CODE AMENDMENT 96-004, COMPREHENSIVE REVISIONS TO THE CITY'S
SUBDIVISION CODE (ORDINANCE NO. 1177)
Code Amendment 96-004 (Ordinance No. 1177) is a comprehensive revision to the
City's Subdivision Code (Tustin City Code 9310 et. seq.) to implement the.
Subdivision Map Act of the State of California. The proposed amendments would
also establish a more efficient subdivision process.
Recommendation by the Community Development Department:
1. Open and close the Public Hearing.
2. Adopt the following Resolution No. 97-4 approving the Environmental
Determination for the project:
RESOLUTION NO. 97-4- A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION
AS ADEQUATE FOR COMPREHENSIVE REVISIONS TO THE CITY'S
SUBDIVISION ORDINANCE INCLUDING REQUIRED FINDINGS PURSUANT TO
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

ORDINANCE NO. 1177 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY

ARTICLE 9, CHAPTER 3, SUBDIVISIONS, OF THE TUSTIN CITY CODE
CONSENT CALENDAR (ITEMS 2 THROUGH 9)
All matters listed under'Consent Calendar are considered routine and will be enacted by one
motion. There will be no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request specific items be
discussed and/or removed from the Consent Calendar for separate action.

APPROVAL OF MINUTES - JANUARY 6, 1997 REGULAR MEETING
Recommendation: Approve the City Council Minutes of January 6, 1997.

APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $2,325,345.58 and ratify
Payroll in the amount of $675,930.56.

RESOLUTION NO. 97-5 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ADOPTING THE PROPOSED DECISION OF THE
ADMINISTRATIVE LAW JUDGE IN THE ADMINISTRATIVE APPEAL OF RUSSELL
WHITEHEAD AS ITS FINAL DECISION TO DENY MR. WHITEHEAD'S APPLICATION
FOR DISABILITY RETIREMENT BENEFITS
Recommendation: Adopt Resolution No. 97-5 as recommended by the City
Attorney. This Resolution is a final decision by the City Council on Mr. Whitehead's
application for disability retirement. This Resolution adopts the proposed decision
of the administrative law judge to deny Mr. Whitehead's. application for disability
retirement benefits. This decision was rendered after an evidentiary appeal hearing.

Recommendation: Deny subject claim and direct the City Clerk to send notice
thereof to the claimant and claimant's attorney as recommended by the City

AWARD OF BID FOR CONSTRUCTION OF FRONTIER PARK RESTROOM
REHABILITATION (PROJECT NO. 200030)
Recommendation: (1) Award a contract for the construction of the Frontier Park
Restroom Rehabilitation, Project No. 200030, to Irvine Engineering Corporation of
Irvine in the amount of $137,500.00, subject to approval of contract requirements
by the City Attorney and execution by the City Manager, and (2) Appropriate
$70,000 from the Park Development Fund to cover additional'work necessary to
service the growing summer lunch program and correct the American with Disabilities
Act deficiencies at the site as recommended by the Community Services Department.

Recommendation: Ratify the Planning Commission Action Agenda of January 13,
1997.
CONTRACT RENEWAL FOR ASPHALT CONCRETE PAVEMENT REPAIR PROGRAM
Recommendation: Approve an amendment to the contract for Annual Concrete
Pavement Repairs Program with All American Asphalt as recommended by the Public
Works Department/Field Services Division. The contract amendment would extend
the agreement from January 21, 1997 to June 30, 1997, would grant the contractor
a 2.6% adjustment for consumer price index as allowed in the contract extension,
and add an additional work item for the grinding and cold planing of asphalt. The
total contract would be a not to exceed amount of $219,301.50.

10. PUBLIC EMPLOYEES' RETIREMENT SYSTEM CONTRACT AMENDMENT,
SURVIVOR BENEFITS
1959
The proposed contract amendment with the Public Employees' Retirement System
(PERS) will add Level Three 1959 Survivor Benefits Option for all miscellaneous'
employees.
Recommendation by Personnel Services:

Adopt the following Resolution No. 97-2 to amend the PERS contract to add the
Level Three 1959 Survivor Benefits Option for all miscellaneous employees as
previously approved by the City Council on January 31, 1995, in the
Memorandum of Understanding with the Tustin Municipal Employees
Association:

On November 8, 1994, City voters approved a ballot measure limiting terms of office
of members of the City Council to two (2) full consecutive terms. In order to assist
the City to carry out the wishes of the voters, special State legislation was enacted
to permit the City Council to adopt an ordinance limiting the number of City Council
terms without submitting, the proposal to the electors for approval~
Recommendation by the City Attorney:
1. Have first reading by title only of Ordinance No. 1175.
2. Introduce the following Ordinance No. 1175:
ORDINANCE NO. 1175 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, CONFIRMING THE. VOTERS' WISHES EXPRESSED
ON NOVEMBER 8, 1994, TO LIMIT CONSECUTIVE TERMS OF MEMBERS OF
THE CITY COUNCIL
TUSTIN BOYS AND GIRLS CLUB
Councilmember Potts requested that the City Council discuss the need to assist the
Boys and Girls Club in identifying options for rehabilitation/expansion of its current
facilities.
Recommendation: Pleasure of the City Council.

COMMITTEE REPORTS- City Council
CLOSED SESSION- The City Council will convene in closed session to confer with the
City Attorney regarding: (1) Initiation of litigation pursuant to Government. Code Section
54956.9(c) (one potential case); (2) Claim of the Estate of Terry McGlynn (Claim No. 96-
47); the claim may be reviewed in the City Clerk's office; and (3) To confer with Nick
Nichols, the City's labor negotiator. The employee organizations involved in potential
negotiations are Tustin Municipal Employees Association and Tustin Police Officers
Association/Management Unit. Unrepresented employees are management and confidential
units.

next regular meeting of the City Council is scheduled for Monday, February 3, 1997, at
7:00 p.m. in the Council Chambers at 300 Centennial Way.
