The City Council meets the first and third Monday of each month at 7:00 p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited during.the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. VI. CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. CITY COUNCIL AGENDA PAGE 1 JANUARY 19, 1993 1. APPROVAL OB NUTES - JANUARY 4, 1993 - 31AR MEETING Recommend -.Lon: Approve the City Cou._ jl Minutes of January 4, 1993. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $607,108.29 and ratify Payroll in the amount of $297,929.69. 3. REJECTION OF CLAIM NO. 92-51 - CLAIMANT, GARY GREEN; DATE OF LOSS, 6/2/92; DATE FILED WITH CITY, 11/2/92 Recommendation: Reject subject claim for property damages in the amount of $80.00 as recommended by the City Attorney. 4. REJECTION OF CLAIM NO. 92-40 - CLAIMANT, FARMERS INSURANCE; DATE OF LOSS, 6/25/92; DATE FILED WITH CITY, 9/1/92 Recommendation: Reject subject claim for property damages in the amount of $2,135.14 as recommended by the City Attorney. S. RESOLUTION NO. 93-04 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR MEDIAN ISLAND AND CUT SLOPE LANDSCAPE AND IRRIGATION IMPROVEMENTS ALONG JAMBOREE ROAD BETWEEN TUSTIN RANCH ROAD AND THE NORTHERLY CITY LIMITS Recommendation: Adopt Resolution No. 93-04 approving the plans and specifications for landscape and irrigation improvements for the median islands and cut slopes along Jamboree Road between Tustin Ranch Road and the northerly City limits and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 6. YORBA STREET AHFP PROJECT NOS. 1293 AND 1294 RIGHT-OF-WAY CERTIFICATION Recommendation: Authorize the Mayor and City Clerk to execute the subject right-of-way certification as recommended by the Public Works Department/Engineering Division. 7. LAMBERT SCHOOL LEASE RENEWAL Recommendation: Renew lease with the Tustin Unified School District for use of Lambert School for a period of one year commencing on February 1, 1993 and ending January 31, 1994, and authorize the Mayor to execute subject lease as recommended by the Community Services Department. VII. ORDINANCES FOR INTRODUCTION - None VIII. ORDINANCES FOR ADOPTION - None IX. OLD BUSINESS 1. STATUS REPORT - ALMERIA HOMEOWNERS ASSOCIATION TRAFFIC ISSUES At the June 15, 1992 and July 20, 1992 City Council meetings, the Council directed staff to continue to coordinate the review of traffic related issues within the Almeria Development. Recommendation: Approve the following actions regarding the Almeria Development within the Tustin Ranch area as recommended by the Public Works Department/Engineering Division: CITY COUNCIL AGENDA PAGE 2 JANUARY 19, 1993 a. Approve n concept, the possible i allation of a four -foot wide, s.--..y-foot long, raised lands fed median on Palermo at the entrance to the Almeria Development from Tustin Ranch Road. b. Recommend removal of the unauthorized "Slow Watch For Children" signs throughout the Almeria Development. 2. STATUS REPORT: GENERAL PURPOSE NON-PROFIT FOUNDATION The City Council authorized attorney John Francis to prepare the By-laws and Articles of Incorporation for a general purpose non- profit foundation. Recommendation: Pleasure of the City Council. 3. COSTCO COMPLETION UPDATE Status update on the outstanding items related to the completion of Costco. Recommendation: Pleasure of the City Council. 4. SPORTS PARK MASTER PLAN UPDATE AND APPROVAL OF DESIGN CONTRACT FOR WORKING DRAWINGS AND BID DOCUMENTS The City has a Consultant Services Agreement with Anthony and Langford for the Master Plan phase of the Sports Park. This Agreement provides that the City will decide whether the consultant should proceed with the working drawings at the time of review and approval of the Master Plan. Recommendation by the Community Services Department: a. Authorize a Consultant Services Agreement with Anthony and Langford for $210,000.00 to prepare bid documents for a phased construction project. b. Review the Scheme D site plan. Provide input for the Parks and Recreation Commission review on January 21, 1993. X. NEW BUSINESS - None XI. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - JANUARY 11, 1993 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of January 11, 1993. 2. AMERICANS WITH DISABILITIES ACT PROGRAM AND SERVICES TRANSITION PLAN The Americans with Disabilities Act is a comprehensive national mandate enacted to eliminate discrimination of practices and barriers on the basis of a disability, guarantee access, and CITY COUNCIL AGENDA PAGE 3 JANUARY 19, 1993 provide eq opportunities in the 3t integrated setting appropriate. Recommendation: Receive and file the Programs and Services Transition Plan prepared for compliance with the Americans with Disabilities Act as recommended by the Community Development Department. 3. STATUS UPDATE - ARCADA COMMUNITY ASSOCIATION'S REQUEST TO REMOVE ON -STREET PARKING RESTRICTIONS ON MYFORD ROAD AND HERITAGE WAY At the City Council meeting on December 21, 1992, staff was directed to conduct an internal study to consider easing parking restrictions on Myford Road and Heritage Way. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 4. FREEWAY CONSTRUCTION STATUS Informational report relating to both freeway and local street closures as they pertain to the Tustin area. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 5. STATUS REPORT: FUTURE NEWPORT AVENUE EXTENSION TO EDINGER AVENUE At their meeting of December 21, 1992, the City Council considered an item that addressed future Edinger Avenue grade separations at Tustin Ranch Road and at Red Hill Avenue, and the future extension of Newport Avenue to Edinger Avenue. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 6. ROOSTER UPDATE The City Council requested that this issue be monitored and .reviewed in six months to determine whether the requirements imposed by Ordinance No. 1090 were mitigating the noise problem created by crowing roosters in the neighborhood. Recommendation: Receive and file subject report as.recommended by the Community Development Department. 7. RESEARCH ON BEAUTIFICATION COMMITTEE At the December 7, 1992 City Council meeting, Councilmember Thomas requested a status report on the concept of creating a "Beautification Committee". Staff has researched the concept and investigated other cities and how their committees are structured. Recommendation: Pleasure of the City Council. S. JAILS AND BOOKING FEES The City Council requested information on the feasibility of converting the present Police Department holding cells to a jail CITY COUNCIL AGENDA PAGE 4 JANUARY 19, 1993 facility in '.ch arrestees could be ker ntil their court dates. Recommendation: Receive and file subject report as recommended by the Police Department. 9. VEHICLE CODE - CITY ORDINANCES The City Council requested information on the feasibility and legality of prosecuting violators of the California Vehicle Code under Tustin City ordinances, if such were enacted, to duplicate the Vehicle Code. ADJOURNMENT The City Council has scheduled the following meetings: A joint meeting with the Planning Commission on January 20, 1993, at 6:00 p.m.; a joint meeting with the Parks and Recreation Commission on January 28, 1993, at 6:00 p.m.; a joint meeting with the Audit Committee on February 1, 1993, at 5:30 p.m.; and the next regular meeting of the City Council is scheduled for Monday, February 1, 1993, at 7:00 p.m. All meetings will be held at the Tustin Area Senior Center. • CITY COUNCIL AGENDA PAGE 5 JANUARY 19, 1993
