CALL TO ORDER The meeting was called to.order by Mayor Edgar at 3:50 p.m. IIo ROLL CALL Councilpersons Present: Edgar, Greinke, Hoesterey, Kennedy, Saltarelli Councilpersons Absent: None Others Present: James G. PUBLIC CONCERNS None. IV. COMMENDATION 1. SlXTH CONSECUTIVE PEDESTRIAN SAFETY CITATION BY AUTOMOBILE CLUB OF SOUTHERN CALIFORNIA Don Lippert, representing the local Automobile Club of Southern California, stated this is the sixth consecutive year of honor- ing Tustin for its outstanding pedestrian safety record. Mr. Lippert reported that Tustin is one of 437 cities of generally comparable size evaluated throughout the Nation; and excelled not only because there were no pedestrian fatalities, but because the pedestrian injury rate is 23% below the average of other participating cities. He congratulated the Police and Public Works Departments for their contribution to this achieve- ment, and commended the City Council for its guidance and sup- port. On behalf of the Automobile Club of Southern California and the American Automobile Association, he presented the City of Tustin with the Pedestrian Safety Citation for 1981. Mayor Edgar accepted the plaque on the City's behalf. 84 V. PROCLAMATION 1. SENIOR CITIZENS DAY Mayor Edgar read and presented a proclamation designating October 21, 1982, as "Senior Citizens Day" to Isabelle McClements, Senior Leader/Senior Citizens, representing the Tustin Chapter #3479 of the American Association of Retired Per- sons, Inc. Tom Piercy, 17541Amaganset Way, Local AARP Chapter President, expressed thanks to the Council for the proclamation on behalf of all Tustin senior citizens. 84 RECESS - PLANNING AGENCY& REDEVELOPMENT AGENCY RECONVENED The City Council recessed at 3:55 p.m. to the Planning Agency and Redevelopment Agency meetings. At 5:06 p.m. the City Council meet- ing was reconvened with all members present. CITY COUNCIL MINUTES Page 2, 10-4-82 VI · PUBLIC HEARING 1. ANNEXATION NO. 130 (IRVINE-ELIZABETH WAY) Dr. Fleagle, Planning Consultant, presented the staff report and recommendation and indicated that to date no written protests have been filed- Mayor Edgar opened the public hearing at 5:09 p.m. There being no speakers on the matter, the public hearing was closed. It was moved by Greinke, seconded by Kennedy, to adopt Resolu- tion No. 82-81, with 0 protests filed representing 0% of the total assessed value, approving the Irvine-Elizabeth Way Annexa- tion NO. 130. Councilman Greinke commended Dr. Fleagle on his efforts in the annexation proceedings and encouraged any residents in opposi- tion to visit City Hall to learn the benefits of annexation. The motion 'carried 5-0. 24 AGENDA ORDER XII OTHER. BUSINESS 1. ANNEXATION - ELIZABETH WAY-WASS STREET Based on the fact that members of the audience were present to indicate their desire and support of annexation to the City,.~ it was moved by Edgar, seconded by Greinke, to authorize staff to initiate proceedings for the inhabited annexation of the south- westerly portion of Elizabeth Way-Wass Street adjacent to Annexation No. 130. The following person spoke in favor of subject annexation: Nora Skank, spoke on behalf of Ralph Skank, Gail BOsa, and Mr. and Mrs. Ostrander, residents of subject area. The motion carried 5-0. 24 VII · CONSENT CALENDAR It Was moved by Greinke, seconded by Kennedy, to approve the entire Consent Calendar. Carried 5-0. 1. APPROVAL OF MINUTES - September 20, 1982 2. RATIFICATION OF PAYROLL in the amount of $97,854.18. APPROVAL OF DEMANDS in the amount Of $249,338.92. 50 3. RESOLUTION NO. 82-79 - A Resolution of the City Council of the City of Tustin, California, SUPPORTING REHABILITATION AND REST0- RATION OF THE OLD COUNTY COURTHOUSE IN SANTA ANA BY THE COUNTY OF ORANGE Adopt Resolution No. 82-79 as requested by Councilman Greinke · 67 VIII · ORDI- NANCES FOR INTRODUCTION- None IX. ORDI- : NANCES FOR ADOPTION 1. ORDINANCE NO. 873 - An Ordinance of the City Council of the City of Tustin, California, REVISING PRIMA FACIE SPEED LIMITS ON CERTAIN STREETS (Main Street and Bryan Avenue) It was moved by Hoesterey, seconded by Kennedy, that Ordinance No. 873 have second reading by title only. Carried 5-0 · Following reading of the title of Ordinance No. 873 by the City Clerk, it was moved by Hoestere!r, seconded by Saltarelli, that Ordinance No. 873 be passed and adopted. CITY COUNCIL MINUTES Page 3, 10-4-82 Mayor Edgar recognized the necessity for doing something to enable radar speed limits on Main Street. The substitute motion by Edgar to modify Ordinance No. 873 to set the speed limit at 40 mph on Main Street from the west City limits to Pacific Street, and at 30 mph on Main Street from Pacific Street to Prospect Avenue died for lack of a Second. R011 call vote to pass and adopt Ordinance No. 873: ~- AYES: Edgar, Greinke, Hoesterey, Kennedy, Saltarelli NOES: None ABSENT: None 100 In relation to traffic on Main Street, it was moved by Edgar, seconded by Greinke, that a stop sign be installed at the corner of "B" and Main Streets. Councilpersons Saltarelli and Kennedy requested that the matter be agendized. A substitute motion was made by Hoesterey, seconded by Kennedy, to agendize installing a stop sign at the corner of "B" and Main Streets for the October 20 meeting. Carried 5-0. 100 The Director of Public Works indicated staff will attempt to update the warrant study to determine if anything has changed since the previous one, whereby Council will have the benefit of reviewing the most updated material. 2. ORDINANCE NO. 879 - An Ordinance of the City Council of the City of Tustin, California, AMENDING SECTION 5133 OF THE TUSTIN CITY CODE PERTAINING TO SMOKE DETECTORS It was moved by Hoesterey, seconded by Kennedy, that Ordinance No. 879 have second reading by title only. Carried 5-0. Following reading of the title of Ordinance No. 880 by the City Clerk, it was moved by Hoesterey, seconded by Kennedy, that Ordinance No. 880 be passed and adopted. In relation to the above, it was then moved by Kennedy, seconded by Hoesterey, to adopt the following resolution: RESOLUTION NO. 82-80 - A Resolution of the City Council of the City of Tustin, California, MAKING FINDINGS CONCERNING THE UNI- FORM BUILDING CODE AND ROOFING MATERIALS Carried 4-1, Greinke opposed. 51; 81 CITY ODUNCIL MINUTES Page 4, 10-4-82 X. OLD BUSINESS 1.REVENUE SHARING REQUEST - "THE VILLA" ORANGE COUNTY ALCOHOLIC WOMEN'S REHABILITATION CENTER, INC. Following consideration of the report dated September 29, 1982, prepared by the Finance Director, it was moved by Hoesterey, seconded by Kennedy, to approve the $2,500 contribution to "The Villa" from General Revenue Sharing FUnds, as originally recom- mendedlby the Chief of Police. Councilman Greinke agreed with the Finance Director's suggestion to investigate the comparative financial position of requesting groups to determine what the need factors are. The City Manager noted that for next year's Revenue Sharing budget, staff will develop criteria for Council approval of such requests. The motion carried 5-0. 29 2. PLANNING COMMISSION JURISDICTION It was moved by Hoesterey, seconded by Edgar, to receive and file the report dated September 28, 1982, prepared by the City Attorney, and schedule a public hearing on October 20, 1982, at 7:30 p.m. to consider the Planning Commission ordinance. CoUncil discussion followed regarding the appeal procedure; set- ting a fee for filing an appeal; refunding the fee if the appeal is approved; waiving the fee when the appeal is filed by someone other than the applicant; recent state legislation on setting planning and building fees; eliminating the fee altogether; making the Planning Commission an advisory body in nature versus a policy-making body; and Council liability for actions of the Planning Commission. In response to the City Manager's request for clarification, it was the Council's consensus that actions of the Planning Commission could be considered under Consent Calendar, with appealed items set for public hearing. The motion carried 5-0. 81 XI. NEW BUSINESS AUTHORIZATION TO SOLICIT BIDS, POLICE DEPARTMENT COMPUTER EQUIP- MENT AS recommended in the report dated September 24, 1982, prepared by the Chief of Police, it was moved Hoesterse, to authorize the Police Department to solicit bids for computer equipment as included in Fiscal Year 1982-82 Budget. Carried 5-0. 87 2. WATER SYSTEM FINANCIAL REVIEW AND RATE STUDY Following consideration of the report dated September 28, 1982, prepared by the Director of Public Works, it was moved by Salta- relli, seconded by Edgar, to schedule a workshop during the week of November 8, 1982, to discuss and review the Water System Financial Review and Rate Study and Phase I of the Water Plan. Motion carried 5-0. 107 3. PURCHASE OF USED VEHICLES THROUGH EXCEPTION FROM FORMAL PUR-- CHASING PROCEDURES Pursuant to the recommendation contained in the report dated September 29, 1982, prepared by the Finance Director, it was moved by Saltarelli, seconded by Hoesterey, to authorize the City Manager to purchase used vehicles and equipment, evoking Section 1624 of Ordinance No. 871, Bidding Exceptions. Carried 5-0. 94 XII.OTHER BUSINESS 1. REVENUE SHARING FUNDS - ST. JEANNE DE LESTONNAC SOCIETY Co~cilmn Saltarelli reported that St. Jeanne de Lestonnac Society operates a free medical clinic in Orange at no cost to those who are ~able to pay. ~ey sere residents of Tustin and have statistical information on s~e. Co~cil conchred to direct staff to investigate the matter to see if they qualify for revenue sharing f~ds. 29 2. FIREMAN'S FUND OPEN HOUSE In response to Co~cilman Greinke, the City Manager indicated staff will represent Co~cil at the Fireman's F~d Open Ho~e. 3. BUSINESS LICENSE OPERATIONS Mayor Edgar requested a report on statistics of business license operations, i.e., revenues, ~plication procedures, etc. The City Manager indicated staff could provide same. 31 4. BAD CHECK INVESTIGATIONS In response to Mayor Edgar, the City Manager reported that the Chief of Police will have an article printed in ~e next ChaSer of Co~erce p~lication on bad check investigation procedures. Co~cilman Greinke suggested the ~ssibility of conducting a seminar on this topic. 5. PLANNING COMMISSION WORKSHOP Mayor Pro Tem Kennedy requested clarification on the status of the Planning Co~ission. She was informed that candidate appli- cations had to be in the City Clerk's office by 5:00 p.m. October 26, with a workshop to interview candidates to ~ set following that. After a short discussion period, the Council conchred to set a ~rkshop to interview Planning Co~ission candidates on Nove~er 1, 1982, at 7:30 p.m. 81 XIII · PUBLIC HEARINGS 2. DECLARING INTENTION TO VACATE ALLEY BETWEEN EL CAMINO REAL & "C" STREET The 7:30 p.m. p~lic hearing on thisit~ was cancelled and will be scheduled for a fut~e agenda. 105 XN.
