opened the public hearing at 7:07 p.m. Jeff Jolley, General Manager and RME, American Restoration & Con- struction, Inc., 3100 West Warher, Suite 8, Santa Ana, general con- tractors for subject property, provided background on the matter. He requested additional time for plan checking and stated it would take approximately 60-90 days to correct conditions and bring the property into Code cOnformance. Ruben Flores, President, American Restoration and Construction, Inc., and Harold Cormann, property owner at 17592 Amaganset Avenue, were also present. Mr. Cormann responded to Council questions. There were no other speakers on the matter, and the public hearing was closed at 7:14 p.m. The Community Development Director provided further background on the matter. He noted that it would take longer than 60-90 days to correct conditions with the rainy weather. It was then moved by Greinke, seconded by Edgar, to continue the following to December 16, 1985: RESOLUTION NO. 85-116 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING THAT CERTAIN CONDITIONS ON THE PROPERTY LOCATED AT 17592 AMAGANSET AVENUE (AP# 401-033-01) CONSTITUTE A PUBLIC NUISANCE AND HEREBY ORDERING THE ABATEMENT OF SAID NUISANCE The motion carried 5-0. 81 Councilman Edgar noted that Council's concern is that the property. be upgraded, and not that property owners be penalized. However, if a penalty is necessary to correct the situation, Council is pre- pared to do so. IV. PUBLIC INPUT 1. FIRST ANNUAL TREE LIGHTING CEREMONY - DECEMBER 6, 1985 At the Mayor's request, the Director of Community and Administra- tive Services invited everyone to attend the First Annual Tree Lighting Ceremony to be held on Friday, December 6, 1985, at 7:00 p.m. at the Civic Center Complex. 2. RECOGNITION OF FOOTHILL HIGH SCHOOL STUDENTS Mayor Greinke recognized students from Foothill High School Civic classes attending this evening's meeting. There was no public input from the audience. RESOLUTION NO. 85-122 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ENDORSING THE "FAIR RESPONSIBILITY ACT OF 1986" Adopted Resolution No. 85-122 as recommended by the City Manager. 61 VI. ORDINANCES FOR INTRODUCTION 1, ADOPTION OF NEW MODEL AMBULANCE ORDINANCE - URGENCY ORDINANCE NO. 953 AND ORDINANCE NO. 955 The staff report and recommendation were presented by the Community Development Director as contained in the inter-com dated December 2, 1985, preparedby the Community Development Department. The Chief of Police and City Manager responded to concerns expressed by Councilmembers Saltarelli and Kennedy. It was moved by Kennedy, seconded by Hoesterey, that Urgency Ordi- nance No. 953 have first reading by title only. Carried 5-0. After a brief discussion period, the motion carried 5-0. Following first reading by title only of Urgency Ordinance No. 956 by the City Clerk, it was moved by Edgar, seconded by Hoesterey, that Urgency Ordinance No. 956 be introduced as follows: ORDINANCE NO, 956 - AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE NO. 936 WHICH ESTABLISHED A DEVELOPMENT MORATORIUM ON FIRST STREET The motion carried 5-0. 81 It was then moved by Edgar, seconded by Hoesterey, that Urgency Ordinance No. 956 have second reading by title only. SMOKING REGULATIONS IN PUBLIC PLACES & PLACES OF EMPLOYMENT - ORDI- NANCE NG. 949 {Revised Pursuant to Council action of November 18, 1985) Mayor Greinke noted that it is Council consensus that this is not a public hearing and that the public hearing on subject item had been closed and duly argued. It was moved by Edgar, seconded by Kennedy, that Ordinance No. 949 have first reading by title only. Motion carried 5-0. Following first reading by title only of Ordinance No. 949 by the City Clerk, it was moved by Kennedy, seconded by Edgar, that Ordinance No. 949 be introduced as follows: ORDINANCE NO, 949 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN AMENDING ARTICLE 4, CHAPTER I OF THE TUSTIN MUNICIPAL CODE BY ADDING PART 2, SECTIONS 4120, 4121, 4122, 4123, 4124, 4125, 4126, 4127, 4128, AND 4129, RELATING TO THE REGULATION OF SMOKING IN PUBLIC PLACES AND PLACES OF EMPLOYMENT The motion carried 4-1, Greinke opposed. 88 CITY COUNCIL MINUTES Page 5, 12-2-85 VII. ORDINANCE FOR ADOPTION 1. PARKING RESTRICTIONS - ORDINANCE NO. 952 It was moved by Kennedy, seconded by Saltarelli, that Ordinance No. 952 have second reading by title only. Motion carried 5-0. Following second reading by title only of Ordinance No. 952 by the City Clerk, it was moved by Hoesterey, seconded by Edgar, that Ordinance No. 952 be passed and adopted as follows: ORDINANCE NO. 952 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING TUSTIN CITY CODE SECTION 5340d (PARK- ING OF VEHICLES OVER 6,000 LBS.) The motion carried 5-0. 75 VIII. OLD BUSINESS None. IX. NEW BUSINESS 1. BID AWARD - PURCHASE OF ONE TRACTOR MOWER As recommended in the inter-com dated November 25, 1985, prepared by the Engineering Division, it was moved by Hoesterey, seconded by Edgar, to authorize the purchase of one small tractor mower from O.T.S. Distributors, Orange, in the amount of $8,998.34. The motion carried 5-0. 87 2. BID AWARD - PURCHASE OF THREE PICK-UP TRUCKS Pursuant to the recommendation contained in the inter-com dated November 25, 1985, it was moved by Edgar, seconded by Greinke, to authorize the purchase of three pick-up trucks {one with utility bed} from Earnest Ford, Inc., Orange, in the amount of $36,632.02. Following a question-and-answer period, the motion carried 5-0. 87 Mayor Greinke recommended that staff investigate the possibility of converting to the more economical, small-size pick-up trucks for City use. 3. BID AWARD - ONE 4-WHEEL DRIVE TRACTOR Mayor Greinke declared a conflict of interest on subject item. It was moved by Hoesterey, seconded by Edgar, to authorize the pur- chase of one 4-wheel drive tractor from Cook Tractor, Cerritos, in the amount of $14,453.10 as recommended by the Engineering Division in the inter-com dated November 25, 1985. Carried 4-0, Greinke abstained. 87 4. PROPOSED TRAFFIC SIGNAL AT INTERSECTION OF MOULTON PARKWAY AND MYFORD ROAD ! , As recommended in the inter-com dated NoVember 18, 1985, prepared by the Engineering Division, it was moved by Edgar, seconded by Saltarelli, to authorize a supplemental budget appropriation in the amount of $93,500 for the design and construction of a traffic sig- nal at the intersection of Moulton Parkway and Myford Road. The Director of Public Works responded to Mayor Greinke that traf- fic signal equipment is not a stock item and requires great lead time for ordering. COuncilman Saltarelli concurred with Councilwoman Kennedy that the City of Irvine should assist in funding the traffic signal since traffic through subject intersection will primarily be generated from Irvine's Industrial Complex. CITY COUNCIL MINUTES Page 6, 12-2-85 The Director responded that a joint funding agreement for~the con- struction of Myford Road through the Marine base will come before Council in the next two or three meetings. The Irvine Company's share will be approximately 35%, the City of Irvine's share 41%, and Tustin's share the remaining 24%. The motion was amended to: 1) Authorize a supplemental budget appropriation in the amount of $93,500 for the design and construction of a traffic signal at the intersection of Moulton Parkway and Myford Road; 2)Request a reimbursement from the City of Irvine for 41% of such costs; and 3)Install a temporary three-way stop at subject intersection until the signal is in operation. The motion carried 5-0. 94 X. REPORTS 1. PLANNING COMMISSION ACTIONS - NOVEMBER 25, 1985 It was moved by Saltarelli, seconded by Hoesterey, to ratify the entire Planning Commission Action Agenda of November 25, 1985. Motion carried 5-0. 80 XI. OTHER BIJSINESS 1. MAIN STREET ZONING STUDY In response to Councilman'Edgar, the Community Development Director reported that now that the First Street Specific Plan has been com- pleted, staff will provide a status report on the Main Street zon- ing study at the December 16, 1985, Council meeting. 81 2. CAPITAL IMPROVEMENT BUDGET WORKSHOP Councilman Edgar suggested a workshop to study the capital improve- ment budget. The City Manager recommended that Council schedule same in early March. 50 3. SENIOR CITIZEN CENTER PLANNING In response to Councilman Edgar, the Director of Community and Administrative Services provided an oral status report on progress made to date by the Steering Committee for a Senior Center. She stated the Committee has yet to come to an agreement regarding the outside elevation. As soon as that happens, it will bebrought to Council for approval. Until then, working drawings cannot begin, which should take between four to six months to complete. 41 4. ORANGE COUNTY ACADEMIC DECATHLON - TUSTIN'S HIGH SCHOOLS WINNERS Councilwoman Kennedy reported that both TUSD high schools placed high in the 18th Annual Orange County Academic Decathlon held on November 16 at Tustin High School. Foothill High School won first place and Tustin High School won third place. As suggested by Councilwoman Kennedy, Mayor Greinke requested the City Manager send a letter to the TUSD Board of Education in congratulations of such an achievement. 9O 5. FISCAL YEAR 1985-86 SLURRY SEAL PROGRAM In response to Mayor Pro Tam Saltarelli, the Director of Public Works reported that the slurry seal project has been delayed because staff requested that the contractor work on major streets during weekends only so as not to impact business traffiC, and the recent rains have slowed the pro~ect further. 95 CITY COUNCIL MINUTES Page 7, 12-2-85 6. REQUEST FOR PROCLAMATION - BOYS & GIRLS CLUB OF TUSTIN Council concurred with Mayor Greinke's request that a proclamation be presented to the Boys and Girls Club of Tustin in recognition of their Twentieth Anniversary in January. 84 7. EMPLOYEE AWARDS BANQUET - EMPLOYEE OF THE YEAR Mayor Greinke commented on the enjoyable evening had by all at the annual Employee Awards Banquet held on November 23, 1985. Particularly, he noted with pride the selection of Isabelle McClements, Recreation Coordinator, as "Employee of the Year." The Mayor also commended "The Tustin News" reporter John Orr for his excellent article on Mrs. McClements. 79 8. APPOINTMENT TO ORANGE COUNTY VECTOR CONTROL DISTRICT - URSULA E. KENNEDY As requested by Mayor Greinke, it was moved by Edgar, seconded by Hoestere~, to reappoint Ursula E. Kennedy to the Orange County Vector Control District. Carried 5-0. 67 9. SENATE BILL 735 Mayor Greinke reported that Senator Edward Royce has written in reference to Senate Bill 735 regarding agencies being able to charge drunk drivers up to $500 for costs incurred. Council con- curred with Chief Thayer's request that Tustin recommend removal of tFfi~"IFSO0 ceiling, or that Senator Royce's staff work with the Director of Community and Administrative Services to establish a more reasonable amount. 61 10. TUSTIN AREA COUNCIL-1 - RENEE FERRELL Mayor Greinke reported that Renee Fartell has withdrawn her resig- nation and will continue to serve on the Tustin Area Council-1 Com- mittee. He requested a letter of commendation be sent to her in recognition of her services as Chairman of TAC-1. 41 RECESS - REDEVELOPMENT - RECONVENED At 7:53 p.m. it was moved by Hoestere~, seconded by Edgar, to recess to the Redevelopment Agency. The motion carried 5-0. The meeting was reconvened at 7:55 p.m. with all members present. ADD-ON ITEM - REMOVED FROM REDEVELOPMENT AGENCY AGENDA FOR CITY COUNCIL ACTION 1, AUTHORIZATION TO ADVERTISE FOR BIDS - COMMUNICATIONS CENTER UPGRADE - RESOLUTION NO. 85-121 Following Revelopment Agency consideration of the inter-com dated November 22, 1985, prepared by the Chief of Police, it was deter- mined that subject matter should be deferred to the City Council for appropriate action (see December 2 Redevelopment Agency Min- utes, page 1). It was then moved by Saltarelli, seconded by Edgar, to appropriate General Fund monies for the purchase and installation of new com- munications center upgrade equipment and to adopt the following: RESOLUTION NO. 85-121 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR COMMUNICATIONS CENTER UPGRADE IN THE POLICE DEPARTMENT FACILITY AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS The motion carried 5-0. 82 CITY COUNCIL MINUTES Page 8, 12-2-85 XII.
