ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE CATCH BASIN INSERT
PROJECT FY 2002~03 (402-6222)
SUMMARY
The Catch Basin Insert Project FY 2002/03 (402-6222) has been completed to the satisfaction of the
City Engineer and is now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 03-31 accepting the Catch Basin Insert
Project FY 2002/03 (402-6222), and authorizing the recordation of the Notice of Completion, and direct
the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of
recordation of the Notice of Completion; and
2. Release the Faithful Performance bond not sooner than one year after the date of recordation
of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five (35)
days after the date of recordation of the Notice of Completion the City Council authorize payment of
the final 10% retention in the amount of $7,968.20 to United Storm Water Inc. This amount, together
with previous contract payments of $71,713.80 represents 100% of the final contract cost.
FISCAL IMPACT
The final construction cost of this project is $79,682.00. Matching grant funds received from the County
of Orange Urban Runoff Grant Program were used to fund fifty (50%) percent of this cost.
BACKGROUND AND DISCUSSION
The City's catch basins serve as inlets into the storm drain system. The implementation of structural
best management practices (BMPs) to mitigate urban water runoff pollution is a means to comply with
the new requirements of the Santa Ana Region NPDES Permit. The subject project involved the
installation of 146 catch basin filter inserts throughout the City in both curb opening and grate opening
type configurations. Prior to their installation, each catch basin was cleaned and the removed material
was categorized by weight and type of waste. The inserts will be cleaned regularly as a routine

maintenance activity. A program is being developed to categorize the waste trapped by the filters in
order to determine their effectiveness. The information obtained from these analyses will be a beneficial
tool that can be used to identify sources of pollutants.
All of the work for this project has been completed to the satisfaction of the City Engineer, and is now
ready for City Council acceptance.

RESOLUTION NO. 03-31
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR
THE CATCH BASIN INSERT PROJECT FY 2002/03 (402-6222)
WHEREAS, United Storm Water, Inc. having a contract with the City of Tustin to
construct the hereinafter described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
work and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement is found to be complete, and the same is hereby
accepted. Said public work and improvement is more particularly described as follows:

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 3rd day of March 2003.
