SUBJECT: YORBA STREET AHFP PROJECT NOS. 1293 AND 1294 RIGHT-OF-WAY
CERTIFICATION
RECOMMENDATIONS:
It is recommended that the City Council, at their meeting of
January 19, 1993, authorize the Mayor and the City Clerk to execute
the attached right-of-way certification.
BACKGROUND:
The attached right-of-way certification establishes that all right-
of-way has been acquired, or condemnation suit has been filed and
an order of immediate possession has been taken on all parcels not
acquired by negotiations.
At the City Council meeting of July 20, 1992, the City Council
accepted four offers of dedication with the adoption of Resolution
No. 92-92.
Resolution No. 92-151 was adopted at the City Council meeting of
December 22, 1992, which initiated eminent domain proceedings to
acquire the temporary construction easement at the last remaining
parcel. Subsequently the City Attorney's office has obtained an
order of immediate possession, which enables the City the legal
right to enter the property for the purpose of constructing the
proposed street improvements.
DISCUSSION:
Once the right-of-way certification has been completed, the County
will forward the Administration Agreement to the City for execution
and then returned to the County for execution by the Board of
Supervisors. The County will then authorize the City to advertise
for bids.

RIGHT-OF-WAY CERTIFICATION
The City of Tustin hereby certifies in connection with the
right-of-way for AHFP Project Nos. 1293 and 1294, Yorba Street from
First Street to Irvine Boulevard that:

1. All right-of-way has been acquired, or condemnation suit
has been filed and order of immediate possession has been
taken on all parcels not acquired by negotiation.
2. Existing improvements (check which apply):
( X ) No building improvement nor utility exists in the
right-of-way area; or
( ) The following improvements do exist in the right-
of-way area but will be removed before the
contractor enters to perform the construction.
However, no delay will be occasioned to the
contractor by these obstructions; or
( ) The following improvements do exist within the
right-of-way area but same will not in any way
interfere with proposed construction:
3. Utilities which have prior rights and which will require
relocation are as follows:
In making this certification, the City of Tustin agrees to
hold the County harmless from the liability which may arise by
reason of the County's reliance upon this Certificate and its
use of said rights-of-way.
