A PROFESSIONAL CORPORATION MEMORANDUM NO. 12 2-3!97 TO: Honorable Mayor and Members of the City Council City of Tustin FROM: City Attorney DATE: RE: January 29, 1997 Designation of Assistant City Manager and DirectOr of Community DeveloPment as Persons Authorized on behalf of the City of Tustin to Review and Execute CEQA and NEPA Documents RECOMMENDATION: Adopt the enclosed resolution designating the Assistant City Manager and/or the Director of Community Development as persons authorized on behalf of the City to review and execute CEQA and NEPA documents. , DISCUSSION: The' designation of persons who are authorized to approve and execute CEQA and NEPA documents will centralize the environmental review process and ensure that knowledgeable persons are reviewing and executing CEQA and NEPA documents on behalf of the City. As various City departments are engaged in projects that require CEQA and NEPA review, centralized review responsibility is imperative. - Enclosure cc: William A. Huston, City Manager ' 1100-00012 41112_1 RESOLUTION NO. 97-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, DESIGNATING THE ASSISTANT CITY MANAGER AND/OR THE DIRECTOR OF COMMUNITY DEVELOPMENT AS PERSONS AUTHORIZED ON BEHALF OF THE CITY TO REVIEW AND EXECUTE CEQA AND NEPA DOCUMENTS WHEREAS, the California Environmental Quality Act (~CEQA") and the National 'Environmental Policy Act (~NEPA") require the City to 6 assign internal responsibility for determining the adequacy of environmental documents; and WHEREAS, due to the number of City projects in a variety of 8 departments, it is desirable to centralize that responsibility for ensuring compliance with CEQA and NEPA. 9 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, 10 CALIFORNIA, finds, determines and orders as follows: 1~ SECTION 1: That the Assistant City Manager and/or the Director of Community Development are designated as persons 12 authorized on behalf of the City to review and execute CEQA and NEPA documents. SECTION 2: The above-referenced designation, is not intended 14 to and does not relieve the City Council from its responsibilities under CEQA and/orNEPA to review and consider environmental documents 1§ and certify as to their adequacy before approving a project.
