HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT RESOLUTION APPROVING AN APPLICATION FOR A BLOCK GRANT AND AUTflOR1ZING THE USE OF RECLAMA~ON FOR MANAGEMENT OF THE USED PROGRAM STATE USED OIL GREAT WESTERN OIL RECYCLING RECOMMENDATION Adopt resolution No. 97-14 approving an application for State grant funds in the amoum of $21,000 annually for a three year period to maintain and manage a used oil recycling program and authorize the use of Great Western Reclamation to manage the program. All fees for program development and BACKGROUND AND DISCUSSION On April 4, 1994, February 6, 1995 and November 20, 1995 the City Council approved successful' applications to the California Integrated Waste Management Board (CIWMB) for the California Used Oil Recycling Block Grant Program. At this time, the City may again apply for additional grant funds to continue the operation of the current program. Previous grants were issued for one year periods. This grant will be for a period of three years. The California Recycling Enhancement Act of 1991 establishes and provides grant funding for programs that increase the proper collection and recycling of used oil. The purpose of this State grant program is to provide funding to local governments for establishing and maintaining used oil collection programs and locally based used oil collection centers. This program will remain available through the year 2000. The grant will also support continued public education efforts which will focus on decreasing illegal dumping of used oil into landfills, storm drains and sewer systems and encourage the utilization of the City's new curbside used oil collection program. All programs will assist with National Pollutant Discharge Elimination System (NPDES) and AB 939 compliance. Funding is allocated on a per capita basis. At .31 cents per capita, the City is currently eligible for approximately $21,000. If the City is successful in obtaining funding for this grant cycle, the number of local collection centers for used oil will be maintained at the current level (three) and possibly increased if willing businesses can be recruited. Without continued state fimding, the City could either discontinue support for the program or continue the program by using City funds and staff. For the Used Oil Block Grant application, staff believes that the use of a comract firm is crucial to the success of the program in order to perform day-to-day management of the program and provide professional and technical support to the businesses which have become involved in various aspects of this program. Staff recommends the use of the services of Great Western Reclamation because they are uniquely qualified to continue operation and management of this program. Staff solicited, but did not receive a proposal from the current program manager. Great Western Reclamation has successfully submitted several prior applications during previous grant cycles and currently manages a program for the City of Santa Ana. They have a proven track record of success in developing and implementing various hazardous waste programs and continue to seek out new and innovative methods in the areas of oil and hazardous material recycling and disposal. Development and submittal of the grant application will be completed at no cost to the City. If the application is successful, Great Western Reclamation will be responsible for operating and managing the City's used oil program, and all program costs will be paid from grant funds, as has been done in the past. To proceed with the development of the grant application, a resolution approving an application for State grant funds and authorizing the use of Great Western Reclamation for program management is required. Director of Public Works/City Engineer Jo6/Yr~e~ers~ ;~' e'strative Assistant IL Public Works TD S :JM:klb: oilgmt Attachment RESOLUTION NO. 97-14 A RESOLUTION OF THE Crl~ COUNCIL OF THE Crl~ OF TUSTIN, CALIFORNIA APPROVING AN APPLICATION FOR GRANT FUNDS FROM THE CALIFORNIA USED OIL RECYCLING BLOCK GRANT PROGRAM TO OPERATE A USED OIL RECYCLING PROGRAM WltEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the California Integrated Waste Management Board (lWMB) has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures goveming application by cities and counties under the program; and WHEREAS, said procedures established by the California Integrated Waste Management Board require the applicant to certify by resolution the approval of application before submission of said application to the state; and WItEREAS, the applicant will enter into an agreement with the State of California for development of the project. NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Tustin Approves the filing of an application for the California Used Oil Recycling Block Grant Program under the California Oil Recycling Enhancement Act for state grant assistance for the project specified above; and . Appoint the Director of Public Works as agent of the City of Tustin to conduct all negotiations, execute and submit all documents including, but not limited to, applications, state and consultant agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project. . The City will retain the services of Great Western Reclamation of Santa Ana, CA to operate and manage a used oil program as approved by the State of Califomia, Integrated Waste Management Board.
