RESOLUTION NO. 83-17 - A Resolution of the City Council of the City of Tustin, California, APPROVING PLANS AND SPECIFICATIONS FOR EXTERIOR PAINTING OF TUSTIN CIVIC CENTER COMPLEX Adopt Resolution No. 83-17 as recommended by the Engineering Department · 39 10. FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE 0F BONDS, TRACT NO. 10979 (Office Condominium southerly of Main Street, between "B" and "C" Streets - Stevens Square Development) Accept all public improvements within Tract No. 10979 and authorize the release of the following bonds: Bond No. 392979, Faithful Performance - $125,500.00; Bond No. 392979, Labor and Materials- $62,750.00; and Bond No. 392982, Monu- mentation - $3,400.00 as recommended by the City Engineer. 99 Censent Calendar Item No. 4 - Sales Tax Audit Agreement - In response to Councilman Hoesterey, the City Manager clarified that the consultant fees will be paid based on incremental sales tax revenues the City will receive from the State Board of Equaliza- tion. Pursuant to the recommendation contained in the report dated February 14, 1983, prepared by the Finance Director, it was moved by Eoesterey, seconded by Kennedy, to approve the following: 4. SALES TAX AUDIT AGREEMENT Authorize the City Manager to sign the subject agreement for sales tax auditing services with Municipal Resource Consul- tants. Carried 5-0 · 45 Censent Calendar Item No. 9 - Sale of Surplus vehicles and equip- ment- The Director of Public Works responded to Councilman Salta~7 relli that all vehicles have been replaced and are now totally sur- plus. As recommended in the report dated February 15, 1983, pre- pared by the Director of Public Works, it was then moved by Salta- relli, seconded by Kennedy, to approve the following: 9. Sale OF SURPLUS VEHICLES AND EQUIPMENT Declare the ten passenger vehicles and three pieces of equipment as outlined in the report dated February 15, 1983, as surplus property that is not required for public use. Carried 5-0. 87 VII. ORDINANCES FOR INTRODUCTION - None VIII. ORDI- NANCES FOR ADOPTION 1. ORDINANCE NO. 883 - An Ordinance of the City Council of the City of Tustin, California, ENDING THE TUSTIN CITY CODE RELATIVE TO CITY COUNCIL MEETINGS (Urgency Ordinance) It was moved by Boesterey, seconded by Kennedy, that Ordinance No. 883 have first reading by title only. Carried 5-0. Follow- ing the reading of title of Ordinance No. 883 by the City Clerk, it was moved by Kennedy, seconded by Hoesterey, that Ordinance No. 883 be introduced. Motion carried 5-0. It was then moved by Hoesterey, seconded by Saltarelli, that Ordinance No. 883 have second reading by title only. Carried 5-0. Following the second reading of title of Ordinance No- 883 CITY COUNCIL MINUTES Page 3, 2-22-83 by the City Clerk, it was moved by Hoesterey, seconded by Greinke, that Ordinance No. 883 be passed and adopted as an urgency ordinance. In response to Mayor Pro Tern Kennedy, the City Attorney stated that Council can change the meeting time back to 7:30 p.m. if 7:00 p.m. proves unfeasible. Roll call vote: AYES: Edgar, Greinke, Hoesterey, Kennedy, Saltarelli NOES: None ABSENT: None 38 IX. OLD BUSINESS 1. COLUMBUS-TUSTIN PLAN The City Manager presented the staff report and reconunendation as contained in his inter-corn dated February 15, 1983. Mayor Pro Tem Kennedy requested a workshop on the matter. It was the Council's consensus to delay scheduling a workshop until receipt of the staff report on operation and maintenance costs of the proposed facility. It was then moved by Hoesterey, seconded by Greinke, to continue this item to the March 2~, ~983, meeting. carried 5-0 · 77 2. TWO HOUR PARKING RESTRICTION - SANTA FE DRIVE The Director of Public Works presented the staff report as con- tained in his inter-corn dated February 2, ~983, and recommended that Council deny the request for removal of the "2 Hour Parking ~ = Anytime~' restriction along Santa Fe Drive Between Red Hill ! Avenue and Woodland Avenue. Ted Guarriello, Nursery Supplies West, Inc., suggested that, in addition to eliminating the two-hour parking restriction, park- ing be prohibited from dusk to dawn. In response to Councilman Saltarelli's request for alternatives, the Chief of Police requested that this matter be continued to allow further staff investigation. It was then moved by Salta- relli, seconded by Kennedy, to continue the item to March ~, ~983. Motion carried 5-0. 74 X. NEW BUSINESS 1. TILLER DAYS STREET FAIRE REQUEST FOR FUNDING Cherrill Webb, Tiller Days Street Fairs Chairperson, presented the report and financial summary on the 1982 Tustin Tiller Days and requested $6,000 in City funds for the ~983 event. Mrs. Webb recommended that lighting be rented in lieu of purchasing at this time. councilmen Hoesterey suggested that Mrs. Webb work with staff on the possibility of dual signatures on expenditure checks. Mrs. Webb responded that the only foreseeable problem is that the other signator would not be available to sign expense checks paid during the three festival days, i.e., trash cans, sanita- tion, carnival personnel, and performers. It was then moved by Greinke, seconded by Edgar, to approve allocation of $6,000, plus $798 for lighting rental' for the 1983 Tustin Tiller Days Street Fairs. Mrs. Webb responded to Council concerns, stating that there is now a waiting list for booth rentals; the reason for lighting rental vs. purchase is that as the fairs grows, a larger site may have to be considered in the future; the City would be first in line to receive any profits; food vouchers will be given out again to fairs workers (Marines, Police and Committee members); and relayed plans for a more prosperous fairs. CITY COUNCIL MINUTES Page 4, 2-22-83 Councilmeters made favorable comments on the 1982 Tustin Tiller Days Faire. Mayor Edgar encouraged the committee to maintain the "hometown flavor" of the faire. Mrs. Webb concurred. The motion carried 5-0. 34 XI. REPORTS 1. PLANNING COMMISSION ACTION AGENDA Council concurred to receive and file the action agenda of the Planning Commission. 80 2. BULLET TRAIN The City Manager presented an update on the bullet train issue and action staff has taken on the matter. Couacil discussion followed. Councilman 8altarelli suggested that the City Attor- ney determine the possibility of restricting speed limits of trains passing through Tustin and of acquiring land scheduled for the bullet train route in order to control the right of way. Council concurred. 101 3. MID YEAR BUDGET The City Manager presented the staff report. AS recommended in his inter-com dated February 16, 1983, it was moved by Greinke, seconded by Hoesterey, to continue the matter to the March 21, 1983, meeting. Carried 5-0. 29 4. WATER SERVICE MANAGEMENT PLAN The City Manager commented briefly on subject item. It was moved b~ Greinke, seconded by Hoesterey, to continue the matter to the March 21, 1983, meeting. Motion carried 5-0. 107 XlI. BUSINESS 1. REQUEST FOR CLOSED SESSION The City Manager requested a closed session for discussion of personnel matters 2. ORANGE COUNTY TRANSPORTATION PROBLEMS Councilman Saltarelli requested that a response be sent to Supervisor Nestdude expressing the City's concerns regarding the transportation problems in Orange County. ' 101 3. GREINKES' 31ST WEDDING ANNIVERSARY The Council joined Councilman Saltarelli in congratulating Councilman Frank and Margaret Greinke on their 31 st Wedding Anniversary. 4. WEED ABATEMENT - TUSTIN MEADOWS & PEPPERTREE Councilman Hoesterey requested that staff contact the railroad company about the tall weeds growing between Tustin Meadows and Peppertree residential areas. 108 5. RESIDENTIAL SPEED HUMPS Mayor Edgar presented a report on reducing speeding traffic in residential areas by installing speed humps, rather than speed bumps, as reported in an article on the City of Thousand Oaks. Councilman Hoesterey responded that test case results are not yet ready, and there are concerns about potential liability and emergency vehicle response tim being affected by same. The CITY COUNCIL MINUTES Page 5, 2-22-83 City Manager indicated staff would obtain a copy of the State's comprehensive study on the matter, report back to Council, and have the City Attorney address same from a legal standpoint. 6. KUDOS TO TUSTIN NEWS REPORTER, JOHN ORE Mayor Pro Tem Kennedy congratulated John Orr, Tustin News reporter, upon receiving the California Newspaper Publishers Association (CNPA} Award for Best Individual Spot News Reporting in the weekly category. Councilwoman Kennedy requested that the Mayor send a congratulatory letter to Mr. Orr. Council con- curred · 84 7. SMOKE DETECTOR ORDINANCES Mayor Edgar reported that Mrs. Edgar has been active in a fire committee, and a matter of committee discussion several weeks ago was the fact that the City ordinance adopted pertaining to installing smoke detectors in every residence was not the best ordinance that should exist in terms of the City's capacity to monitor, check, etc · County Fire Department staff indicated there is a degree of ordinance refinement that should be made to allow a better job of monitoring and checking. The Mayor con- tinued it was his understanding that the City ordinance was derived from what was recommended by the County, but if there is significant upgrading to the existing ordinance, then it's appropriate for the City to do so. Mrs. Edgar clarified that a few weeks ago a member of the Orange County Fire Department attended their committee meeting and pulled the Tustin ordinance apart, in particular, where he said it would not hold up in court because the ordinance does not say who is responsible. The City Manager stated that the County Fire Department was very actively involved in the ordinance adoption, and they assured the City that enforcement would not be a problem. He indicated he would discuss the matter with the Fire Chief. CLOSED SESSION & ADJOURNMENT At 8:28 p.m. the Council recessed to a Closed Session for discussion of personnel matters, thence to a breakfast at O'Keefe's Restaurant on Thursday, February 24 at 7:30 a.m., and thence to the next regu- lar meeting on March 7, 1983, at 7:00 p.m.
