AMENDMENT TO COOPERATIVE AGREEMENT NO. 12-018 A-1, BETWEEN THE STATE AND
SUBJECT: THE CITY OF TUSTIN, TO EXTEND THE TERMINATION DATE TO JANUARY 1, 1994 FOR
TUSTIN RANCH ROAD INTERCHANGE AND I-5 FREEWAY WIDENING
RECOMMENDATION
It is recommended that the City Council, at their meeting of
"anuary 4, 1993, by Minute Motion, approve and authorize the Mayor
to execute the subject amendment.
BACKGROUND
_he City Council previously approved the Tustin Ranch Road/Santa
rna Freeway (I-5) Interchange Cooperative Agreement on November 21,
.988. The Agreement defined the terms and conditions of a
cooperative project to widen the I-5 Freeway and construct an
_nterchange at Tustin Ranch Road. The Agreement also provided the
%-ehicle for the City to bill Caltrans for all freeway widening work
that is not interchange related and for Caltrans to bill the City
for interchange work that is not freeway widening related.
=he original termination date specified in the Agreement was
-anuary 1, 1993. It has been determined that the project will not
he completed prior to the termination date.
The Amendment to Cooperative Agreement No. 12-018 A-1 extends the
termination date to January 1, 1994. The other terms and
conditions shall remain in full force and effect.

Agreement No. 12-018 A-1 between STATE and City of Tustin, to
extend the termination date.
T Please have three (3) -copies of.the enclosed Agreement
signed by the appropriate City officials and return them to us
together with three ( 3 ) certified copies of a resolution adopted by
City approving the Agreement and.authorizing its execution.
After signature by the appropriate STATE officials, you will
be furnished a fully executed copy of the Agreement for your files.

THIS AMENDMENT TO AGREEMENT, ENTERED INTO ON 11992
is between the STATE OF CALIFORNIA, acting by and through its
Department of Transportation, referred to herein as STATE, and
CITY OF TFJSTIN

herein as CITY

RECITALS
(1) The parties hereto entered into an Agreemer- (Document No
66311 on November 21, 1988, said Agreement defining the terms
and conditions of a cooperative project to widen Route 5 by
constructing a new interchange at Tustin Ranch Road, referred
to herein as PROJECT.
(2) It has bei determined that PROJECT will not be completed
prior to the termination date of said Agreer..ent.
IT IS THEREFORE MUTUALLY AGREED
1) The termination date specified in Section III, Article 26 -of
the original Agreement shall now be January 1, 1994 instead of
January 1, 1993.
(2) The other terms and conditions of said Agreement (Document No.
6631) shall remain in full force and effect.

Document No. 6631.
