HomeMy WebLinkAboutAGENDA 12-21-92AMENDED AGENDA CITY COUNCIL REGULAR MEETING CITY OF TUSTIN DECEMBER 21, 1992 - 7:00 P.M. The City Council meets the first and third Monday of each month at 7:00 p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an. item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited during the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE Ii. INVOCATION - The Invocation will be given by Rev. McCready Johnston, Church of the New Covenant. III. ROLL CALL IV. PROCLAMATIONS - BARBARA BENSON AND JOYCE HANSON, FORMER TUSTIN UNIFIED SCHOOL BOARD MEMBERS V. PUBLIC HEARING 1. ZONE CHANGE 92-004, 14122 RED HILL AVENUE On December 14, 1992, the Planning Commission denied Zone Change 92-004, a request to change the zoning designation on the property located at 14122 Red Hill Avenue from CG (Commercial General) to C-1 (Retail Commercial). Recommendation: Continue this item to the City Council meeting on January 4, 1993 as recommended by the Community Development Department. VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF'MINUTES - DECEMBER 7, 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of December 7, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF.PAYROLL Recommendation: Approve Demands in the amount of $1,810.,151.04 and ratify Payroll in the amount of $303,742.70. 3. REJECTION OF CLAIM NO. 92-29 - CLAIMANT, STEPHEN MURPHY; DATE OF LOSS, 4-30-92; DATE FILED WITH CITY, 11/23/92 Recommendation: Reject subject claim for personal injury and property damages of an undetermined amount as recommended by the City Attorney. 4. RESOLUTION NO. 92-152 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, 'CALIFORNIA, APPROVING AN AGREEMENT FOR COURT LIAISON CLERK WITH THE CALIFORNIA HIGHWAY PATROL, SANTA ANA OFFICE Recommendation: Adopt Resolution No. 92-152 which will authorize the City of Tustin to continue to perform the court liaison duties for the California Highway Patrol, Santa Ana office, as recommended by the Police Department. S. SELECTION OF BOND COUNSEL AND FINANCIAL ADVISOR FOR PROPOSED WATER CORPORATION BOND ISSUE Recommendation: Authorize the City Manager to accept the proposals from Bartle Wells Associates to provide financial services and from Mudge Rose Guthrie Alexander and Ferdon for Co -Bond Counsel services for the proposed 1993 Water System Financing and Refunding as recommended by the Finance Dept. 6. RESOLUTION NO. 92-155 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PRESCRIBING THE EMPLOYMENT AND COMPENSATION OF THE CITY ATTORNEY Recommendation: Adopt Resolution No. 92-155 prescribing the employment and compensation of the City Attorney as recommended by the City Attorney. VIII. ORDINANCE FOR INTRODUCTION - None IB. ORDINANCE FOR ADOPTION 1. ORDINANCE NO. 1102 - ZONE CHANGE 92-002 (LYON) Ordinance No. 1102 had first reading by title only and introduction at the December 7, 1992 City Council meeting. OF TUSTIN,,-,IFORNIA, APPROVING ZONE r NGE 92-002 TO AMEND THE EAST TUSTI2 PECIFIC PLAN LAND USE MA 20 CHANGE THE LAND USE CATEGORY IN THE VICINITY OF LOT 12 OF TRACT 12870 FROM MEDIUM DENSITY TO MEDIUM-HIGH DENSITY RESIDENTIAL WITH MINOR TEXTURAL REVISIONS OLD BUSINESS 1. DEVELOPMENT AGREEMENT 92-001 (LYON) The City Council continued Development Agreement 92-001 to allow the City Attorney to provide revised language related to paragraph 6, Liens and Encumbrances, based upon comments raised by Councilmember Saltarelli at the public hearing. Recommendation: Approve Development Agreement 92-001 by adopting the following Resolution No. 92-148, as submitted or revised, as recommended by the Community Development Department: RESOLUTION NO. 92-148 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DEVELOPMENT AGREEMENT 92-001 2. FINANCING SPORTS PARR PROJECT The City Council, at their meeting on December 7, 1992, requested a report concerning the financing of the Sports Park project. Recommendation: Pleasure of the City Council. NEW BUSINESS 1. ESTABLISHMENT OF PERMANENT TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM DEVELOPMENT FEES On November 6, 1989, the Cities of Tustin and Santa Ana entered into a Joint Powers Agreement which created the Santa Ana -Tustin Transportation System Improvement Authority. Recommendation: Adopt the following Resolution No. 92* -153 which establishes permanent Transportation System Improvement Program (TSIP) Development Fees in TSIP Areas "A" and "B": RESOLUTION NO. 92-153 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM DEVELOPMENT FEES 2. REQUEST TO REMOVE PARKING RESTRICTIONS ON MYFORD ROAD AND HERITAGE WAY (ARCADA CONDOMINIUM DEVELOPMENT -EAST TUSTIN TRACT NO. 13096) The City has received a letter dated November 12, 1992, from the Arcada Community Association, and two letters and a petition dated November 23, 1992 and November 30, 1992 from Mr. James C. Barnes, a resident of the Arcada Development, regarding subject parking restrictions. Recommendation: Pleasure of the City Council. 3. PROPOSAL TO LOCATE A CORRECTIONAL FACILITY AT MCAS-TUSTIN On October 30, 1992, the Department of the Navy began its CITY COUNCIL AGENDA PAGE 3 DECEMBER 21, 1992 disposition ocess by advertising the a 'lability of MCAS -Tustin property to terested federal agencies Through that process, a proposal has been received from the U.S. Justice Department, Federal Bureau of Prisons, to obtain a below market -value interest in a portion of the Base property for the specific purpose of locating a federal correctional facility within MCAS -Tustin. Recommendation: Support the Base Closure Task Force action of December 13, 1992, by formally adopting the following Resolution No. 92-154: RESOLUTION NO. 92-154 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, STATING THE COUNCIL'S VEHEMENT OPPOSITION TO ANY PROPOSAL TO LOCATE A CORRECTIONAL FACILITY AT THE MARINE CORPS AIR STATION-TUSTIN XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - DECEMBER 14, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of December 14, 1992. 2. BUSINESS LICENSE AMNESTY PROGRAM - 1992 During the Business License Amnesty period, July 1 through September 30, 1992, 102 delinquent new business licenses and 65 delinquent renewal business licenses were processed. Recommendation: Receive and file subject report as recommended by the Community Development Department. 3. PRESENTATION OF CITY'S COMPREHENSIVE ANNUAL FINANCIAL REPORT FOR YEAR ENDING JUNE 30, 1992; REDEVELOPMENT AGENCY INCLUDED The Audit Committee is submitting to the City Council the Comprehensive Annual Financial Report for year ending June 30, 1992. Recommendation: Receive and file subject report as recommended by the Audit Committee. 4. FUTURE EDINGER AVENUE GRADE SEPARATIONS AT TUSTIN RANCH ROAD, AT RED HILL AVENUE AND NEWPORT AVENUE EXTENSION TO EDINGER AVENUE The City Council, at their meeting of December 7, 1992, requested staff prepare a status update and suggested actions on three key roadway improvements: (1) Extension of Tustin Ranch Road southerly from Walnut Avenue to Edinger Avenue inclusive of a grade separation over the AT&SF railroad tracks, flood control channel and Edinger Avenue with access ramps to and from Edinger Avenue; additionally, the further extension of Tustin Ranch Road to Barranca Parkway at the Von Karmon Avenue intersection, (2) A grade separation of Red Hill Avenue at both Edinger Avenue and the AT&SF railroad/flood control channel, and (3) The extension of Newport Avenue southerly from its current terminus to Edinger Avenue as an underpass below the AT&SF railroad and flood control CITY COUNCIL AGENDA PAGE 4 DECEMBER 21, 1992 channel. Recommendation: Approve the following as recommended by the Public Works Department/Engineering Division: a. Reactivate the Tustin Ranch Road extension project (Walnut Avenue to Edinger Avenue) to pursue a roadway design including conceptual/preliminary design of the grade separation structure and access ramps at Edinger Avenue based upon and coordinated with the Marine Corps Air Station Base Reuse Plan. b. At the completion of the Moulton Parkway (Edinger Avenue) Super Street EIR, evaluate the Red Hill Avenue conceptual overpass alternatives as presented and proceed with a formal project as desired. c. Negotiate with Catellus Development to accelerate the plan preparation for both Phase I and Phase II of the Newport Avenue extension. S. COSTCO BUILDING IDENTIFICATION SIGN On November 2, 1992, Ms. Jane Anderson of the Sevilla Homeowner Association, requested that the City Council look into the Costco sign which remains on all night and radiates light into the nearby residences. Recommendation: Receive and file subject report as recommended by the Community Development Department. 6. TUSTIN/NORTH IRVINE COMMUTER RAIL STATION The City Council, at their meeting on December 7, 1992, requested a status update on the Commuter Rail Station. CLOSED SESSION The City Council will recess to Closed Session to meet with its designated representatives regarding labor relations matters pursuant to Government -Code Section 54967.6. XVI. ADJOURNMENT The City Council has scheduled a special meeting to be held Tuesday, ~� December 22, 1992, at 5:30 p.m.; has scheduled a Redevelopment Agency Workshop on January 4, 1993, at 5:30 p.m.; and the next regular meeting of the City Council is scheduled for Monday, January 4, 1993, at 7:00 p.m. All meetings will be held at the Tustin Area Senior Center.
