RECOMMENDATION:
1. Increase the General Fund transfer to the Liability Fund by an
additional $500,000 to replenish reserves for.future claims.
2. Transfer $900,000 from the Unappropriated Fund balance of the
General Fund to the Capital Projects Fund.
3. Increase the transfer from the Water Operations Fund to the
Water Capital Improvement Fund by an additional $2,247,032 to
fund identified capital projects.
DISCUSSION:
The attached report generally follows the format of the 1996-97
budget but the information is presented in summary form. Each
department has reviewed their areas of responsibility and have
provided the projections as they appear in the report. The
following report will touch on the significant items that impact
the various Funds of the City.
GENERAL FUND
The ending balance of the General Fund was $984,000 higher at the
close of the 1995-96 fiscal year than had been projected in the
approved 1996-97 budget. Audited revenues were $625,000 more than
we estimated when the budget for 1996-97 was prepared last spring,
and there was an additional savings of $357,000 in General Fund
expenditures that contributed to the adjusted beginning balance of
$4,623,855 for the 1996-97 fiscal year. The beginning and ending
1996-97 General Fund balances shown on page, one of the Midyear
Budget Review. reflect the adjustments from 1995=96 and the
recommended transfers as indicated above. The projected 1996-97
ending balance of $4,101,917 is 15.3% of projected expenditures
(including transfers to other funds) . City Council policy requires
a 15% fund balance.
REVENUES
Projected revenues for the fiscal year are $26,436,000. This is
slightly above budgeted revenues of $26,323,359.
Property Taxes are still fluctuating primarily due to valuation
appeals. Meetings with the Assessor's Office indicate that there
remains a back log of appeals in excess of one year. We may be
approaching a slow down of the decline in growth of assessed value
but it appears that it may continue for the next year or even two.
The current year's Property Tax Revenue projection of $3,,520..000 is
approximately 2.4% less than the 1996 receipts. We will continue
to monitor the appeals process in order to more accurately budget
revenues in this area.
Sales Tax revenue is continuing to grow at a better than Consumer
Price Index (CPI) rate. We are currently projecting Sales Tax
revenues of $13,130,000 which is an increase of 6.5% from the prior
year. Our sales tax auditors meet with us each quarter to go over
the details of where the growth in sales tax is appearing. Our
Business to Business and Auto Sales and Leasing categories continue
to be very strong. We have not experienced a serious drop in sales
tax income since the build out of the Tustin Marketplace and Auto
Center. Sales Tax income is a critical Revenue source to the City
since the primary source of income to cities has shifted away from
property taxes.
I have adjusted the interest income estimate down by $325,000.
Interest rates have stabilized to a narrow range and it does not
appear that they will increase in the near term. We have also
consciously transferred surplus funds to other critical areas such
as the Park Development and Capital Projects Funds, which increases
resources in those much needed areas but does reduce surplus cash
available for investment from the General Fund.
Motor Vehicle In -Lieu fees are projected to exceed the budgeted
amount by $241,000. The State Controller's Office provides
estimates of the expected per capita income for this subvention at
the beginning of each year and it appears that we will benefit from
higher than expected vehicle license fees. It's important to note
that the Motor Vehicle In -Lieu subvention is the third largest
revenue source to the General Fund.

Transfers -in from other Funds has been reduced by $124,,000 based on
revised estimates of costs through year end. For example, the
transfer to cover the first year expenses for the 800MHz system was
less than anticipated. A revised Inter -Fund Transfer schedule is
included on page two of the report.
EXPENDITURES
The General Fund expenditure detail includes the recommendation as
stated. Estimated expenses.prior to the recommended transfers to
the Liability and Capital Projects Funds were $251-392,F938" which is
3.2% under the authorized budget. Please note that the 1996-97
Budget column on page seven of the midyear review has not been,
adjusted to reflect the recommended transfers to the Liability and
Capital Projects Funds. Since they are included in 1996-97
Projected column, it gives the appearance that the projected
General Fund budget 'is out of balance by $558,704. When the
authorized budget amount is adjusted to reflect the additional
transfers (assuming the City Council approves the recommendation),
1996-97 projected General Fund expenditures are $841,296 (3.0%)
under the approved budget.
CAPITAL PROJECTS FUND
The Combined Fund Balance for the Capital Projects Fund at year end
is $6,128,815. Construction in progress accounts for $4.4 million
of the balance and $1.7 million is available for future projects.
The $4.4 million balance is earmarked for capital projects approved
in 1996-97. As indicated this balance includes the recommended
$900,000 transfer from the General Fund. During the 1997-98 budget
process we will need to appropriate $600,000 from this balance for
the Major Street Maintenance Programs in order to meet our Measure
M Maintenance of Effort (MOE) requirements. The City is eligible
to receive approximately $700,000 a year in Measure M Funds but
must continue to spend approximately $1.2 million a year on street
related projects from other than Measure M Funds in order to meet
each year's MOE. The Major Street Maintenance Program is a
significant component of our MOE.
MEASURE M FUNDS
The negative projected expenses of $97,525 shown in the Measure M
Fund is only temporary. Measure M Competitive Funds became
available for the Edinger Street Widening Project between Harvard
and Jamboree. A final accounting is expected to be completed prior
to year end to transfer eligible expenses to the Competitive Fund.
Measure M Turnback construction in progress at year end is
projected to be $430,469 and Measure M Competitive construction in
progress is projected at $1,067,205.

PARR DEVELOPMENT FIIND
The Park Development -Fund projected balance of $2,587,174 million
includes reserves for construction in progress of $1.4 million for
Cedar Glen Park. During the 1996-97 fiscal year, the City will
have access to $1 million in lease revenue bond proceeds to
complete construction of Heritage Way Park currently in design.
After allowing for committed parks projects the unencumbered Park
Development Fund balance is approximately $900,000.
REDEVELOPMENT AGENCY
The South Central Project Area is continuing to accumulate funds
for the Newport Avenue/Edinger Avenue underpass a
pi nificantproject,
g project which will facilitate the Pacific Center East
development. There are several related projects that are in
preliminary. engineering and design but no construction is underway
at this time.
The Town Center Project Area currently is reflecting reserves in
the Debt Service Fund consistent with outstanding bond documents.
The Capital Projects Fund has undesignated reserves of
approximately $2.8 million available for the Agency.
Housing set aside funds are earmarked for projects designated in
the City Council approved housing strategy plan.
WATER ENTERPRISE
The significant change in the Water Enterprise Fund is the $2.2
million increase in the transfer from Operations to the Water
Capital Improvement Fund projected by year end. These are Capital
Improvement Funds that are included in the rate structure and
transferred to the Capital Improvement Fund as needed. When the
authorized 1996-97 budget amount shown on page twenty-seven of the
midyear budget review is adjusted to reflect the transfer to the
Water Capital Improvement Fund, projected 1996-97 expenses are
$760,920 less than the authorized budget. The additional transfer
has been designated to be used on the Main Street reservoir and
well Project. The use of these funds will complete a major .project
identified in the Capital Improvement Program and postpone the
necessity to issue additional long term debt for Water Capital
Improvement projects.
The transfer between the Water Enterprise Fund and the General Fund
has not been adjusted from the budget amount. The final transfer
will be based on time keeping records and the Council approved
policy at year end. The transfer from the Enterprise to the Risk
Management Fund has been revised based on the input from the City's
Underwriter.

EQUIPMENT REPLACEMENT AND RISK MANAGEMENT FUNDS
The City's Equipment Replacement Fund balance represents the
designation of reserves for future replacement of the major rolling
stock owned by the City.
The Risk Management Funds consist of Workers Compensation,
Liability and Unemployment Compensation Funds. The City retains a
significant portion of the risk in these areas and purchases excess
insurance to meet -or surpass legal limits. The Workers
Compensation and Unemployment Funds are showing adequate reserves
at this time. Significant claims activity in the Liability Fund
for the past few years has depleted reserves to the extent that it
was necessary to include an additional transfers -in this year. We
will be looking -at this Fund during the 1997-98 budget process and
may make adjustments to future years' transfers.
CONCLUSION
Overall the financial picture of the City is currently healthy.
The operating funds are balanced, and there are reserve increases
in some areas. We also have significant capital improvement
activity in many areas including public facilities, parks and
streets. But it's evident that the Capital Improvement Fund and
Park Development Fund reserves are getting low. We also need to be
aware of the Maintenance of Effort requirement for Measure M Funds.
The $1.2 million annual expenditure requirement has a major impact
on each year's budget process and the risk of not meeting the MOE
is the loss of the full amount of the City's Measure M allocation
for t e year.
