CONTRACT AMENDMENT FOR LANDSCAPE MAINTENANCE SERVICES
FOR THE GENERAL FUND AREAS WITH LANCO LANDSCAPE
MANAGEMENT, INC.
SUMMARY
Approval of the third contract amendment with Lanco Landscape Management, Inc. provides for
maintenance services for the existing lemon grove at Lemon Tree Park to be added to the existing
contract.
RECOMMENDATION
It is recommended that the City Council approve the third amendment to the contract agreement
between Lanco Landscape Management, Inc. and the City of Tustin for landscape maintenance
services subject to City Attorney approval.
FISCAL IMPACT
Adequate funds are currently available in the 2002/2003 Fiscal Year budget to cover the cost of
the proposed increase.
DISCUSSION
The City has contracted with Lanco Landscape Management, Inc. since July 1, 2000 for
maintenance of all General Fund areas, including all center islands and specific City and Water
Operations facilities. The original agreement was for a l-year period with three l-year extensions
available to City. The second contract amendment extended the agreement until June 30, 2003.
This contract amendment would add the maintenance services of the lemon grove area within the
future Lemon Tree Park to the existing contract agreement. The contractor will be compensated
for these additional services, an amount equal to $1,965 per month for the period from March 1,
through June 30, 2003. The contractor's monthly compensation will be increased to $14,862.74
for the period from March 1, 2003 through June 30, 2003.
The additional landscape maintenance services are the result of the expiration of the five-year
Lemon Orchard Maintenance Agreement on September 1, 2003 with the Irvine Company. The
maintenance of the Grove was considered part of the developer contributions to City Park
improvements for tentative Tract Map No. 15380, Lot 27.

The City attempted to extend that Maintenance Agreement, but the Irvine Company did not want
to maintain the lemon grove any longer. The grove area consists of approximately 8.1 acres and
has over 800 lemon trees within the future Lemon Tree Park. The proposed amendment to the
Agreement with Lanco Landscape Management, Inc., will provide basic landscape maintenance
services that include: irrigation, fertilization, pruning, weeding, cleaning, pest and rodent control,
and removal and disposal of fruits from the lemon trees area only.
Lanco Landscape Management, Inc. has provided consistent service of a reasonably high quality
over the last two years and has been very responsive in correcting any service that did not meet
City standards. The additional grove maintenance services will have no effect on the contractor's
ability to continue to provide the quality and responsiveness the City has received previously.

THIRD AMENDMENT TO
CONTRACT AGREEMENT
THIS THIRD AMENDMENT is entered into this day of ,2003, by
and between the City of Tustin, a Municipal Corporation (herein referred to as "City"), and Lanco
Landscape Management, Inc., a California corporation, (herein referred to as "Contractor").
This Amendment is made with reference to the following:
RECITALS
A. WHEREAS, City and Contractor entered into an Agreement dated July 3, 2000, the
"Agreement", wherein Contractor agreed to perform landscape maintenance services in
accordance with the agreement and specifications entitled "Annual Landscape Maintenance
Services for the General Fund Areas";
B. WHEREAS, the initial term of the Agreement was one year, with the option to be
extended for three additional one-year terms by written agreement of the parties;
C. WHEREAS, City and Contractor entered into the first Amendment to the Agreement on
August 20, 2001 and extended the Agreement until June 30, 2003;
D. WHEREAS, City and Contractor entered into this Second Amendment to that Agreement
on July 15, 2002 and extended the Agreement until June 30, 2003;
E. WHEREAS, City and Contractor desire to add the Lemon Grove maintenance services
at the future Lemon Tree Park to the Agreement, and to adjust Contractor's compensation
under the Agreement to reflect a negotiated price increase for that area.
AGREEMENT
The Agreement is hereby amended as follows:
A. The areas of landscape maintenance services to be provided by the Contractor under
this Agreement, is amended to include the following areas effective March 1,2003;

B. City shall pay Contractor the following sums for the periods indicated:
2. From March 1, 2003 to June 30, 2003 City shall pay Contractor, on a monthly
basis, an additional amount of $1,965.00 per month, which will bring the total monthly
compensation amount to $14,862.74.
3. City shall pay contractor a sum not to exceed $7,860.00 for the additional
landscape maintenance services for the period from March 1, 2003 to June 30, 2003.
4. City shall pay Contractor a sum not to exceed $162,632.88 for the period from
July 1, 2002 to June 30, 2003.
C. Except as expressly amended by this Third Amendment, all other terms and conditions
of the Agreement and all attachments and exhibits thereto shall remain in full force and effect.
