FINAL ACCEPTANCE OF IMPROVEMENT AND AUTHORIZING RECORDATION OF "NOTICE OF
SUBJECT: COMPLETION" FOR P.C.C. CROSS GUTTERS AND CURB RETURNS AT PACIFIC STREET
AND SECOND STREET AND PACIFIC STREET AND THIRD STREET (PROJECT NO. 700105)
RECOMMENDATION
It is recommended that the City Council, at their regular meeting
of October 19, 1992, adopt the attached resolution accepting the
work of improvement and repair and authorizing the recordation of
the Notice of Completion for the subject project.
Assuming no claims or stop notices are filed, it is further
recommended that 35 days after the date of recordation of the
Notice of Completion, the City Council authorize payment of the
final 10% retention amount of $2,028.91. This amount together with
the previous payment of $18,260.19, represents 100% of the final
contract amount of $20,289.10.
BACKGROUND
This project consisted of the construction of a new PCC cross
gutter, curb returns and curb ramps at Pacific Street and Second
Street and Pacific Street and Third Street.
This was a Capital Improvement Project with a working budget of
$22,200.00. Actual project costs were as follows:

To clarify the contract costs, the change order is defined as
follows:
Contract Change Order No. 1 - Due to unexpected circumstances
in the field, it was necessary to have the contractor install
sprinkler pipe in one area of the reconstruction and install
the conduit for the necessary street light relocation.
The final contract amount for this project is $20,289.10. This
represents a 4.6% increase over the original contract amount. This
increase was due to the change order previously discussed.
It is requested that the Tustin City Council pass and adopt the
attached resolution accepting the works of improvement and repair
and authorizing the recordation of the Notice of Completion for
P.C.C. Cross Gutter and Curb Returns at Pacific Street and Second
Street and Pacific Street and Third Street.

RESOLUTION NO. 92-127
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR
AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
P.C.C. CROSS GUTTER AND CURB RETURNS AT PACIFIC STREET
AND SECOND STREET AND PACIFIC STREET AND THIRD STREET
(PROJECT NO. 700105)
WHEREAS, Hardy & Harper, Inc., having a contract with the
City of Tustin to construct the hereinafter described public work
and improvement; and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvements
hereinafter mentioned in manner satisfactory to the City Council
of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
described in accordance with the provisions of the contract
documents and the notice of completion and acceptance of said
public work and improvement should be filled and payment of the
balance due said contract authorized in accordance with the
contract documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin that said work and improvement be, and the same is
hereby accepted. Said work and improvement is more particularly
described as follows:
The construction of a new portland cement concrete cross
gutter, 25' radius curb returns and two curb ramps at Pacific
Street and Second Street and Pacific Street and Third Street
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Engineer
of the City of Tustin be, and is hereby authorized to execute and
file a notice of completion and acceptance of said public work and
improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin held on the 19th day of October, 1992.
