JOINT MEETING- At 5:30 p.m. in the Community Center, the City COuncil 'will hold a joint meeting with the Audit Committee. This joint meeting is open to the public. CALL TO ORDER / PLEDGE OF ALLEGIANCE INVOCATION- The Invocation will be given by Captain Lee Lescano, Salvation Army Church. ROLL CALL PUBLIC INPUT- At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO ACTION can be taken on off-agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the blue forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. CORRIDOR MAJOi~ INVESTMENT STUDY PRESENTATION BY ORANGE COUNTY TRANSPORTATION AUTHORITY The Orange County Transportation Authority has initiated a public outreach/ involvement effort and has requested to be agendized to make a presentation to the City Council on the Corridor Major Investment Study. Recommendation: Receive and file subject report. 2. TUSTIN OLD TOWN ASSOCIATION Dr. William B. Stanford will be making a verbal presentation on behalf of the Tustin Old Town Association. APPEAL OF CONDI i IONAL USE PERMIT 96-37 AND DESIGN REVIEW 96-51 (PLAZA LAFAYETTE PARKING LOT EXPANSION) Applicant is requesting establishment of a commercial parking lot in a 50' by 314' portion of an abandoned railroad right-of-way located in the Multiple Family Residential (R-3) zoning district. Recommendation by the Community Development Department: 1. Open and close the Public Hearing. . Adopt the following Resolution No. 97-7 upholding the Planning Commission's action and denying the appeal of Conditional Use Permit 96-37 and Design Review 96-51' RESOLUTION NO. 97-7 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,~ CALIFORNIA, DENYING THE APPEAL AND UPHOLDING THE PLANNING COMMISSION'S ACTION TO APPROVE CONDITIONAL USE PERMIT 96-37 AND DESIGN REVIEW 96-51 AUTHORIZING THE ESTABLISHMENT OF A PARKING LOT ON A VACANT 50' BY 314' PORTION OF AN ABANDONED RAILROAD RIGHT-OF-WAY LOCATED TO THE NORTH OF THE PLAZA LAFAYETTE SHOPPING CENTER AT 13031 NEWPORT AVENUE AND TO THE WEST OF THE WOOD CREST APARTMENTS AT 12901-12943 NEWPORT AVENUE. 1 ZONE CHANGE 96-2 (SANDERSON J. RAY DEVELOPMENT CO.) Applicant is requesting to change the setback standards of the Neighborhood Commercial District of the East Tustin Specific Plan for single-story developments located adjacent to residential uses. The proposed amendment would accommodate construction of an'8,500 square foot retail building located at 13331 Jamboree Road. Recommendation by the Community Development Department: 1 Open and close the Public Hearing. 2. Adopt the following Resolution No. 97-11 approving the Environmental Determination for the project: RESOLUTION NO. 97-11 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) CERTIFIED FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS'ADEQUATE TO SERVE AS THE PROGRAM EIR FOR ZONE CHANGE 96-2 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Council Agenda 2 February 18, 1997 Se 3. APPROVAL OF MINUTES- FEBRUARY 3, 1997 REGULAR MEETING Recommendation: Approve the City Council Minutes of February 3, 1997. 1 APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,324,949.33 and ratify Payroll in the amount of $346,866.56. am PLANNING COMMISSION ACTION AGENDA- FEBRUARY 10, 1997 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of February 10, 1997. Sm PURCHASE OF PROPERTY AT 3075-3097 EDINGER AVENUE (COMMUTER RAIL STATION) Recommendation: Approve and authorize the City Manager to execute the Purchase and. Sale Agreement between AB REO IV, L.L.C. and the City of Tustin for a Commuter Rail Station, subject to minor modifications as may be required and approved by the City Attorney as recommended by the Assistant City Manager. TESTING FOR TAXICAB SERVICE PROVIDERS Government Code Section 53075.5 requires each city to adopt an ordinance regarding mandatory controlled substance and alcohol testing certification procedures for taxicab transportation service providers. Recommendation by the Police Department: 1. Have first reading by title only of Ordinance No. 1178. 2. Introduce the following Ordinance No. 1178: ORDINANCE NO. 1178 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTIONS 3412 AND 3415 OF THE TUSTIN CITY CODE REGARDING THE LICENSING AND OPERATION OF TAXICAB SERVICES 12. ADOPTION OF ORDINANCE NO. 1175 - CONFIRMING VOTERS' WISHES TO LIMIT CITY COUNCIL TERMS Ordinance No. 1175 was introduced at the February 3, 1997 City Council meeting.
