HomeMy WebLinkAbout10 OLD TOWN STSCAPE 02-18-03AGENDA REPORT NO. 10 02-18-03 MEETING DATE: FEBRUARY 18, 2003 TO' FROM' SUBJECT: WILLIAM HUSTON, CITY MANAGER REDEVELOPMENT AGENCY STAFF OLD TOWN STREETSCAPE STOREFRONT PLANTERS LICENSE AGREEMENTS SUMMARY This action is to approve a storefront planter licensing program in the Old Town Tustin business district and authorize the Assistant City Manager to execute individual License Agreements. RECOMMENDATION It is recommended that the City Council' 1. Approve the storefront planter licensing program and direct Staff to prepare the License Agreement for the City Attorney's approval; and 2. Authorize the Assistant City Manager to execute the individual License Agreements as needed. FISCAL IMPACT This action will have no addition impact on the Redevelopment Agency at this time, the planters have been purchased and delivered to the City under the Old Town Streetscape and Pedestrian Enhancement Project Contract (CIP No. 7172) approved by the Tustin City Council on December 3, 2001. DISCUSSION As a part of the Old Town Tustin streetscape improvement program, the City purchased planting pots to provide a uniform street furnishings program along with the benches, trash receptacles and signage in the downtown district. The design intent was to further enhance the pedestrian environment by extending the street planting to the storefronts and business entrances on El Camino Real and Main Street. William Huston February 18, 2003 Page 2 Based on the considerable interest expressed by the property owners and merchants in the district, Staff is proposing to "lease" planters to property owners and/or merchants in the district under individual license agreements. The license agreements would require in consideration for the use of the City planters that the licensees provide the on-going maintenance of the planters to ensure that the planter's appearance is maintained to an appropriate level, including the watering and upkeep of all plant material installed in the planters. If the level of maintenance is not upheld by the licensee, the City would be able to terminate the license and remove the planters and re-lease the planters to another licensee in the district.
