The Pledge of Allegiance was led by Councilmember Potts. The Invocation was given by Mayor Worley. ROLL CALL Council Present: Tracy Wills Worley, Mayor Jeffery M. Development Valerie Crabill, chief Deputy city Clerk Greg Gubman, Associate Planner Bettie Correa, Senior Personnel Analyst Approximately 15 in the audience PROCLAMATION TUSTIN HIGH SCHOOL CROSS COUNTRY TEAM Mayor Worley read and presented proclamations to Tustin High School Cross Country team members Brian Cameron, Tom Coffey, Jr., Ryan Dedman, Leo Gordillo, Martin Kuklinski, C.J. Marciales, Daniel smith, Ray Vergara, and Michael Yang, for winning the CIF Championship and placing second in the State Meet. Coach Coffey commended the team for winning the CIF Championship; noted the importance and difficulty of winning the Orange County Championship; stated that the Cross Country team was only one of five teams'in Tustin High School history to win an Orange County Championship; and thanked Council for the proclamations. C.J. Marciales, a cross country teammember, noted how close the team had come to winning the State Meet and stated he was proud of the team's accomplishments. CITY COUNCIL MINUTES Page 2, 12-16-96 PUBLIC INPUT "TUSTIN: A CITY OF TREES" David Bryant, Tustin Area Historical Society, presented Council with autographed copies of Carol Jordan's recently published book, "Tustin: A City of Trees;" and reported that Ms. Jordan had received grant funding for a second book, "The Significant Trees of Tustin." Council/speaker discussion followed regarding the book's contents. PUBLIC HEARINH (ITEM 1) le AMENDMENT TO VESTING TENTATIVE TRACT MAP 14410 (LEWIS HOMES) . Greg Gubman, Associate Planner, reported that the project, located at Peters Canyon Road and Pioneer Road, was originally approved in October 1995 with three floor plans. He stated that an amendment to the plan was approved in June 1996, allowing a second product line of smaller units. However, due to renewed confidence by Lewis Homes to market the larger size product, the proposed amendment would cancel the smaller units and expand the product line to five floor plans. He said the architectural design, colors, and materials were consistent with the existing construction; the project was in compliance with the East Tustin Specific Plan; and the Planning Commission had recommended approval of the proposed amendment. Mayor Worley opened the public hearing at 7:20 p.m. There were no speakers on the subject and the public hearing was closed. Councilmember Saltarelli stated that he was pleased Lewis Homes was proposing elimination of the smaller product line and by their renewed confidence in future development; and he supported the proposed amendment. It was moved by Potts, seconded by Thomas, to adopt the following Resolution No. 96-129 approving the Environmental Determination for the project; and.adopt the following Resolution No. 96-130 approving Amendment No. 2 to Tentative Tract Map 14410: '. RESOLUTION NO. 96-129 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE FINAL ENVIRONMENTAL IMPACT REPORT (EIR) PREPARED FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS. ADEQUATE TO SERVE AS THE PROGRAM EIR FOR AMENDMENT NO. 2 TO VESTING TENTATIVE TRACT MAP 14410 AND APPLICABLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT RESOLUTION NO. 96-130 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENT NO. 2 TO VESTING TENTATIVE TRACT MAp 14410 LOCATED AT THE NORTHWESTERLY CORNER OF PIONEER ROAD AND PETERS CANYON ROAD CITY COUNCIL MINUTES Page 3, 12-16-96 Motion carried 5-0: CONSENT CI~ff.,ENDAII ( ITEMS Z THROUGH 11 ) Item No. 10 was removed from the Consent Calendar by Councilmember Potts. It was moved by Thomas, seconded by Saltarelli, to approve the remainder · of the Consent Calendar as recommended by stazf. Motion carried 5-0.' 2. APPROVAL OF MINUTES - DECEMBER 2, 1996 REGULAR MEETING Recommendation: Approve the City Council Minutes of December 2, 1996. · APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $828,549.47 and ratify Payroll in the amount of $338,444.67. SERVICE AUTHORITY FOR THE ABATEMENT OF ABANDONED VEHICLES (SAAV) .PROGRAM RecommendatiOn: Authorize the Community Development Department to apply to the Orange County Transportation Authority through the Service Authority Abandoned Vehicles (SAAV) program for funding of equipment to support the City's Abandoned Vehicle Program; and to approve appropriation of funds to the Community Development Department Other Equipment Account. (010-400-3010-9800) as recommended by the Community Development Department. · PLANNING COMMISSION ACTION AGENDA - DECEMBER 9, 1996 Ail actions of the Planning Commission become final unless appealed bY the city Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of December 9, 1996. AGREEMENT'BETWEEN THE CITY OF TUSTIN AND. THE IRVINE RANCH WATER DISTRICT Recommendation: Authorize the City Manager or Assistant city Manager to execute an agreement between the City of Tustin and Irvine Ranch Water District for preparation of a Water and Sewer Sub-Area Master Plan (SAMP) for Marine Corps Air Station Tustin as 'recommended by the Assistant city Manager. RESOLUTION NO. 96-122 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, VACATING A PORTION OF AN EXISTING PUBLIC SERVICE EASEMENT RECORDED ON NOVEMBER 15, 1991, AS INSTRUMENT NO. 91-625668, RUNNING ALONG LOTS 34-43 AND LOT H OF TRACT NO. 15292, AS SHOWN ON A MAP FIELD IN BOOK 737, PAGES 18-21, OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA Recommendation: Adopt Resolution No. 96-122 which vacates a portion of an existing storm drain' easement located in Tract No. 15292; and approve and authorize the Mayor t° execute Amendment No. i to the ,'Operation and Maintenance Easement Agreement" to exclude this property from the Agreement as recommended by the Public Works Department/Engineering Division. AUTHORIZATION TO ADVERTISE FOR .BIDS, FRONTIER PARK RESTROOM REHABILITATION (PROJECT NO. 200030) Recommendation: Approve plans and specifications and authorize CITY COUNCIL MINUTES Page 4, 12-16-96 advertisement for bids for construction of the Frontier Park Restroom Rehabilitation as recommended by the Community Services Department. · RESOLUTION NO. 96-131 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE APPLICATION FOR TRADE AND COMMERCE DESIGNATION OF A LAMBRAFORMARINE CORPS AIR STATION, TUSTIN Recommendation: Adopt Resolution No. 96-131 as required by the State in order to be favorably considered for LAMBR~ designation at Marine Corps Air Station Tustin as recommended by the. Community Redevelopment Agency. 11. PROFESSIONAL SERVICES AGREEMENT FOR CONSULTING ENGINEERING SERVICES FOR THE SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL PROJECT FROM NEWPORT AVENUE TO APPROXIMATELY 400~ WEST OF PASADENA AVENUE (CIP NO. 700149) Recommendation: Approve the Professional Services Agreement with Post, Buckley, Schuh & Jernigan, Inc. to provide consulting engineering design 'services on the subject project for a total not to exceed fee of $65,450.00 and authorize execution of the Professional Services Agreement by the Mayor and City Clerk as recommended by the Public Works Department/Engineering Division. CONSENT CALENDAR ITEM NO. 10 - HUMAN SERVICES COORDINATOR POSITION - TUSTIN FAMILY AND YOUTH CENTER Councilmember Potts suggested the position be bilingual and encouraged participation by local role models at the Center. Mike Henley, Director of Community Services, responded that the position would be funded through the Community Development Block Grant program which required utilizing an employment pool from the project area. It was moved by Potts, ·seconded by Thomas, to authorize a new, full-time Human Services Coordinator for the Tustin Family and Youth Center; funding to be provided from a combination of tenant lease payments and Community Development Block Grant funds. Motion carried 5-0. REGULAR BUSINESS ( ITEM 12 12. STATUS REPORT: HERITAGE WAY PARK (PROJECT NO. 400042) AND CEDAR GROVE PARK (PROJECT NO. 400041) Mike Henley, Director of Community Services, reported that the architect had redesigned Cedar Grove Park's playground area to complement the park's natural character; challenge a child's curiosity, imagination, and social skills; and create a strong visual design statement. Bob Mueting, RJM Design Group, summarized Cedar Grove Park design refinements including play opportunities and apparatus for different youth age groups. · CITY COUNCIL MINUTES Page 5, 12-16-96 Council/staff discussion followed regarding that Cedar Grove Park was 9.7 acres; Camino Real Park was approximately 4 acres; two half-court basketball courts were proposed for Cedar Grove Park; and the park would be constructed in one phase. Bob Mueting described proposed Cedar Grove Park amenities including park,access from Pioneer Road; 42 parking spaces; two half-court basketball courts; group picnic areas; open play areas for' informal team sports; perimeter walkway for hiking and jogging; and an informal amphitheater. Council/speaker/staff discussion followed regarding the park amenities provided recreation opportunities for all ages; the park provided access for Physically challenged individuals; park construction to begin by Summer 1997; construction completion by the end of 1997; playground equipment wOuld provide children with mental and physical development; providing full-court versus half- court basketball coUrts; and full-court basketball courts would be available during non-school hours at the new elementary and intermediate schools in Tustin Ranch. Bob Mueting presented slides showing the proposed Heritage Way Park design including half-court basketball courts; parking for approximately 25 vehicles; water features; covered picnic area; restroom building; play area; sand volleyball facility; open multi-use playing fields; perimeter walkway; fencing; and landscaping. He stated that the Parks and ReCreation Commission had requested two full-court basketball courts, two volleyball courts, and additional parking in order to provide more activities in the park. , Council/speaker/staff discussion followed regarding installation of a roller hockey pad at Heritage Way Park; referring-the matter back for Parks and Recreation Commission review; deleting the sand volleyball area to install a roller hockey facility; redeveloping Laurel Glen Park for volleyball; and potential noise generated by roller hockey play. Councilmember Doyle stated he opposed installation of a sand volleyball~- court; supported Construction of a roller hockey practice rink at the park; noted the importance of maintaining adequate parking because this would be the only roller hockey site in the City; and said the park design phase provided an excellent opportunity to include a roller hockey~pad. Councilmember Saltarelli stated he supported installing a roller hockey pad in a park with adequate acreage such as Cedar Grove Park; said roller hockey pads should be constructed away from residential areas; supported constructing two roller hockey rinks; and requested staff investigate utilizing one of the corner fields at Tustin Ranch Elementary School for two roller hockey pads. Council/staff discussion followed regarding future residential areas were planned adjacent to Cedar Grove Park; concern regarding delaying Cedar Grove Park construction for further study; and utilizing the Tustin Sports Park-as a roller hockey Site. CITY COUNCIL MINUTES Page 6, 12-16-96 Mayor Worley stated that perspective buyers purchasing homes adjacent to parks were aware of potential noise generated from the park; she believed roller hockey did not create excess noise; and it was the appropriate time to address roller hockey pad installation during the design phase of Cedar Grove and Heritage Way Parks. The following member of the audience spoke in support of construction of a full-court basketball court at Heritage Way Park' · Brian Gallogly, 13171 Contessa, Tustin Council/Speaker Gallogly discussion followed regarding the lack of full-court basketball courts in the City; and the difficulty in playing basketball at Columbus-Tustin Gym because of continuous public usage. The following member of the audience spoke regarding the growing popularity of soccer and roller hockey and the need for both sPort opportunities at Heritage Way Park: Carolyn Brothers, 2525 Avenida Alpera, Tustin Mayor Pro Tem Thomas stated that redevelopment of Laurel Glen Park could provide another opportunity for providing an active sport location; the proposed design for Cedar Grove Park was unique; the need for full-court basketball and roller hockey in the city; and he believed the matter should be referred back to the Parks and Recreation Commission. Council/staff discussion followed regarding the directive to the Parks and Recreation Commission to incorporate -full-court basketball courts and~two roller hockey practice rinks at Laurel Glen, Cedar Grove, and/or Heritage Way Parks. Councilmember Potts stated his concern about noise generated from roller hockey play; supported construction of roller hockey practice rinks; suggested refurbishing Tustin High School's basketball courts; and requested scheduling a public workshop with CounCil and the Parks and Recreation Commission. Council/staff discussion followed regarding the importance of moving forward with Cedar Grove and Heritage' Way Park construction; the park development process; past interest by a private company to modify the two tennis courts at Tustin High School to' a roller hockey pad; constructing a large tot lot at Laurel Glen Park instead of Cedar Grove and/or Heritage Way Parks; scheduling a workshop with the Parks and Recreation Commission in January; Council's past direction to fast-track park design and construction; support of continued fast-track of park construction; redevelopment of Laurel Glen Park; and staff to develop conceptual plans for basketball courts and roller hockey pads. TUSTIN HOST LIONS DONATION Councilmember Doyle commended the Tustin Host Lions Club for their generous toy donation to the Santa Cop program and requested support and donations for the program prior to December 20, 1996. JAMBOREE ROAD Councilmember Potts reported the barbed wire fencing surrounding the Marine Base along Jamboree Road was littered with debris and he requested clean-up by the responsible agency. TUSTIN RANCH ROAD/IRVINE BOULEVARD CounCilmember Potts requested that staff investigate installation of double left-turn lanes for northbound Tustin Ranch Road at Irvine Boulevard. TUSTIN SPORTS PARK TREES Councilmember Saltarelli requested the leaning trees at the Sports Park be straightened. FUTURE PARK LANDSCAPING Councilmember Saltarelli requested landscaping bids for future parks include mature trees and landscaping for faster growth. PROCLAMATIONS - BASE CLOSURE TASK FORCE Mayor Pro Tem Thomas requested proClamations be given to members of the Base Closure Task Force. CHRISTMAS TREE LIGHTING CEREMONY Mayor Worley reported on the successful Christmas Tree Lighting Ceremony. CLOSED SESSION' Mayor Worley announced that the City Council would convene in closed session to confer with Nick Nichols, the City's labor negotiator. The employee organizations involved in potential negotiations were Tustin Municipal Employees Association. and Tustin Police Officers Association/Management Unit. Unrepresented employees were management and confidential units. CITY COUNCIL MINUTES Page 8, 12-16-96 ADJO~~ Mayor Worley adjourned the meeting at 8:40 p.m. The City Council scheduled a joint meeting with the Parks and Recreation Commission on Monday, January 6, 1997, at 5:00 p.m., and the next regular meeting of the city Council was scheduled for Monday, January 6, 1997, at 7:00 p.m. in the Council Chambers at 300 Centennial Way.
