SUBJECT: CHARGES FOR THE DEPARTMENTS OF LEGISLATION, ADMINISTRATION,
COMMUNITY DEVELOPMENT, PUBLIC WORKS, POLICE AND COMMUNITY
RECOMMENDATION:
That the City Council, at its meeting of September 21, 1992, adopt
Resolution 92-103 modifying certain fees and service charges for
the departments of Legislation, Administration, Community
Development, Public Works, Police, and Community Services.
BACKGROUND:
In response to Council's direction, staff has prepared revised fee
schedules and implemented service charges as needed to recover
expenses. Resolution 92-103 is formatted using specific exhibits
for each department with the corresponding staff background data.
DISCUSSION:
The adoption of Resolution No. 92-103 will establish a mechanism to
establish fees and to annually automatically adjust schedules to
reflect the Consumer Price Index.

BACKGROUND:
Following is a clarification of duplication fees outlined in Exhibit A of
Resolution No. 92-103:
Duplication of Municipal Code/Revisions, $0.25 per page
The cost of supplying the Municipal Code in its entirety with a binder, tab
dividers, etc. has become prohibitive (approximately $350.00) and requests
are rare. Duplicating sections or revisions as requested at $0.25/page will
accommodate the needs of the public.
Duplication of Agendas/Minutes and Tape Recordings:
Current fees are $7.50/year and $10.00/year for mailing agendas and minutes
respectively. Doubling the costs to $15.00 and $20.00 will help to recover
costs for envelopes, reproduction, postage, etc. and at the same time keep
the cost affordable to all residents and businesses.
A $15.00 tape duplication charge was established with the adoption of City
Council Resolution No. 88-84.
Miscellaneous Duplication Fees:
Charging an increased rate for the first five (5) copies will recover
staff's initial cost for research and clerical time.
Documents Filed Pursuant to Political Reform Act, $0.10 per page:
Pursuant to Government Code Section 81008, all statements and reports filed
in compliance with the Political Reform Act must be provided at a charge not
to exceed $0.10 per page.

SUBJECT: NATER SERVICE BILLING FEES
BACKGROUND:
Since the adoption of Resolution 86-1 in 1986, Certain fees and
service charges for water functions have not been revised and
therefore need to be adjusted to more accurately reflect the
current cost of these services. The major changes to the service
fee schedule and explanations are as follows:
Delinquent Notice - $5.00 after 30 days from billing. Current
late fee of $2.00 has not been effective in providing customer
incentive to pay within 30 days. We continually process 200
second notices per billing cycle at a cost of $10.00 per
notice sent out.
Delinquent Account Water Reconnection Fee - Same day service
calls after 4:00 p.m. require a higher fee to recover the cost
of overtime pay for personnel working beyond their regular
shift.
Deposits for Water Service - All customers will be required
to pay a $40.00 refundable deposit. Current policy allows for
no deposit to homeowners and business owners. Business
failures and homeowners "skipping" on final bills have caused
higher debt write offs. Deposits will be refunded after two
years of good payment history. Current policy is to refund
after one year if all payments have been made in a timely
manner. As rates increase, we expect the skip rate for both
renters and owners to increase.
Door Hanger Charge - Presently, after 45 days we door hang a
notice of an unpaid water bill giving a 48 hour notice of
impending water disconnection. We provide this as a courtesy
at.no charge, but due to the volume of notices being generated
from customers who wait until this final notice we are
recommending this new fee. We currently door hang an average
of 50 customers a week. The implementation of a service charge
of $3.00 should generate fewer door hangers and allow us to
better utilize water personnel.

Water Theft - It is a fairly common practice for contractors
to hook up to our hydrants without metering or to have
customers hook up a direct meter by-pass. We currently have no
method to combat this situation. A minimum charge is one
method of discouraging water theft.
The service charges proposed by Resolution 92-103 will recover
costs associated with providing these additional services. The
attached survey has been conducted to verify that these charges are
appropriate.

SUBJECT: INCREASES IN COMMUNITY DEVELOPMENT FEES AND SERVICE CHARGES
BACKGROUND
In response to Council direction, the Community Development
Department has prepared revised fee schedules for certain planning
and building services. California Government Code allows public
agencies to charge applicants a reasonable fee not to exceed the
amount reasonably necessary to provide the service required for
processing of development applications.
In 1987, the City Council adopted Resolution No. 87-27 establishing
planning fees based upon a comprehensive survey of City costs and
comparison of fees charged by other cities in Orange and Los
. Angeles counties. The City Council also adopted Resolution No. 87-
138 raising Building Division fees. Although planning fees have
not been modified since 1987, provisions were made in Resolution
No. 87-138 that Building Division fees would be adjusted each
January consistent with the Consumer Price Index.
A variety of fee adjustments are proposed for certain Planning and
Building related services that presently do not cover the cost to
provide the service. These increases are viewed as an interim
measure until a more comprehensive cost analysis and city survey
can be completed which may justify additional modifications.
DISCUSSION
Planning Fees
Planning fees are proposed to be increased consistent with Consumer
Price Index (CPI) increases since 1987 which represents a
reasonable increase in city costs to provide services. Applying
the Consumer Price Index each January since 1987 to the planning
fees results in an overall 25% increase from the 1987 fees. On
average, a $100 application fee would increase to $125. Details of
these increases and calculations are provided in Attachment B.
Staff has also been able to determine that a number of additional
fees can be added where actual staff costs could be fully
documented at this time.

Building Fees
The following revisions are proposed to the Building Division Fee
Schedule:
1. Increase the building permit issuance fee from the current
$16.40 fee to $25.00 on mechanical, electrical, plumbing and
sign permits and impose a new $25.00 issuance fee on all
building, grading and infrastructure permits.
2. Increase penalty fees for work begun without permits from the
current double assessment fee to the permit fee plus two times
the permit fee (same as San Clemente) with a minimum of $300
and maximum of $3,000 as a disincentive for beginning
construction work without obtaining permits.
3. Establish line item fees for items such as re -roofs, tenant
improvements, and walls as the current building valuation
calculation method to determine these fees does not recover
the costs of providing the service.

BACKGROUND:
The Public Works Department/Engineering Division reviewed existing
fees and service charges to determine any modifications necessary
to accurately reflect increases in costs to the City.
Based upon this review, minor adjustments were made specifically
for increased costs in reproduction (blueline and regular
duplication). The modified fees, as reflected in Exhibit D,
accurately reflect the costs for reproduction of the various maps
and documents currently available from the Public Works
Department/Engineering Division.

RECOMMENDATION
That City Council authorize modification and addition of certain
fees and service charges as indicated in Exhibit E, Resolution 92-
103.
BACKGROUND
Modifications:
A survey of local agencies regarding fees for Police Reports
indicated our fees were below the average. A time -and -motion
study was conducted which justified the proposed increase in
fees as outlined in Exhibit E.
Special Police Services need to be charged at a given rate to
enable community groups to budget and be charged in advance
for security services. By existing resolution the fees are
computed at actual hourly rate and can only be determined
after assignment has been made. This makes it impossible for
advance payment of fees for community facilities activities or
budgeting.

The frequency of Statistical Data Searches has increased
tremendously requiring the use of manpower and system
resources. Based on a time -and -motion study, the fee for
supplying these searches to the public would be $45.00 per
hour with a one-hour minimum.
A recent survey or Orange County law enforcement agencies
indicates that the majority have enacted fees for Impounded
Vehicle Releases to reimburse the agency for time and
resources spent in processing paperwork. A fee of $25.00 can
easily be justified.
We would recommend that authorization be granted to make the
modifications and additions to Resolution 86-1.

SUBJECT., COMMUNITY SERVICES DEPARTMENT CONSOLIDATED RENTAL FEE SCHEDULE
Attached is a copy of the consolidated fee schedule for Community
Services Department rentals. The City Council approved, by motion,
all fees except "Ball Diamond" as part of the latest facility use
policy revision. An increase in Ball Diamond fees is proposed to
ensure that the City recovers costs and to remain constant with the
Orange County ball diamond rental market.
Staff is now conducting a detailed analysis of all rental fees.
Any proposed changes will be forwarded to the Parks and Recreation
Commission for review at the October 15, 1992 meeting. These
revisions will be ready to go to the City Council the first meeting
in November.

AND SERVICE CHARGES FOR THE DEPARTMENTS OF
LEGISLATION, ADMINISTRATION, COMMUNITY
DEVELOPMENT, PUBLIC WORKS, POLICE, AND
COMMUNITY SERVICES.
I. The City Council finds and determines
A. There are a number of services provided by the City
that are of primary benefit to certain individuals.
B. The costs'of these services should be borne by the
individuals receiving benefit from such services.
C. The City can account for actual costs of these
services.
II. The Fees and Service Charges schedules attached to this
Resolution shall be automatically adjusted annually
beginning January 1, 1993 to reflect the Consumer Price
Index (CPI) for the period of December to December of the
previous year.
III. The following .schedules containing fees and service
charges are hereby established and supersede certain
existing fees, and shall be applied uniformly except
where, in the discretion of the City Manager, reduced
fees are justified by special circumstances.
