HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF IMPROVEMENTS AND AUTHORIZING RECORDATION SUBJECT: OF NOTICE OF COMPLETION FOR SIDEWALK, CURB AND GUTTER AND INTERLOCKING PAVER REPAIR PROJECT, 1991-92 (PROJECT NO. A A *a RECOMMENDATIONS: It is recommended that the City Council, at their regular meeting of November 16, 1992, adopt the attached resolution accepting the work of improvements and repairs and authorizing the recordation of the Notice of Completion for the subject project. Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention amount of $10,938.99. This amount, combined with the previous payments totaling $98,450.94, represents 100% of the final contract amount of $109,389.93. BACKGROUND: This project consisted of the removal and replacement of sidewalk, curb and gutter and/or interlocking concrete pavers at various locations throughout the City. The working budget for this annual project was $119,807.00. The actual project costs were as follows: Original Contract Cost ................... $ 86,426.50 Contract Change Order No. 1 .............. 4,618.50 Contract Change Order No. 2 .............. 2,896.80 Contract Change Order No. 3 .............. (120.00) Additional Locations ..................... 15,568.13 $109,389.93 DISCUSSION: These improvements and repairs have now been completed by the contractor, Advanced Construction, to the satisfaction of the City's Public Works Department. To clarify contract costs, the change orders are described as follows: Contract Change Order No. 1 - A guarantee of bid item prices for quantities over and above 25% of the bid quantities for items of PCC sidewalk Type "A-2" curb and gutter, commercial curb and gutter and asphalt concrete paving. Final Acceptance November 16, 1992 Page 2 Contract Change Order No. 2 - A price increase for bid items whose quantities exceed 25% of the bid quantity namely, PCC Type nDn curb and gutter and residential drive apron. Contract Change Order No. 3 - Delete a concrete beam in the area of the interlocking concrete pavers. The additional locations are routinely added when bids are received at an amount below the original Engineer's estimate. This allows the City to take advantage of the lower unit costs and lower the backlog of hazardous areas requiring repair. This practice has been previously implemented over the past several years. The final contract amount for this project is $109,389.93. This represents an increase of 21% over the original contract amount. This increase was due to the change orders and additional locations as previously discussed. Hallman Junior Civil Engineer 1 2 3 4 5 6 7, 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 92-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR SIDEWALK, CURB AND GUTTER AND INTERLOCKING PAVER REPAIR PROJECT, 1991-92 FY (PROJECT NO. 000221) WHEREAS, Advanced Construction, having a contract with the City of Tustin to construdt the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement. hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by .the City Council of the City of Tustin that said work and improvement be, and the same is hereby accepted. Said work and improvement is more particularly described as follows: Removal and replacement of portland cement concrete sidewalk, curb and gutter, drive aprons and interlocking concrete pavers at various locations throughout the City. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby, authorized to execute and file a Notice of Completion and acceptance of said public work and improvement described herein as required by law.
