FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - EDINGER AVENUE
WIDENING PROJECT, 1995-96 FY (PROJECT NO. 700127)
RECOMMENDATION
It is recommended that the City Council, at their meeting of February 3, 1997~ adopt Resolution
No. 97-03 accepting said work as complete and authorize the recordation of the Notice of
Completion, and direct the City Clerk to:
1. Release the labor and materials bond not sooner than thirty-five (35) days after the date
of recordation of the Notice of Completion.
2. Release the faithful performance bond not sooner than one year after the date of
recordation of the Notice of Completion.

Assuming no claims or stop notices are filed, it is further recommendex] that 35 days afar the date
of recordation of the Notice of Completion the City Council authorize payment of the final 10%
retention in the amount of $89,329.77 to Cornerstone C&M, Inc., dba Sully-Miller Contracting
Company. This amount together with previous payments totaling $803,969.91 represent 100% of
the final contact amount.
FISCAL IMPACT
The final cost of the construction contract for the Edinger Avenue Widening Project is $893,297.68
which includes two contract change orders to Cornerstone C&M, Inc., dba Sully-Miller
Contracting Company. The contract change orders were for work connected with unforeseen
conditions involving paving, traffic signals, sidewalk, retaining walls and conflicts with an existing
4' Pacific Bell telephone duct.
The City's Capital Improvement Program/Budget for 1995-96 FY provided $1,030,970 for final
design and construction of this project.
The Master Plan of Arterial Highways Program (MPAH) through the Measure "M" Combined
Transportation Funding Program (CTFP) provided an allocation of $483,450. The final City
construction cost including construction engineering will be reimbursed from the MPAH at a ratio
of 50% not to exceed the above allocation.
Recently, the Orange County Transportation Authority (OCTA) approved the County Smart Street
Program, and as a part of that, a segment of Moulton Parkway between Ritchey Street and Harvard
Avenue was included. The subject project is a part of that segment~and as a result the
~ii~,st~tis~n expenses should be reimbursed subject to the OCTA Board approval up to 100% City's.

BACKGROUND
This project provided for the widening of Edinger Avenue to major arterial standards from 2500'+
westerly of Jamboree Road to Harvard Avenue. Completion of this project was necessary to
accommodate the Eastern Transportation Corridor and the grade separation for the Jamboree
Rmd/F~inger Avenue intersection.
The work on this project has been completed by Cornerstone C&M, Inc., dba Sully-Miller
Contracting Company to the satisfaction of the Engineering Division.

A RF.~OLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA ACCEFrING THE WORKS OF
IMPROVEMENT AND AUTHORIZING RECORDATION OF
NOTICE OF COMPLETION FOR STREET
IMPROVEMENTS FOR EDINGER AVENUE WIDENING
FROM 2500~ +_ WES~Y OF JAMBOREE ROAD TO
HARVARD AVENUE .(PROJF~T NO. 700127)
WI-W-REAS, Comerstone C&M, Inc., dba Sully-Miller Contracting Company, having a
contract with the City of Tustin to construct the hereinafter described public works and
improvements; and
WHEREAS, the City Engineer has duly certified to the construction and completion of said
public improvements hereinafter mentioned in a manner satisfactory to the City Council of the
City of Tustin; and
WI-IEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of the
contract documents and the Notice of Completion, and acceptance of said public work and
improvement should "be filed and payment of the balance due said contract or authorized in
accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVF_.I) by the City Council of the City of Tustin that
said public work and improvement is found to be complete, and the same is hereby accepted.
Said public work and improvement is more particularly described as follows:
Street Improvements for Edinger Avenue Widening from 2500' + Westerly
of Jamboree Road to Harvard Avenue (Project No. 700127)
AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby
authorized to execute and file a Notice of Completion for the acceptance of said public works and
improvement described herein as required by law.
PASSED AND ADOPTED at a 3egular meeting of the City Council of the City of Tustin held
on the 34 day of February, 1997.
