SUBJECT: PROGRAM FOR THE CITY OF TUSTIN WATER SERVICES
RECOMMENDATION:
Adopt Resolution No. 93-9 Establishing an Agriculture Water Credit
Program for the City of Tustin Water Services.
BACKGROUND:
As directed by Council, staff has established an Agriculture Water
Credit Program (AWCP) with an effective date of November 1, 1992.
During the Water Rate Workshop,Council directed staff to provide
water credit for the agriculture (AG) users within our service
area. Metropolitan Water District (MWD) stopped offering any kind
of AG credit in March of 1991, prior to that the AG credit received
was passed through to eligible AG users.
DISCUSSION:
The adoption of Resolution No. 93-9 will establish and detail the
requirements needed to obtain AG water credit. AG users who meet
all requirements will be eligible for a ten (10) percent discount
from the water consumption charges on the AG meter. Credit will
only be given on the water consumption charge and not on the fixed
charge, which is predetermined based on meter size and system
demand. The City of Tustin Water AG Credit requirements are as
follows:
■ The land parcels must be in AG use, does not include
ornamental horticulture.
■ The AG land must be a minimum of three acres.
■ The AG product must be grown for profit and resale.
■ The water meter must serve only agricultural land.
■ Request for AG credit must be received within 90 days
from billing date.

The City of Tustin Water Services will make inspection checks to
verify requirements are met. Customers meeting all requirements
will be given a credit after a request is received and the account
is verified to make sure no "past due" amounts are owed. If there
are any unresolved issues regarding the water bill, the customer
must make a deposit payment equal to the average of the preceding
12 months bill to avoid late charges or possible service
disconnection. Upon resolution of the problem the deposit will be
refunded or applied to the customers account. The request for
Agriculture Water Credit form (attached), must be received within
90 days after the invoicing period. Requests received after the 90
day period will not be eligible for credit.
It is anticipated that approximately one thousand dollars
($1,000.00) in AG credits will be given out annually. The City of
Tustin Water Services will bear all costs because MWD no longer has
an AG credit program and does not anticipate any changes in the
future. Staff will continue to monitor the AG credit program to
ensure all eligible AG users are benefiting from the program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN CALIFORNIA, AUTHORIZING THE
ESTABLISHMENT OF AN AGRICULTURE WATER CREDIT
PROGRAM FOR THE CITY OF TUSTIN WATER SERVICES
WHEREAS, the City Council of the City of
Tustin, California, does hereby acknowledge that
agriculture is an important facet to the community;
and
WHEREAS, the Metropolitan Water District (MWD)
in March, 1991 eliminated Water Agriculture Credits;
and
WHEREAS, the City Council adopted new water
rates effective November 1, 1992; and
WHEREAS, in recognition of the water rate
increase having an effect on agriculture, the City
Council does hereby establish an Agriculture Water
Credit Program; and
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Tustin that all agricultural
water users who meet all requirements will be
eligible for a ten (10) percent discount from the
water consumption charges on their. water
agriculture meter; and
BE IT FURTHER RESOLVED that all the following
requirements must be met in order to obtain credit:
■ The land parcels must be in agricultural use;
and
■ The agriculture land must be a minimum of
three acres; and
■ The agriculture product must be grown for a
profit and resale; and
■ The water meter must serve only agriculture
land; and
■ The request for agriculture water credit must
be received within 90 days from billing date;

BE IT FURTHER RESOLVED that the City of Tustin
will credit customers accounts after all
information is received and is verified; and
BE IT FURTHER RESOLVED that the Agriculture
Water Credit Program for the City of Tustin Water
Service shall commence on November 1, 1992.
PASSED AND ADOPTED at a regular meeting of the
City Council of the City of Tustin, California,
held on the 1st day of February , 1993.
