HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE OLD TOWN STREETSCAPE AND PEDESTRIAN ENHANCEMENT PROJECT (CIP NO. 7172) SUMMARY The Old Town Streetscape and Pedestrian Enhancement Project (CIP No. 7172) has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 03-39 accepting the Old Town Streetscape and Pedestrian Enhancement Project (CIP No. 7172), and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five (35) days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $ 175,332.33 to Ecology Construction, Inc. This amount, together with previous contract payments and change order amounts of $1,577,991.00 represents 100% of the final contract cost. FISCAL IMPACT The final construction cost of this project is $1,753,323.33. The project construction was funded from various funding sources including the City's Capital Improvement Program Fund, Gas Tax Fund, Community Redevelopment Agency-Town Center Fund and the Ad Valorem Street Lighting District Fund. Streetscape and Pedestrian Enhancement Project (CIP No. 7172) March 17, 2003 Page 2 Project construction has increased the City's infrastructure assets by $921,800.00. That increased infrastructure valuation will be added to the City's infrastructure inventory as required by Statement 34 of the Governmental Accounting Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34 Infrastructure Inventory Valuation Form. BACKGROUND AND DISCUSSION The construction of the Old Town Streetscape and Pedestrian Enhancement Project was a major project within the Old Town Tustin area. The project enhanced and improved the pedestrian ambiance of the area. The project included the installation of raised end-islands and curb bump-outs with landscaping, Iow-level walls, decorative lighting and furnishings, area signage and other streetscape enhancements on El Camino Real between Newport Avenue and First Street. The alley bordered by El Camino Real and Third Street was improved by adding decorative paving, pedestrian lighting and landscaped planters. The existing street lights within the project area on El Camino Real and Main Street were replaced with the "nostalgic style" light standards consistent with those currently on Main Street near "B" Street. This work was done by and under separate contract with Southern California Edison concurrently with this project. Currently, the final contract progress payment and one change order are still in progress. However, these costs are included in the final contract amount shown on the previous page. All of the work for this project has been completed to the satisfaction of the City Engineer, and is now ready for City Council acceptance. Tim D. Kasdan ~ Engineering Services Manager Attachments: Resolution No. 03-39 GASB 34 Infrastructure Inventory Form Location Exhibit 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 03-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE OLD TOWN STREETSCAPE AND PEDESTRIAN ENHANCEMENT PROJECT (CIP NO. 7172) WHEREAS, Ecology Construction, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: OLD TOWN STREETSCAPE AND PEDESTRIAN ENHANCEMENT PROJECT (CIP NO. 7172) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file the Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
