HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: AMERICANS WITH DISABILITIES ACT PROGRAM AND SERVICES TRANSITION PLAN RECOMMENDATION It is recommended that the City Council receive and file the Programs and Services Transition Plan prepared for compliance with the Americans with Disabilities Act (ADA). BACKGROUND AND DISCUSSION On July 26, 1990, the ADA became law. The ADA is a comprehensive national mandate enacted to eliminate discrimination of practices and barriers on the basis of a disability, guarantee access, and provide equal opportunities in the most integrated setting appropriate. As part of the requirements necessary to meet the provisions of the ADA, the City conducted a comprehensive audit of all public facilities to identify possible physical barriers to access and subsequently completed a Facilities Transition Plan defining a strategy for mitigating the identified barriers. This Transition Plan was completed in July, 1992. All projects identified in the Facilities Transition Plan must be completed by July 26, 1995. In addition to the Facilities Transition Plan, the City was required to complete by January 26, 1993, a comprehensive self- evaluation of all programs and services provided to the public, again identifying possible barriers to participation. This self- evaluation included programs and services ranging from public hearings and permit issuance to recreation programs and finger printing in the Police Department. A subsequent Transition Plan for programs and services was completed. Pursuant to the ADA, individuals and organizations representing the disabled were provided with a copy of the self-evaluation and their input was solicited. A workshop was also held for agencies who wished to participate to provide them with an opportunity to review the Programs and Services Self -Evaluation and Transition Plan. All comments received were incorporated into the document. CONCLUSION The City's ADA Task Force, comprised of representatives from each department, worked together closely to complete the programs and services self-evaluation and the Transition Plan. Staff believes that we are one of a very few cities in Orange County who have now completed a Transition Plan. Americans with Disabilities Act January 19, 1993 Page 2 Additional voluntary ADA compliance activities will include an in- house training for all employees sensitizing them to the ADA and the needs of our disabled community. The Task Force will continue to meet on a regular basis as the City proceeds in its efforts to comply with the ADA. Christine A.
