JITY COUNCIL REGULAR MEETI,
CITY OF TUSTIN
,._ OCTOBER 5, 1992 - 7:00 P.M.
The City Council meets the first and third Monday of. each month at 7:00 p.m.
at the Tustin Area Senior Center, 200 South "C" Street, Tustin.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City of Tustin agenda books located in the Police Department and
the Tustin Public Library. These same books are also provided for public
use at the Senior Center during the Council meeting. Listening devices for
the hearing impaired are available upon request from the City Clerk.
Smoking is prohibited during the Council meeting.
Distribution of Material to City Council: If you have material you wish to
distribute to the City Council regarding an item on the agenda, please give
the material to the City Clerk prior to the meeting. This will allow the
City Council sufficient time to review the material prior to taking action.

1. RECOVERY OF CITY COSTS FOR THE ABATEMENT OF A PUBLIC NUISANCE AT
200 EL CAMINO REAL
Tustin City Code Sections 4417 and 4418 permit the City to
initiate removal of weed and debris nuisances with an assessment
against the property to recover costs.
Recommendation: Adopt the following Resolution No. 91-114
confirming the schedule of costs associated with the abatement of
weeds and overgrown vegetation and directing that the same
constitute an assessment against the subject property as
recommended by the Community Development Department:

2. VESTING TEN IVE TRACT MAP NO. 14669
Vesting Tentative Tract Map No. 14669 is proposed by California
Pacific Homes and would subdivide an approximate 11.193 -acre site
_. for the development of 69 single family residential units. The
site is bordered by Rawlings Way on the east, Lot 28 of Tract
12870 on the west, Tustin Ranch Road on the south, and Township
Drive on the north.
Recommendation by the Community Development Department:
a. Approve the Environmental Determination for the project by
adopting the following Resolution No. 92-115:
RESOLUTION NO. 92-115 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL
ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC
PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED
SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM
EIR FOR VESTING TENTATIVE TRACT MAP NO. 14669 AND ALL FEASIBLE
MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
b. Approve Vesting Tentative Tract Map No. 14669 by adopting the
following Resolution No. 91-116:
RESOLUTION NO. 92-116 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE
TRACT MAP 14669 TO CREATE 69.NUMBEREDLOTS AND 20 LETTERED
LOTS FOR A DETACHED SINGLE FAMILY RESIDENTIAL PROJECT LOCATED
ON LOT 8 OF TRACT 12870
3. VESTING TENTATIVE TRACT MAP NO. 14585
Vesting Tentative Tract Map No. 14585 is proposed by RecreActions
Group of Companies and would subdivide an approximate 18.02 -acre
site for the development of 214 condominium dwelling units. The
site is bounded by Tustin Ranch Golf Course on the north and west;
Lot 15 of Tract 12870, a potential elementary school site and Lot
17 of Tract 12870, the future community park across Robinson Drive
on the south; and Venturanza Del Verde condominiums (Tract 13835)
to the east. `
Recommendation by the Community Development Department:
a. Approve the Environmental Determination for the project by
adopting the following Resolution No. 92-117:

direction regarding locking devices on pedestrian gates within
the East -Tustin Specific Plan project area.

VII. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - SEPTEMBER 21, 1992 REGULAR MEETING
Recommendation: Approve the City Council Minutes of September
21, 1992.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,043,435.13
and ratify Payroll in the amount of $303,381.53.
3. REJECTION OF CLAIM NO. 92-37 - CLAIMANT, CLAUDIO CARVALHO; DATE OF
LOSS, 2/11/92; DATE FILED WITH CITY, 8/6/92
Recommendation: Reject subject claim for property damage in the
amount of $542.50 as recommended by the City Attorney.
4. REJECTION OF CLAIM NO. 92-39 - CLAIMANT, EUGENE AND LINDA LEVIN;
DATE OF LOSS, UNSPECIFIED; DATE FILED WITH CITY, 9/1/92
Recommendation: Reject subject claim for property and general
damages of an undetermined amount as recommended by the City
Attorney.
S. REJECTION OF CLAIM NO. 92-38 - CLAIMANT, WHITNEY SECOR; DATE OF

Recommendation: Reject subject claim for personal injury
damages in the amount of $655.21 as recommended by the City
Attorney.
6. SEVENTEENTH STREET DESALTER PARTICIPATION IN METROPOLITAN WATER
DISTRICT GROUNDWATER RECOVERY PROGRAM
Recommendation: Authorize the Mayor to execute Tustin Desalter
Project Joint Participation Agreement for Recovery and
Utilization of Contaminated Groundwater between the Metropolitan

Water Dis_'ct of Southern Californ- the Municipal Water
District L irange County, the Orange C .ty Water District, the
East Orange County Water District, and the City of Tustin as
recommended by the Public Works Department/Water Division.
7. RESOLUTION NO. 92-120 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AUTHORIZING FUTURE EXPENDITURES WITH
RESPECT TO THE CITY'S WATER FACILITY IMPROVEMENT PROGRAM TO BE
REIMBURSED FROM FUTURE LONG-TERM FINANCINGS
Recommendation: Adopt Resolution No. 92-120 confirming the City
Council's intent to recover certain water service expenses from
future bond sales as recommended by the Finance Department.

IX. ORDINANCE FOR ADOPTION
1. ORDINANCE NO. 1098 - SECOND RESPONSE TO DISTURBANCE
Ordinance No. 1098 had first reading by title only and
introduction at the September 21, 1992 City Council meeting.
Recommendation: Have second reading by title only and adoption of
the following Ordinance No. 1098 (roll call vote):

1. STATE WORKERS' COMPENSATION REFORM
At the City Council meeting of September 21, 1992, Mayor Pro Tem
Potts requested agendizing a resolution in support of the
Governor's position on workers' compensation reform.
Recommendation: Pleasure of the City Council.
2. CITY RECORDS - RETENTION AND DESTRUCTION
At a recent City Council meeting, Councilmember Saltarelli
requested the City's policy regarding retention and destruction of
records be agendized for Council review..
Recommendation: Pleasure of the City Council.
XII. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 28, 1992
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
September 28, 1992.
