SUBJECT: DEFERRAL OF FIRE SERVICE ANNUAL FEE ADJUSTMENT
RECOMMENDATION
It is recommended that the City Council:
1. Adopt Resolution No. 92-102 deferring the fire services annual
fee adjustment.
BACKGROUND
The City of Tustin contracts with the County of Orange for the
Orange County Fire Department to provide fire services.
On July 18, 1990, the Orange County Board of Supervisors passed
Resolution 90-1011 establishing a fee schedule for fire prevention,
false alarms and miscellaneous services provided by the Orange
County Fire Department to become effective July 1, 1991. The
amount of each fee is to recover operating costs incurred in
providing those services.
On May 20, 1991 the Tustin City Council adopted Resolution 91-56
establishing, in part, permit fees for alarm businesses and penalty
fees for false alarms. The fee schedule was effective July 1,
1991, enabling the Fire Department to collect those fees.
As part of the fire service provided by Orange County Fire
Department the adopted fees included an annual automatic fee
adjustment beginning July 1, 1992.
The Orange County Fire Department has determined that due to
reductions in false alarm responses and cooperation in quickly
correcting fire code violations the annual fee increase for alarm
businesses and penalties will not be necessary for fiscal year
1992-1993. The Orange County Fire Department has recommended that
contract cities have their Council adopt a resolution deferring
the annual fee increase which was to be effective July 1, 1992.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN TO DEFER AUTOMATIC ANNUAL FEE ADJUSTMENTS
FOR FIRE PREVENTION, FALSE ALARMS AND
MISCELLANEOUS SERVICES PROVIDED BY THE ORANGE
COUNTY FIRE DEPARTMENT
I. The City Council of the City of Tustin does hereby
resolve as follows:
A. On May 20, 1991 the City Council of the City of
Tustin adopted Resolution No. 91-56 enacting fees
for fire prevention, false alarms and
miscellaneous services provided by the Orange
County Fire Department and to authorize the
County of Orange to administer collection
enforcement of certain fees; and
B. The Orange County Fire Department fee schedule
contained a provision to allow an automatic
annual fee adjustment to adopted fees beginning
July 1, 1992 through June 30, 1994 based on
changes to the Consumer Price Index (CPI); and
C. That the Orange County Fire Department contract
cities have expressed concern that fee increases
will have an adverse impact on development and
business during the current economic recession;
and
D. The City of Tustin which is served by the Orange
County Fire Department has been requested to have
the City Council authorize a one time deferral of
the annual adjustment which was effective July 1,
1992.
E. The one time deferral of the automatic annual fee
adjustment is exempt from the CEQA in accordance
with Public Resources Code Section 21080 (b) (8) .
II. The City of Tustin does hereby authorize the Orange
County Fire Department to continue using the fee
schedule which was adjusted on July 1, 1991 and
adopted by Resolution No. 91-56.
III. That this is a one time deferral of the adjustment and
that fire service fees will be automatically adjusted
beginning on July 1, 1993 and will be based on changes

to the Consumer Price Index for the period of March to
March of the two previous years.
PASSED AND ADOPTED at the regular meeting of the City
Council of the City of Tustin held on the 8th day of
September, 1992.
