HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: INITIATION OF ANNEXATION NO. 154, 18582 17th STREET RECOMMENDATION It is recommended that the City Council initiate Annexation 154 by adoption of Resolution 92-149 and confirm the Master Property Tax Transfer Agreement by adoption of Resolution 92-150, as submitted or revised. BACKGROUND In conjunction with the Orange County Water District, (OCWD) the City of Tustin Water Division has been working on improving the quality of water provided to the customers. The City of Tustin owns two water wells located at 18602 17th Street(See Exhibit A) and has been planning to construct a water desalinization facility at this location. This site is located within Tustin City boundaries. In order to improve access to the facility and to provide some mitigation measures, OCWD purchased the adjacent parcel (18582 17th Street) and incorporated it into the project design. The adjacent parcel is within County unincorporated area. Earlier this year OCWD purchased the property and transferred title to the City. In order to streamline the design and permit processing and to eliminate the need to deal with two jurisdictions (the County of Orange and the City of Tusth tin) it is recommended that the property located at 18582 be annexed to the City of Tustin. DISCUSSION During the preliminary design process, the City of Tustin Water Division and OCWD have had informal discussions with the Foothill Communities Association and some of the neighboring property owners regarding the mitigation of traffic, visual, noise and safety-related impacts. At the same time, the adjacent vacant site was offered to the OCWD to be included into the project design. Staff determined that the additional .14 acre site (18582 17th Street) could be a benefit -to the site design, improve access to the facility, provide for additional storage area and help mitigate the noise and visual impacts of the project. Once the conceptual project design is completed, the desalter City Council Report Initiation of 17th 154 December 7, 1992 Page 2 Street/Water Desalter Facility Annexation No. facility will be subject to design review by the Community Development Department. At that time, the issues of visual impact and access to the site will be addressed. As part of the application for annexation, the City Council is required to adopt a resolution confirming the application of the Master Property Tax Transfer agreement that provides for the division of property taxes between the County of Orange and City of Tustin. CONCLUSION Based upon the above discussion, staff recommends the City Council initiate Annexation No. 154 and confirm the Master Property Tax Transfer Agreement. Whereas, a Master Property Tax Transfer Agreement between the County of Orange and the City of Tustin to provide for property tax exchange in areas annexed by the City has been executed by the Board of Supervisors of Orange County and the City Council of the City of Tustin. Effective November 18, 1980, the agreement provides for division of property taxes pursuant to Section 99(d) of the Revenue and Taxation Code of the State of California, and Whereas the City Council of the City of Tustin has proposed the annexation of the uninhabited and undeveloped parcel known. as Annexation No. 154 (18582 17th Street). Now, therefore, be it resolved by the City Council of the City of Tustin that the Master Property Tax Transfer Agreement between the County of Orange and the City _of Tustin to provide for property tax exchange in areas annexed by the City providing for the allocation of property tax revenues, as approved by the Board of Supervisors and the City Council and effective November 18, 1980, shall be applicable to the territory within the proposed Annexation No. 154 (18582 17th Szreet). RESOLUTION NO. 92-149 A RESOLUTION OF THE CITY COUNCIL OF TUSTIN, CALIFORNIA, INITIATING APPLICATION FOR THE UNINHABITED ANNEXATION OF TE RI ORY KNOWN AS ANNEXATION NO. 154 ( STREET) Whereas, the City Council of the City ofsin on its own motion has initiated preliminary proceeding for the annexation of certain uninhabited territory; and Whereas the City of Tustin Water Division has a water well located at 18602 17th Street, adjacent to subject property, and intends to expand the existing water facility in conjunction with the Orange County Water District to construct a water de lserve tthe ion facility on both parcels in order to better customers; and Whereas, in order to simplify and streamline the design and permitting process, it would be of Streetsignificant benefit for both 18602 and17th 7and be located within the same jurisdiction; Whereas, the City Council .has individual arcel determ that the of land proposed annexation is an construction p and therefore proposed for minor new qualifies as a Categorical Exemption (Class 19 ) from the requirements of the California Environmental Quality Act.
