Sara Pashalides reported that Sara Barnett requested that her
authority as applicant be granted to the tenant, Pacific Auto
Parts. Pacific Auto Parts agreed to this; therefore, this action
necessitated revisions to Resolution No. 3495.
Commissioner Pontious moved, Mitzman seconded,, to adopt Resolution
No. 3495 approving Conditional Use Permit 96-033 revised as
follows: Page 1, Section I,A shall read, "A proper application,
Conditional Use Permit 96-033, has been filed by Vince O'Connor,
requesting authorization to permit the outside storage of three (3)
military vehicles and two (2) metal storage containers located at
125 West Main Street." Exhibit A, Condition 1.4, shall read,
"Approval of Conditional Use Permit 96-003 is contingent upon the
applicant signing and returning an "Agreement to Conditions
Imposed" form as established by the Director of Community
Development." Condition 1.5 shall read, "The applicant shall hold
harmless and defend the City of Tustin from all claims and
liabilities arising out of a challenge to the City's approval of
this project." The first sentence of Condition 2.1 shall read,
"Safety mechanisms shall be installed and maintained within the
military vehicles to prevent their operation by unauthorized
persons, to the satisfaction of the Police Departnnent."
Motion c~rried 4-0. Commissioner Vandaveer abstained.

Recommendation - That the Planning Commission adopt~Resolution No.
3507, upholding the- Zoning Administrator's action and denying the
appeal of Conditional Use Permit 96-037 and.Design Review 96-051.
Presentation: Daniel Fox, Senior Planner
Commissioner Vandaveer moved, Pontious seconded, to adopt
Resolution No. 3507, upholding the Zoning Administrator's action
and denying the appeal of Conditional Use Permit 96-037 and Design
Review 96-051 revised as follows: Condition 1.5 shall read, "The
applicant shall hold harmless and defend the City of Tustin from
all claims and liabilities arising out of a challenge to the City's
approval of this project." Condition 2.1 revised to read, "In.
accordance with Tustin City Code Section 9271(i) related to the
required separation between commercial and residential uses, the
parking lot expansion area shall be screened from surrounding
residential properties and the abandoned railroad right-of-way to
the north by a 6'- 8" high solid masonry wall measured from the
finish grade on the adjacent residential properties." Condition 3.2
to read, "The use of the parking lot expansion area may be reviewed
by the Community Development Director at least on a biannual basis.
If in the future the Community Development Director determines that
noise, security, and/or other nuisance problems exist on the site
or in the vicinity as a result of the establishment of the parking
lot expansion area, the Community Development Director may require
the applicant to provide additional mitigation measures to be
reviewed and approved by the Zoning Administrator or Planning
Commission. Said mitigation may include, but are not limited to,
the following: a. Establish hours of use, b. Secure parking lot
expansion area from adjacent parking area, and c., Retain an on-
site security guard. Failure. to satisfy the above condition could
be grounds for the Zoning Administrator or Planning Commission to
reconsider Conditional Use Permit 96-037 and Design Review 96-051
which may result in revocation.,, Condition 3.5 to read, "The use
of the parking lot expansion area shall be limited to employee
parking only. Customer parking shall 'be prohibited, except in
conjunction with a special event or under special circumstances as
approved by the Community Development Director." Condition 3.6
shall read, "Prior to the final inspection for any building permit,
"Employee Parking Only" signs shall be posted at the entrance to
the parking lot expansion area, with sign details and locations to
be approved by the Community Development Department.. Last sentence
added to Condition 212 to read, "Landscape plans shall be approved
by the Director of the Community Development Department.,, Motion

STATUS: PURSUANT TO SECTION 15301 OF THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT.
REQUEST: AUTHORIZATION TO ELIMINATE TWO EXISTING SERVICE
BAYS, EXPAND THE EXISTING CONVENIENCE MARKET, AND
MAKE CERTAIN SITE AND BUILDING IMPROVEMENTS.
Recommendation - That the Planning Commission adOpt Resolution No.

031.

Commissioner Pontious moved, Vandaveer seconded, to adopt
Resolution No. 3508 approving Conditional Use Permit 96-020 and
Desi~ Review 96-031 revised as follows: "Add Condition 6.4 to
read, "If deemed necessary, on site, no left turn traffic, signs
shall be submitted for review approval and/or installation subject
to the approval of the City Traffic Engineer." Motion carried 5-0.

Comprehensive Revisions To The City's Subdivision Code
(Continued from the meetings of November 12 and November 25,
1996)
Recommendation - That the Planning Commission:
1. Adopt Resolution No. 3501 approving the environmental
.determination for the project; and,
·
Adopt Resolution No. 3502 recommending that the City Council
approve comprehensive revisions to Article 9, Chapter 3,
Subdivisions, subject to final approval of the City Attorney.

Chairman Bone recommended adding that the wording "and serve
residents of the entire City" be added to Part IV under Park -
Neighborhood definitions, making language consistent with the Park
- Community definition.

Co~missioner Mitzman moved, Vandaveer seconded,' to adopt
Resolution No. 3501 approving the environmental determination for
the project. Motion carried 5-0.
Co_mmissioner Mitzman moved, Vandaveer seconded, to adopt Resolution
No. 3502 recommending that the City Council approve comprehensive
revisions to Article 9, Chapter 3, Subdivisions, subject to final
approval of the City Attorney. Motion carried 5-0.

Report on Actions taken at the December 16, 1996 and January
6, 1997 City Council Meetinqs.
Presentation: Elizabeth A. Binsack, Community Development Director
The Director reported on the subject agenda.
COMMISSION CONCERNS:
Commissioner Pontious - None
Commissioner Mitzman
Inquired if the area around the TuStin Commerce Center
Building could be enhanced by trees and landscaping.
There is a landscape gap in the area.
Staff will look into the issue and report.back to the
Commission.
Commissioner Kozak
- Asked if 'the status of the landscaping at the 55/5
Freeway Interchange improvement area could also be
included in the same report concerning the area just
mentioned by Commissioner Mitzman.

Reported that the northbound exit to Jamboree at the site
of the new advertising sign construction for the expanded
area of the marketplace have lights that are blinding to
motorists at night.
Staff will report back on this situation.
Provided a Government Finance Review.article to staff and
the Commission entitled, "When and When Not to Use
Incentives to Attract Business or to Retain Existing
Business."
Commissioner Vandaveer
Expressed concern about the way gas station closings have
left the vacated properties full of trash and wishes to
see this situation monitored. He also asked when the
gasoline tanks could be removed following a station
closing.
The Director stated that the County Health Care Agency
has certain time frames for individual stations. She
will contact the Health Care Agency to find out the
overall schedule of service station cleanups.
Commissioner Bone
Stated that the contract for the landscaping of the 5/55
Freeway Interchange area has been signed by Caltrans and
the OCTA. The area included starts at Edinger and will
extend to the 22 Freeway.
Reported that Tustin Pride gave out 84 Lollypop signs in
recognition of decorative holiday lighting throughout the
City.
Stated that the new bus benches in the City are
collecting trash and graffiti. He inquired if reporting
of this type of graffiti should be done through the
graffiti hot line. He is concerned about the lack of
protection afforded to people from the rain in these open
style bus shelters.

The Director stated that it was best to report this type
of graffiti directly to public services. At. the
suggestion of the Commissioner, staff, will include
information on reporting graffiti on bus shelters for
publication in Tustin Today. The Director pointed out
that the contract for the design of the shelters has
already gone out and .she was not sure it could be
modified, but that she will look into the issue.
Reported that during the. past few weeks he has observed
landscapers pushing debris down the drains with their
blowers. He has talked with Field Services and they have
asked to be notified immediately if this is seen, due to
this practice clogging the drains.
Asked if the proliferation of blue tarps on the roofs at
E1 Camino and Tustin Ranch Road could be addressed.
Has received several calls concerning the vacant lot at
the northwest corner of First Street and Tustin Avenue
and thanked Code Enforcement for getting the site
cleaned.'
Reported that the State of the City luncheon will be held
June 6, 1997, location to be announced.

meeting at 8:55 p.m. Motion carried 5-0.
The next regularly scheduled meeting of the Planning Commission is
on January 27, 1997 beginning at 7:00 p.m., City Council Chambers,
300 Centennial Way, Tustin.
