PREPARATION OF AN ENGINEER'S REPORT FOR THE LEVY OF ANNUAL
ASSESSMEN'I~ FOR THE 199%98 FISCAL YEAR FOR THE TUSTIN
LANDSCAPE AND LIGHTING DISTRICT
RECOMMENDATION
It is recommended that the Tustin City Council, with the adoption of Resolution No. 97-23 order
the preparation of an Engineer's Report for the levy of annual assessments for the 1997-98 Fiscal
Year for the Tustin Landscape and Lighting District.
FISCAL IMPACT
None. All City costs will be recouped through the levy of the annual assessments for the District.
DISCUSSION
This action will be the initial phase of the process to levy annual assessments for Fiscal Year 1997-
98 for the Tustin Landscape and Lighting District and orders the preparation of the Engineer's
Report. The Engineer's Report will consider and incorporate applicable provisions of Proposition
218.
The District provides funding for the ma/ntenance of the perimeter landscaping on the arterial
highways within the Tustin Ranch area and for the operation and maintenance of the street lighting
within the Tustin Ranch area and other locations within the City.
Three additional City Council actions will be required as the process proceeds:
· First, the adoption of a resolution approving the Engineer's Report which is tentatively
scheduled for April 21, 1997.
Second, the adoption of a resolution declaring the City Council's intention to annex
additional territory, pending receipt of the appropriate documentation, to the district and
to provide an annual levy of assessment which is also tentatively scheduled for April 21,
1997. This resolution will set the date for a public heating in June 1997.
The territory to be annexed consists of three parcels that have been approved for
development this past year in various parts of the City and as part of the approval
process were conditioned to be annexed to the Tustin Landscape and Lighting District.
The third resolution will canvas property owner approval and if approved, will order the
annexations and the levy of annual assessments outlined in the Engineer's Report. This
resolution will be considered for City Council action after the public hearing in June
1997.

FOR THE 199%98 FISCAL YEAR FOR THE TUSTIN
IAaNDSCAPE AND LIGHTING DISTRICT
WHEREAS, it is the intention of the City Council of the City of Tustin to levy annual
assessments for the 1997-98 fiscal year for the Tustin landscape and Lighting District; and
WltF~REAS, substantial changes in existing improvements have occurred by reason of new
subdivided parcels, new landscaped areas and new street light facilities to be maintained by said
District; and
WltEREAS, BSI Consultants, Inc., doing business as Berryman and Henigar (B&H), is under
· Contract to provide professional engineering-, serviCes, in Connection- with said 'District 'under the-
direction of the Director of Public Works/City Engineer.
NOW, THEREFORE, BE IT RF_~OLVED by the City Council of the City of Tustin that the
Director of Public Works/City Engineer is hereby ordered to prepare and file, through B & H, the
Engineer's Report for the levy of annual assessments for the 1997-98 fiscal year for the Tustin
Landscape and Lighting District.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held
on the 17~ day of March 1997.
