HomeMy WebLinkAboutAGENDA 11-02-92AGENDA CITY COUNCIL REGULAR MEETING CITY OF TUSTIN NOVEMBER 2, 1992 - 7:00 P.M. The City Council meets the first and third Monday of each month at 7:00 p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited during the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. CODE AMENDMENT 92-007,•MODIFY REQUIREMENTS FOR OFF-SITE ALCOHOLIC BEVERAGE SALES ESTABLISHMENTS The proposed amendment would allow as an outright permitted use in several commercial zones, the sale of alcoholic beverages provided the alcoholic beverage sales area was limited to 10 percent of the gross floor area of a building over 15,000 square feet. Recommendation by the Community Development Department: a. Have st reading by title onlj nd introduction of the following Ordinance No. 1101: ORDINANCE NO. 1101 - AN ORDINANCE OF THE CITY COUNCIL OF THE N THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS COMMERCIAL AND INDUSTRIAL DISTRICTS OF ORTICLE 9 OF THE TUSTIN OFF-SITE ALCOHOLIC CITY CODE TO MODIFY REQUIREMENT BEVERAGE SALES ESTABLISHMENTS 2. 1993-94 PROPOSED USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (19TH YEAR APPLICATION) Community Development Block Grantmonies are available to local jurisdictions to assist in the elimination of urban blight. Recommendation: Adopt the following Resolution No. 92-134 approving the 1993-94 application for the proposed use of Community Development Block Grant funds as recommended by the Community Development Department: RESOLUTION NO. 92-134 - A RESOLUTION OF THE TCITY HE CIOUNCILOF 1993T94 HE CITY OF TUSTIN, CALIFORNIA, APPROVING APPLICATION FOR HOUSING AND COMMUNITY HP PMENT FUNDS AND AUTHORIZING SUBMISSION OF SUCH APPLICATON TO THE COUNTY OF ORANGE 3. APPEAL OF CONDITION OF APPROVAL FOR CONDITIONAL USE PERMIT 92-031 AND DENIAL OF SIGN CODE EXCEPTION 92-006 - TUSTIN HEIGHTS The Planning Commission had approved Conditional Use Permit 92-031 which authorized a new master sign plan for Tustin Heights Shopping Center located at 1076-1222 Irvine Boulevard and required the applicant to bring the existing non -conforming pole sign into conformance with current provisions of the Sign Code. As part of the above action, the Planning Commission denied a sign code exception to permit modifications to the existing non -conforming pole sign. On October 21 1992, staff received an appeal of the Planning Commission's action from the property owner. Recommendation: Temporarily table this item toallow alternative sign designs to be considered by the Planning Commission as requested by the applicant. VI. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,561,767.94 and ratify Payroll in the amount of $320,584.91. 3. RESOLUTION NO. 92-121 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR CONSTRUCTION OF LAUREL GLEN PARK Recommendation: Accept the public improvements installed by Valley Crest Landscape, Inc., at Laurel Glen Park by adopting Resolution No. 92-121 and authorizing the City Clerk to record the Notice of Completion as recommended by the Community Services Department. 4. REJECTION OF CLAIM NO. 92-43 - CLAIMANT, MICHAEL MOTT; DATE OF LOSS, 8/8/92; DATE FILED WITH CITY, 9/15/92 Recommendation: Reject subject claim for property damage in the amount of $85.00 as recommended by the City Attorney. 5. REJECTION OF CLAIM NO. 92-45 - CLAIMANTS, LINDA GALVEZ AND BRIAN CARLSON; DATE OF LOSS, APPROXIMATELY 3/18/92; DATE FILED WITH CITY, 9/18/92 Recommendation: Reject subject claim for property damage of an undetermined amount as recommended by the City Attorney. 6. REJECTION OF CLAIM NO. 92-44 - CLAIMANT, DEBORAH ROBINSON; DATE OF LOSS, 4/25/92; DATE FILED WITH CITY, 9/14/92 Recommendation: Reject subject claim for personal injury damages in the amount of $25,660.00 as recommended by the City Attorney. 7. AWARD OF CONTRACT FOR SUPERVISORY CONTROL AND DATA ACQUISITION (SCADA) SYSTEM FOR THE WATER SERVICE STORAGE AND DISTRIBUTION NETWORK Recommendation: Authorize the award of bid for Water Services Supervisory Control and Data Acquisition (SCADA) System in the amount of $299,950.00 to the low bidder, Phoenix Controls, Inc., Phoenix, Arizona; and authorize a supplemental 1992-93 budget appropriation in the amount of $160,300.00 from the unappropriated reserves of the Water Service Capital Projects Fund as recommended by the Public Works Department/Water Services Division. RESOLUTION NO. 92-132 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, 1991-92 FY, PHASE I Recommendation: Adopt Resolution No. 92-132 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. 9. AWARD OF CONTRACT FOR STREET REHABILITATION ON RED BILL AVENUE BETWEEN WARNER AVENUE AND VALENCIA AVENUE Recommendation: Award the contract to Boral Resources, Inc., Pomona in the amount of $293,866.20 for subject project as recommended by the Public Works Department/ Engineering Division. FUND TRANSFER FROM VEHICLE LEASE FUND TO VEHICLE MAINTENANCE ACCOUNT Recommendation: Authorize a fund transfer in the amount of $13,800.00 from the Vehicle/Equipment Fund to the Vehicle Repair Fund as recommended by the Public Works Department/Field Services Division. 12. CALTRANS CONTRACT NO. 12G029A/1 WITH THE CITY OF TUSTIN FOR A SIX MONTH EXTENSION OF CONTRACT NO. 12GO29 FOR REIMBURSEMENT OF EXPENSES FOR TRAFFIC SIGNAL MODIFICATIONS AND ADJUSTMENTS Recommendation: Approve subject contract and authorize the Mayor to execute as recommended by the Public Works Department/ Engineering Division. 13. TRAVEL POLICY Recommendation: Adopt the policy regarding travel and expense reimbursements for City employees and officials as recommended by the City Manager. 14. AWARD OF CONTRACT FOR EDINGER AVENUE REHABILITATION BETWEEN JAMBOREE ROAD AND 2410± FEET WESTERLY PROJECT, 1992-93 FY Recommendation: Award contract for subject project to All American Asphalt, Corona, in the amount of $174,191.82 as recommended by the Public Works Department/ Engineering Division. 15. RESOLUTION NO. 92-133 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR TRAFFIC SIGNAL INSTALLATION AND MEDIAN MODIFICATION ON TUSTIN RANCH ROAD AT AUTO CENTER DRIVE Recommendation: Adopt Resolution No. 92-133 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. VIII. ORDINANCES FOR INTRODUCTION - None IX. ORDINANCE FOR ADOPTION 1. ORDINANCE NO. 1100 - CODE AMENDMENT 92-0061, SELF -STORAGE MINI WAREHOUSES Ordinance No. 1100 had first, reading by title only and introduction at the October 19, 1992 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1100 (roll call vote): ORDINANCE NO. 1100 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 9 OF THE TUSTIN CITY CODE TO ALLOW SELF -STORAGE MINI WAREHOUSES AS A CONDITIONALLY PERMITTED USE IN THE INDUSTRIAL (M) DISTRICT (CA 92- 006) CITY COUNCIL AGENDA PAGE 4 NOVEMBER 2, 1992 X. OLD BUSINESS 1. AIRPORT STATUS REPORT The Community Development Department has continued to monitor airport issues and attend all relevant meetings. Recommendation: Receive and file subject report as recommended by the Community Development Department. 2. APPOINTMENT TO THE CULTURAL RESOURCES COMMITTEE Staff has received a total of eleven applications from interested residents who wish to be considered for two vacancies on the Cultural Resources Committee. Recommendation: Pleasure of the City Council. XI. NEW BUSINESS 1. CLASS FEE/CONTRACT REVISION PROPOSAL As a matter of practice the Community Services staff reviews class fees and instructors' contracts to assure that fees recover program costs. Recommendation: To negotiate contracts with new contract instructors at a 65/35 percent split of the class fee beginning Summer 1993; existing contract instructors would continue at 70/30 percent fee split then negotiate new contracts at 65/35 percent beginning Winter 1994 as recommended by the Parks and Recreation Commission and Community Services Department. 2. BUILDING RENTAL FEE REVISIONS The City Manager has requested that all fees for City services be reviewed. Following this request, staff has conducted an intensive study of fees charged for renting City buildings and recreation facilities. Recommendation: Adopt the following Resolution No. 92-129 modifying certain Community Services Department fees and charges effective January 1, 1993 as recommended by the Parks and Recreation Commission and Community Services Department: RESOLUTION NO. 92-129 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING CERTAIN FEES AND SERVICE CHARGES FOR THE COMMUNITY SERVICES DEPARTMENT 3. ADULT SOFTBALL - REGISTRATION FEE INCREASE The current softball registration fee is $350.00 for a ten -game season ($35.00 per game). At the September 17, 1992 Parks and Recreation Commission meeting, the Commission supported the staff recommendation to raise adult softball registration by $50.00. Recommendation: Increase adult softball registration fees by $50.00 per team, to $400.00 for the Winter 1993 season, as recommended by the Parks and Recreation Commission and Community Services Department. CITIZEN REQUEST FOR MODIFICATIONS TO ON -STREET PARKING RESTRICTIONS ALONG SIXTH STREET BETWEEN EL CAMINO REAL AND "CII STREET Mr. Don LeJeune, a resident of Tustin, has requested the Public Works Department consider implementing changes to existing parking restrictions in the E1 Camino Real/Sixth Street area. Recommendation by the Public Works Department/Engineering Division: a. Deny the request to remove the two-hour parking restriction signs along Sixth Street between E1 Camino Real and "C" Street. b. Maintain the existing red curb markings in the area of the E1 Camimo Real and Sixth Street intersection. 5. COMMUNITY NON-PROFIT FOUNDATION On August 17, 1992, Councilmember Thomas suggested that the City consider creating a general purpose non-profit foundation to which individuals and businesses could make financial contributions. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - OCTOBER 26, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of October 26, 1992. 2. INVESTMENT SCHEDULE AS OF AUGUST 31, 1992 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. 3. SPORTS PARR MASTER PLAN UPDATE On September 10, 1992, the Parks and Recreation Commission convened a Task Force workshop for the Sports Park Master Plan. Seventy-five people attended the meeting including various representatives from youth/adult sports organizations, neighborhood associations and interested individuals.
