HUSTON, CITY MANAGER HUMAN RESOURCES DEPARTMENT CONTINUATION OF TEMPORARY BENEFITS AND COMPENSATION DURING MILITARY LEAVE FOR CITY EMPLOYEES CALLED TO ACTIVE DUTY WITH THE ARMED FORCES SUMMARY: This agenda item recommends adopting a new Resolution to allow the City to continue supplementing military salary and benefits for eligible employees on extended military leave of absence as previously provided by Resolutions 01-96 and 02-50. RECOMMENDATION: Adopt Resolution 03-38 continuing the benefit of additional temporary partially paid military leave of absence and continuation of benefits for eligible City employees called to active duty in connection with the nation's response to the terrorist attack on the United States of America as previously authorized by Resolutions 01-96 and 02-50. FISCAL IMPACT: Estimated at $36,048 for fiscal year 03-04. BACKGROUND AND DISCUSSION: On October 15, 2001 the City Council adopted Resolution 01-96 establishing additional temporary partially paid military leave of absence and continuation of benefits for eligible City employees called to active duty in connection with the nation's response to the terrorist attack on the United States of America that occurred on September 11, 2001. The provision of these supplemental salary and benefits concluded June 30, 2002. The City Council then extended the provisions until June 30, 2003 by adopting Resolution 02-50 on May 20, 2002. Thus far, two City employees have been reactivated in the call-up of reservists and others may be called. One has been on military leave continuous since January 3, 2002 and the other was recently called back to active duty after returning to work from his initial call out for 12 months. S:\City Council Agenda Items\2003\military leave 0338.doc City Council Agenda March 17, 2003 Page 2 Adoption of the attached Resolution will provide an eligible employee partial pay (the City pays the difference between an employees' military pay and his/her current base salary) and continued employee benefits as currently provided. This Resolution would be effective July 1, 2003 to ensure continuity of salary and benefits at the conclusion of our fiscal year when the benefits provided through Resolution 02-50 conclude. The fiscal impact of the Resolution is anticipated to be approximately $36,048. This estimate is based on two (2) employees whose salaries and benefits are currently supplemented by the City. Funds will be budgeted to cover the costs associated with this Resolution in the City's 03/04 budget. As such, no budget adjustment will be necessary. Arlene Marks, SPHR Director of Human Resources Attachment: Resolution No. 03-38 S:\City Council Agenda Items\2003\military leave 0338.doc RESOLUTION NO. 03-38 l0 14 l? 19 20 2,2 24 25 2? 29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PROVIDING FOR CONTINUATION OF ADDITIONAL TEMPORARY PARTIALLY PAID MILITARY LEAVE OF ABSENCE AND CONTINUATION OF BENEFITS FOR ELIGIBLE CITY EMPLOYEES CALLED TO ACTIVE DUTY WITH THE ARMED FORCES WHEREAS, the City of Tustin currently provides fully paid leave of absence and continuation of benefits for a maximum of thirty (30) calendar days per year to employees who have been in City service for at least one (1) year and who are ordered to report to active duty; and WHEREAS, on October 15, 2001 the City Council of the City of Tustin adopted Resolution 01-96 establishing additional temporary partially paid military leave of absence and continuation of benefits, through June 30, 2002, for eligible City employees called to active duty in connection with the nation's response to the terrorist attack on the United States of America; and WHEREAS, on May 20, 2002 the City Council of the City of Tustin adopted Resolution 02-50 continuing additional temporary partially paid military leave of absence and continuation of benefits, through June 30, 2003. WHEREAS, several City employees have been alerted and have been, or may be in the future, called into active military service in connection with actions to combat terrorism against America; and WHEREAS, the City Council of the City of Tustin desires to continue to alleviate financial hardships which employees, and their families, may experience as a result of serving on active duty during such crisis. NOW, THEREFORE, The City Council of the City of Tustin, California does hereby resolve as follows: . In addition to the fully paid military leave currently provided by the City of Tustin, each full time officer or employee of the City who is eligible to receive such paid leave and, who has been, or is in the future, called to involuntary active military service with the Armed Forces of the United States to serve in support of the current actions to combat terrorism against America, shall be entitled to military leave with partial pay pursuant to the terms of this Resolution for the period of absence on active duty in excess of the period covered by current paid military leave provisions. . The amount of pay that each such employee shall be entitled to receive from the City for said additional period of military leave shall be the difference between the gross pay and allowances actually received by the officer or employee from the United States for such service and the salary schedule gross wages that said officer or employee would have received from the City of Tustin if he or she had not been called to active military duty, subject to all required and appropriate deductions and withholdings. The City shall provide continued health and welfare benefits to such employees' dependents in the manner as they were provided prior to the call to active military duty, provided that the dependents were covered for such benefits prior to the employee being called to active duty. , Wage or benefits pursuant to this Resolution are conditioned upon the officer or employee requesting such payment and providing satisfactory proof and documentation of eligibility to receive payment in accordance with the procedures established by the Human Resources Director. , The pay and benefits authorized by this Resolution shall terminate on and be of no further force or effect on midnight, June 30, 2004, unless extended by the City Council or otherwise required by law. Passed and adopted at a regular meeting of the Tustin City Council held on the 17th day of March, 2003.
