CITY OF TUSTIN
MARCH 11 1993 - 7:00 P.M.
The City Council meets the first and third Monday of each month at 7:00
p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for
public use in the City of Tustin agenda books located in the Police
Department and the Tustin Public Library. These same books are also
provided for public use at the Senior Center during the Council meeting.
Listening devices for the hearing impaired are available upon request
from the City Clerk. Smoking is prohibited during the Council meeting.
Distribution of Material to City Council: If you have material you wish
to distribute to the City Council regarding an item on the agenda, please
give the material to the City Clerk prior to the meeting. This will
allow the City Council sufficient time to review the material prior to
taking action.

1. CODE AMENDMENT 92-005 (SMART SMR)
The applicant, SMART SMR of California, Inc., has been
authorized by the Federal Communications Commissions to
construct and operate the first dual-purpose digital mobile
radio system in the United States.
Recommendation by the Community Development Department:
a. Certify the Negative Declaration as adequate for the
project by adopting the following Resolution No. 93-18:

ORDINANCE NO. 1097 - AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS
OF ARTICLE 9 OF THE TUSTIN CITY CODE AND TWO PLANNED
COMMUNITY DISTRICT REGULATIONS TO ALLOW CERTAIN ANTENNAS

VII. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will
be no separate discussion of these items prior to the time of the
voting on the motion unless members of the Council, staff or public
request specific items be discussed and/or removed from the Consent
Calendar for separate action.
1. APPROVAL OF MINUTES - FEBRUARY 16, 1993 REGULAR MEETING
Recommendation: Approve the City Council Minutes of February
16, 1993.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of
$2,750,969.50 and ratify Payroll in the amount of
$307,587.48.
3. RESOLUTION NO. 93-12 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF
CERTAIN CITY RECORDS, DOCUMENTS, AND PAPERS IN THE POSSESSION
OF THE CITY CLERK'S OFFICE OF THE CITY OF TUSTIN NO LONGER
REQUIRED FOR THE CONDUCT OF CITY BUSINESS PURSUANT TO THE
AUTHORITY GRANTED BY SECTIONS 14811, 14821, 14971, AND 14981 OF
THE ELECTIONS CODE OF THE STATE OF CALIFORNIA
Recommendation: Adopt Resolution No. 93-12 approving
destruction of specified documents pertaining to the April
14, 1992 General Municipal Election as recommended by the
City Clerk's Office.
4. RESOLUTION NO. 93-20 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR SIDEWALK AND WHEELCHAIR RAMPS - SB 821 PROJECT, 1992-93 FY
Recommendation: Adopt Resolution No. 93-20 approving the
plans and specifications for subject project and directing
the City Clerk to advertise for bids as recommended by the
Public Works Department/Engineering Division.

6. REIMBURSEMENT AGREEMENT - RECLAIMED WATER FACILITIES IN TUSTIN
RANCH ROAD AND THROUGH THE I-5 BRIDGE
Recommendation: Approve the reimbursement agreement between
the Irvine Ranch Water District and the City of Tustin for
construction of Reclaimed Water Facilities in Tustin Ranch
Road and through the I-5 Freeway overpass, subject to the
City Attorney's review and approval, as recommended by the
Public Works Department/Engineering Division.
7. RESOLUTION NO. 93-21 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF
CONFIDENTIAL EMPLOYEES
Recommendation: Adopt Resolution No. 93-21 concerning
compensation of confidential employees as recommended by the
City Manager.
S. APPROVAL OF MEMORANDUM OF UNDERSTANDING WITH TUSTIN MUNICIPAL
EMPLOYEES ASSOCIATION
Recommendation: Authorize the City Manager to execute the
Memorandum of. Understanding with the Tustin Municipal
Employees Association as recommended by the Administrative
Services Department.

X. OLD BUSINESS
1. CITY OF TUSTIN RESOLUTION NO. 93-17 AUTHORIZING EXCEED THE LIMITATION
OF PROPOSALS FOR THE PURCHASE OF I
AGGREGATE PRINCIPAL AMOUNT OF CERTIFICATES OF PARTICIPATION
In August of 1992, the City Council received a report
describing certain storage capacity and distribution system
deficiencies in the City's water system. A public workshop was
held to review the engineer's report and evaluate a Rate Study
and Financing Plan that was prepared to accomplish the goals
recommended by staff and the consulting engineers. The City
Council directed staff to proceed with recommendations
regarding the issuance of bonded debt as detailed in the
financing plan.
Recommendation: Adopt the following Resolution No. 93-17 as
recommended by the Finance Department:

2. TUSTIN COMMUNITY NON-PROFIT FOUNDATION
Status report on the formation of the Tustin Community Non -
Profit Foundation.
Recommendation: Pleasure of the City Council.
3. AIRPORT STATUS REPORT
The Community Development Department has continued to monitor
airport issues.
Recommendation: Receive and file subject report as recommended
by the Community Development Department.
4. REQUEST TO REMOVE PARKING RESTRICTIONS ON MYFORD ROAD AND
HERITAGE WAY (ARCADA CONDOMINIUM DEVELOPMENT - EAST TIISTIN
TRACT NO. 13096)
At the City.Council meeting of December 21, 1992, the Council
considered an item entitled, Request to Remove Parking
Restrictions on Myford Road and Heritage Way".
Recommendation: Continue this item until further notice as
recommended by the Public Works Department/Engineering
Division.
XI. NEW BUSINESS
1. RECOMMENDATIONS FOR FUTURE TIISTIN TILLER DAYS CELEBRATIONS
Staff has received a letter from the Tustin Tiller Days Chair,
Executive Council and Board of Directors indicating that they
have chosen to discontinue their participation in Tiller Days
activities.
Recommendation by Community Services Department:
a. Limit the 1993 Tiller Days celebration to include only the
parade and a one -day festival to coincide with the
dedication of the Civic Center.
b. Establish a blue ribbon committee to study Tiller Days and
provide recommendations to the City Council about the
organization of future Tiller Day events.
2. CITIZEN REQUEST FOR MODIFICATION TO ON -STREET PARKING
RESTRICTIONS ALONG EL CAMINO REAL AND SIXTH STREET IN THE
DOWNTOWN AREA
At the February 1, 1993 City Council meeting, Mr. Dick Edgar,
a resident of Tustin, requested that parking restrictions along
the east side of El Camino Real between Sixth Street and the
driveway at 441-461 E1 Camino Real adjacent to the existing

vacant prod be modified to allow a' ager parking period,
basically tt, -accommodate parking for ilh,�tings of the Tustin
Assistance League.
Recommendation by the Public Works Department/Engineering
Division: Modify parking along E1 Camino Real and Sixth Street
in the downtown area to include:
a. Removal of the existing two-hour time restricted parking
limits along the east side of E1 Camino Real between Sixth
Street and the driveway at 441-461 E1 Camino Real
(Assistance League).
b. Removal of the existing two-hour time restricted parking
limits along the north side of Sixth Street between E1
Camino Real and the east property limit of the current
vacant lot on the north-east corner of El Camino Real/Sixth
Street.
c. Installation of signs in the aforementioned area
restricting any on -street parking from 10:00 p.m. to 5:00
a.m.
3. FIRE PROTECTION DISTRICT - PHASE III STUDY
The City Council previously authorized the City's participation
in the study concerning the feasibility of creating a fire
protection district.
Recommendation: Authorize the City to participate in Phase III
of the fire protection district study as recommended by the
City Manager.
4. FIRE CONTRACT
The City is participating in the negotiations to create a fire
district. The current schedule provides for formation of the
fire district effective January 1, 1994. Extension of the fire
contract with the County through June 30, 1994 will.provide a
six-month overlap.
Recommendation: Approve Amendment #3 to the agreement between
the City and the County for fire suppression and paramedic
services as recommended by the City Manager.
%II. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - FEBRUARY 22, 1993
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda
of February 22, 1993.
2. SPORTS PARR MASTER PLAN UPDATE
The City Council has requested updates on
preparation of the Master Plan, working
specifications for the Sports Park.

3. STREET LIGHTING AT THE NEWPORT AVENIIE/MAIN STREET INTERSECTION
At the February 16, 1993 City Council meeting, Councilmember
Saltarelli raised a concern regarding the lighting at the
Newport Avenue/Main Street intersection during the Main Street
Rehabilitation Project currently in progress.
Recommendation: Receive and file subject report as recommended
by the Public Works Department/Engineering Division.

XV. CLOSED SESSION
The City Council will recess to Closed Session pursuant to
Government Code Section 54956.8 to give instructions to the City's
negotiator regarding negotiations with Harold Neher concerning the
rights/purchase/sale/exchange/lease of the property located at
13331 Foothill Boulevard, Santa Ana; and regarding negotiations
with U & M Incorporated concerning the rights/purchase/sale/
exchange/lease of the property located at 240 East Third Street,
Tustin.
XVI. ADJOURNMENT
The City Council has scheduled a joint meeting with the Tustin
Unified School District Board of Education on March 11, 1993, 6:00
p.m., at the Tustin Area Senior Center; and the next regular
meeting of the City Council is scheduled for Monday, March 15,
1993, 7:00 p.m., at the Tustin Area Senior Center.
