SUBJECT: STATE OF CALIFORNIA FISCAL YEAR 1997-98 TRANSIT CAPITAL IMPROVEMENT
PROGRAM FUNDING APPLICATION SUBMITTAL AUTHORIZATION.
RECOMMENDATIONS:-
It is recommended that the City Council, at their meeting of October 7, 1996, adopt Resolution No. 96-95
authorizing the City Engineer to submit an application to the California Transportation Commission for FY
1997-98 Transit Capital Improvement (TCI) Program funds.
FISCAL IMPACT:
State approval of this application would provide for an additional $591,250.00 in funds for construction of the
Tustin Commuter Rail Station.
BACKGROUND AND DISCUSSION:
The California Department of Transportation is currently soliciting formal project applications for the Fiscal
Year 1997-98 TCI Program. Funding for this program is made pursuant to Article XIX of the State
Constitution Section 199 and 199.2 of the Streets and Highways Code, 'and Sections 99317 and 99317.1 of the
Public Utilities Code.
The City is currently preparing a FY 1997,98 TCI application for partial funding of the Tustin Commuter Rail
Station in the amount of $591,250.00. The City's FY 1996-97 TCI application for the Commuter Rail Station
was recently approved by.the California Transportation Commission in the amount of $1,007,500.00. The City
also received a TCI Program award of funding for FY 1994-95 in the amount of $230,000.00.
As part of the application package submittal, a City Council Resolution must be included identifying the City
agent (City Engineer) who is authorized to submit the necessary application documents and emer into an
agreement with the State to implement the project if the funding is approved. Applications are due on or
before November 1, 1996.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING THE APPLICATION FOR FISCAL YEAR 1997-
98 TRANSIT CAPITAL IMPROVEMENT FUNDS
WItEREAS, Article XIX of the constitution of the state of California, Sections
199 and 199.2 of the Streets and Highways Code and Sections 99317 and 99317.1 of the
Public Utilities Code provide for the funding of the Transit Capital Improvement Program;
and
WItEREAS, the California Department of Transportation (Caltrans) has
established the procedures and criteria for reviewing funding applications and is required
to submit to the California Transportation Commission a list of recommended projects
from which the funding recipients will be selected; and

applicant to authorize the filing of the applicati°n for funding; and
WItEREAS, the City of Tustin, as the applicant, will enter into an agreement with
the State of California to carry out the Transit Capital Improvement project;
NOW, THEREFORE, BE IT RESOLVED that the City Council:
1. Approves the filing of an application for the Transit Capital Improvement
Program for funding assistance.
2. Certifies that said applicant will make adequate provisions for operation and
maintenance of the project.

Appoints the City Engineer, as agent of the City of Tustin to conduct all
negotiations, execute and submit all documents, including, but not limited to
applications, agreements, amendments and payment requests, which may be
necessary for the completion of the aforementioned project.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 7a day of October 1996.
