PUBLIC INPUT CLOSED SESSION - Mayor Worley announced the City Council would convene in closed session to: 1. Confer with the City's real property negotiator (Government Code Section 54956.8). Property: 15471 Del Amo Avenue (Assessor's Parcel No. 430-251-001, et al) and 15171 Del Amo Avenue (Assessor's Parcel No. 430-251-006 and 011). Negotiators: City Manager or designee (City) and Michael Leifer (AAE Pacific Park Associates, LLC). Under Negotiation: Price and Terms of Payment. 2. Confer with the City's labor negotiator, Arlene Marks, Director of Human Resources, regarding Tustin Police Support Services Association (TPSSA) and Tustin Municipal Employees Association (TMEA). 3. PREZONE 02-001 FOR ANNEXATION NO. 158 (LORETTNBONNER/MEDFORD/GROVESlTE ANNEXATION) Mayor Worley opened the public hearing at 7:17 p.m. The following members of the audience spoke in favor of the prezoning of LorettalBonnedMedfordlGrovesite properties: Dick Edgar, 345 W. First Street, #29, Tustin, CA John Clifford, County of Orange There were no other speakers on the subject and the public hearing was closed at 7:20 p.m. It was moved by Thomas, seconded by Davert, to adopt the following Resolution No. 03-04 certifying the Negative Declaration as adequate for Prezone 02-001 for Annexation No. 158: Minutes - City Council January 6, 2003 - Page 2 Approved Approved Approved Adopted Resolution No. 03-01 RESOLUTION NO. 03-04 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,. ADOPTING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR PREZONE 02-001 AND ANNEXATION NO. 158 AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Motion carried 5-0. It was moved by Thomas, seconded by Davert to have first reading by title only and introduction of Ordinance No. 1264 approving Prezone 02-001 for Annexation No. 158. Motion carried 5-0. CONSENT CALENDAR (ITEMS 2 THROUGH 7 ) It was moved by Thomas, seconded by Kawashima, to approve the Consent Calendar as recommended by staff. Motion carried 5-0. , APPROVAL OF MINUTES - DECEMBER 16, 2002 REGULAR MEETING Recommendation: Approve the City Council Minutes of December 16, 2002. , APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,776,278.07 and ratify Payroll in the amount of $447,896.88. , SURPLUS EQUIPMENT SALES REPORT Recommendation: Receive and file. 5. Jeffries and Associates; and Adopt the City of Tustin Investment Policy for calendar year 2003 with no changes, as recommended by the City Treasurer. LEGISLATIVE ADVOCACY SERVICES Recommendation: Authorize the firm of Nielsen, Merksamer, Parrinello, Mueller and Naylor (the firm) to provide legislative advocacy and general strategic advice. Minutes - City Council January 6, 2003 - Page 4 Adopted Urgency Ordinance No. 1265 , COMCAST/AT&T BROADBAND FRANCHISE RENEWAL It was moved by Thomas, seconded by Bone, to adopt Urgency Ordinance No. 1265, extending a Cable Television Franchise with Comcast of Los Angeles, Inc. until April 6, 2003. Pamela Stoker, City Clerk, read the following Ordinance No. 1265 by title only: ORDINANCE NO. 1265- AN URGENCY ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, EXTENDING A CABLE TELEVISION FRANCHISE WITH COMCAST OF LOS ANGELES, INC., DBA AT&T BROADBAND UNTIL APRIL 6, 2003. Motion carried 5-0 (roll call vote). Adopted Resolution No. 03-05 as amended 10. AMENDMENT TO THE CITIZEN PARTICIPATION PLAN FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM It was moved by Bone, seconded by Thomas, to adopt the following Resolution No. 03-05, as amended: RESOLUTION NO. 03-05 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENTS TO THE CITY'S CITIZEN PARTICIPATION PLAN FOR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING SUBMISSION OF THE AMENDMENTS TO THE FEDERAL DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Motion carried 5-0. None SECOND PUBLIC INPUT OTHER BUSINESS SANTA TRAIN Councilmember Davert commented on his and Councilmember Bone's attendance at Metrolink during the Santa Train visit; the event was well attended and he hoped it continued in the future. Minutes - City Council January 6, 2003 - Page 5 RECENT DEATHS Councilmember Davert stated that former Superintendent of the Tustin Elementary School District, Dr. Tracy Gaffey, Jr., and former Tustin Unified School Board member, Marjorie Day had recently passed away. STATE BUDGET Mayor Pro Tem Kawashima and Councilmember Davert suggested that the Council continue to watch the California state budget process. HAPPY NEW YEAR Council wished everyone a Happy New Year. ORANGE COUNTY SANITATION DISTRICT Councilmember Bone asked Mayor Pro Tem Kawashima if he had obtained the expected annual costs to homeowners for the proposed secondary treatment process; Mayor Pro Tem Kawashima responded the cost was $16.00 per household annually. SENIOR CENTER FUNDRAISER Mayor Pro Tem Kawashima stated that the Senior Center was hosting a karaoke night on Saturday, January 11, 2003 at 7:00 pm as a fundraiser event. Pat Sanchez, Director of Parks and Recreation Services, explained that the Senior Advisory Board was trying to raise money for a 21-station computer center for local seniors. MCAS, TUSTIN Mayor Pro Tem Kawashima suggested that the City begin an aggressive marketing program for MCAS, Tustin. SANTA ANA UNIFIED SCHOOL DISTRICT Mayor Worley reported that all lawsuits with SAUSD had been settled and summarized the highlights of the base closure over the past decade. REMOVAL OF CHAIN LINK FENCE Mayor Worley requested the removal of a chain link fence surrounding the lemon grove at Portola and Tustin Ranch Roads. MISSING TEACHER Mayor Worley commented on Ty Watkins, a former teacher at Foothill High School, who had been reported missing from the Rancho Santa Margarita area. Minutes - City Council January 6, 2003 - Page 6 ADJOURNMENT- Mayor Worley adjourned the meeting at 7:46 p.m. The next regular meeting of the City Council was scheduled for Tuesday, January 21,2003 at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
