The City Council meets the f irst and third Monday of each month at 7: 00 p . m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening- devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited during the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior -to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. WORKSHOP - The Redevelopment Agency will conduct a Housing Set -Aside — Funding Workshop at 5:00 p.m. This workshop is open to the public. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). If you wish to address the City Council on any matter, please fill out one of the forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please *state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. VII. CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. APPROVAL OF MINUTES - AUGUST 17, 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of August 17, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,659,476.20 and ratify Payroll in the amount of $597,845.81. ,/3. RESOLUTION NO. 92-102 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, TO DEFER AUTOMATIC ANNUAL FEE ADJUSTMENTS FOR FIRE PREVENTION, FALSE ALARMS AND MISCELLANEOUS SERVICES PROVIDED BY THE ORANGE COUNTY FIRE DEPARTMENT Recommendation: Adopt Resolution No. 92-102 deferring the fire services annual fee adjustment as recommended by the Community Development Department. 4. RESOLUTION NO. 92-104 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 14576 Recommendation: Adopt Resolution No. 92-104, as submitted, approving Final Tract Map No. 14576 as recommended by the Community Development Department. S. RESOLUTION NO. 92-105 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE WATER MAIN CONSTRUCTION ON MAIN STREET AT SR -55 FREEWAY, BETWEEN STONEGLASS AND PASADENA AVENUE, PROJECT 600095C Recommendation: Adopt Resolution No. 92-105 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. 6. RESOLUTION NO. 92-106 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN COMMUNITY DEVELOPMENT DEPARTMENT RECORDS Recommendation: Adopt Resolution No. 92-106 authorizing the destruction of Community Development Department records pursuant to the authority granted by Sections 34090 and 34090.5 of the Government Code of the State of California as recommended by the Community Development Department. 7. AWARD OF CONTRACT FOR EL MODENA-IRVINE CHANNEL FACILITY NO. F07 FROM 1101 SOUTHERLY OF MICHELLE DRIVE TO I-5 Recommendation: Award the contract for subject project to Heritage Engineering Construction, Inc., of Ontario, California, in the amount of $811,344.00 as recommended by the Public Works Department/Engineering Division. S. APPROVAL OF AMENDMENT NO. 1 TO STORMWATER PERMIT IMPLEMENTATION AGREEMENT AND NPDES TECHNICAL ADVISORY COMMITTEE BYLAWS Recommendation: Approve Amendment No. 1 to the Stormwater Permit Implementation Agreement and the National Pollutant Discharge Elimination System (NPDES) Technical Advisory Committee bylaws as recommended by the Public Works Department/ Engineering Division. TUSTIN TO PROVIDE I-5/SR-55 FREEWAY Mayor to execute Works Department/ 10. MARRED VEHICLE PURCHASE Recommendation: Authorize purchase of eleven (11) replacement Chevrolet Caprice marked vehicles from Maurice J. Sopp and Son Chevrolet, 5801 Pacific Boulevard, Huntington Beach, California, in the amount of $158,977.61 as recommended by the Police Department. 11. APPROVAL OF CONSULTANT SERVICES AGREEMENT - COTTEN, DAY is SELFON Recommendation: Authorize the Assistant City Manager to execute a consultant services agreement between the City and Cotten, Day & Selfon as recommended by the Community Development Department. 12. RESOLUTION NO. 92-107 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE STREET REHABILITATION OF RED HILL AVENUE BETWEEN WARNER AVENUE AND VALENCIA AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 92-107 approving plans and specifications and authorizing advertisement for bids for subject project; and authorize the Mayor to execute the right- of-way certification as recommended by the Public Works Department/Engineering Division. VIII. ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 1098 - SECOND RESPONSE TO DISTURBANCE In order to eliminate some second police responses to the same location, while at the same time recuperating costs, the Police Department is proposing adoption of Ordinance No. 1098. This ordinance will allow the Police Department to bill responsible parties for actual time spent on return calls. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1098: ORDINANCE NO. 1098 -'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ENACTING REGULATIONS WITH RESPECT TO POLICE RESPONSE SERVICE AT LARGE GATHERINGS IX. ORDINANCES FOR ADOPTION - None X. OLD BUSINESS 1. SELECTION OF PLANNING COMMISSIONERS, PARRS AND RECREATION COMMISSIONERS, AND CULTURAL RESOURCES COMMITTEE MEMBERS There are currently three vacancies on the Planning Commission, three vacancies on the Parks and Recreation Commission, and two vacancies on the Cultural Resources Committee. REQUEST TO' ,VE REQUIREMENTS TO CONSTR SIDEWALK AT 2512-2522 CHAMBERS ROAD (CRESTMARK REAL ESTATE AND INVESTMENTS) At their August 3, 1992 meeting, the City Council discussed the subject item, continued it for further action, and requested staff return with additional alternatives to possibly resolve the issue. Recommendation: Pleasure of the City Council. 3. IRVINE BUSINESS COMPLEX (IBC) - RECIRCULATED DRAFT PROGRAM ENVIRONMENTAL IMPACT REPORT (EIR) GENERAL PLAN AMENDMENT AND REZONING PROJECT The Irvine Business Complex (IBC) Planning Area 36 is a business and industrial complex comprised of approximately 2,800 acres in the western portion of the City of Irvine adjacent to the City of Tustin. Recommendation: Authorize staff to transmit comments and response to the City of Irvine on the Irvine Business Complex ( IBC) project as recommended by the Community Development Department and the Public Works Department/Engineering Division. 4. STATUS OF GREAT WESTERN RECLAMATION REFUND At their meeting of August 3, 1992, the City Council, with the absence of Councilmember Saltarelli, was divided as to whether the $109,000 refund from the 1991-92 trash fees should be held in trust to offset estimated 1993-94 rate increases or should be credited against the proposed 1992-93 rates. Recommendation: XI. NEW BUSINESS Pleasure of the City Council. 1. REQUEST TO WAIVE REQUIREMENTS TO CONSTRUCT SIDEWALK AT 14511 MYFORD ROAD (SILICON SYSTEMS) Silicon Systems has requested that the City waive the requirement to construct a standard sidewalk within the public right-of-way adjacent to their building located at 14511 Myford Road. Recommendation: XII. REPORTS Pleasure of the City Council. 1. PLANNING COMMISSION ACTION AGENDA - AUGUST 24, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 24, 1992. 2. CITY EMERGENCY COMMUNICATION OPERATIONS Mayor Pro Tem Potts had requested information regarding the City's emergency communication program. SUMMER RECREATION PROGRAM WRAP -IIP Status report on the City's summer youth recreation program, specifically in the southwest portion of the City. Recommendation: Receive and file subject report as recommended by the Community Services Department. 4. STATUS UPDATE: BICYCLE LANES ON RED HILL AVENUE IN THE VICINITY OF INTERSTATE ROUTE 5 At the August 25, 1992 Town Hall meeting, a status update report on bicycle lanes on Red Hill Avenue at the I-5 Freeway overpass was requested. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. S. INVESTMENT SCHEDULE AS OF JULY 31, 1992 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. XIII.
