DEFINING THE PUBLIC SAFETY SERVICES DEPARTMENTS FOR
THE CITY OF TUSTIN IN COMPLIANCE WITH AB 2788.
RECOMMENDATION:
Adopt Resolution No. 96-103 defining the Public Safety Services
Departments for the City of Tustin as the Police Department and
Fire Protection.
DISCUSSION:
Proposition 172 (Public Safety Sales Tax) passed and amended the
State Constitution to include a 1/2 cent sales tax to be used
exclusively to augment existing public safety services throughout
the State. AB 2788 implements Proposition 172 and includes a
maintenance of effort (MOE) requirement that must be met each year
in order to receive that year's allocation of the Public Safety
Sales Tax. The first step of complying with the MOE is determining
the Public Safety Departments that will be used in the calculation.
Resolution No. 96-103 identifies the City of Tustin's Police
Department and Fire Protection as the Public Safety Services
Departments.
Since 1993-94 the City has received in excess of $400,000 of
Proposition 172 funds and we are projecting $172,000 for fiscal
1996-97. Based on our initial calculation, the City currently
exceeds its MOE by $2 million.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, DEFINING THE CITY OF TUSTIN
PUBLIC SAFETY SERVICES DEPARTMENTS IN COMPLIANCE
WITH ASSEMBLY BILL 2?88.
The City Council of The City of Tustin does hereby resolve
as follows:
WHEREAS, Assembly Bill 2788 was passed into Statute
during the 1994 Legislative Session; and
WHEREAS, the Statute requires the City Council to
determine which departments are to be defined as Public
Safety Services Departments; and
WHEREAS, the 1992-93 adopted budget for the City's
defined Public Safety Services Departments will become.the
base year that future years maintenance of effort
calculations will be measured.
NOW, THEREFORE, the City Council of the City of Tustin
does hereby resolve, determine and' define the Public
Safety Services Departments for the City of Tustin as the
Police Department and Fire Protection.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City. of Tustin held on the 7th day of.
