:.:CONSENT CALENDAR NO. 4 9-8-92 DATE: SEPTEMBER 8, 1992 Inter -Com TO: WILLIAM A. HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP 14576 RECOMMENDATION It is recommended that the City Council adopt Resolution No. 92- 104, as submitted, approving Final Tract Map 14576. BACKGROUND On October 14, 1991, the Planning Commission adopted Resolution No. 2965 recommending to the City Council approval of Vesting Tentative Tract Map 14366 (Lots 5 & 6 of Tract 13627). The City Council approved Vesting Tentative Tract Map 14366 (Lots 5 & 6 of Tract 13627) on November 4, 1991, by adopting Resolution No. 91-148. This approval included numerous conditions to be met prior to approval of the Final Map, with which the applicant has complied. As permitted by the Subdivision Map Act, the applicant is exercising the right to file multiple Final Maps on the project. It is the applicants intent to file two separate Final Maps, one for Lot 5 (Final Map 14576) and one for Lot 6, on the original approved Vesting Tentative Tract Map 14366. On August 24, 1992, the Planning Commission adopted Resolution No. 3075, recommending approval of Final Tract Map 14576 to the City Council. The Final Map is now ready for recordation with the Orange County Recorder's Office. Prior to recordation, the Final Map must be reviewed and approved by the City Council. Final Map 14576 includes 43 numbered lots and three lettered lots, accommodating 43 single family dwelling units. Final Map 14576 is bordered by Jamboree Road to the east, Pioneer Road and Lots 7 and 8 of Tract 13627 to the west, Lots 2 and 3 of Tract 13627 to the north and the remaining portion of Vesting Tentative Tract 14366 (Lot 6 of Tract 13627) to the south. City Council Report Final Map 14576 September 8, 1992 Page 2 CONCLUSION Staff has determined that the Final Map is in conformance with the Vesting Tentative Map approval, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. Based on this conformance, it is recommended that the City Council adopt Resolution No. 92-104 approving Final Tract Map 14576, subject to final approval of the City Engineer. / v oann M.S. The City Council finds and determines as follows: G A. That Final Tract Map No. 14576 has been submitted by A -M Homes Inc. 8. B. That a public hearing was held by the Planning Commission on October 14, 1991. At that 9 hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 14366 lU (Lots 5 & 6 of Tract 13627) to the City Council. Subsequently, the City Council 11 approved Vesting Tentative Tract Map 14366 (Lots 5 & 6 of Tract 13627) on November 4, 12 1991. 13 C. That following Vesting Tentative Map approval, the applicant filed Final Tract Map 14576 (Lot 14 5 of Tract 13627), which conforms with the approved Vesting Tentative Tract Map. 15 D. The Planning Commission recommended approval 16 of Final Map 14576 to the City Council on 17 August 24, 1992. E. That the proposed subdivision is in 18 conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development 19 Agreement and Subdivision Map Act as it pertains to the development of residential 2� units. 21 F. The .9282 acres of parkland required for this 22 development was previously dedicated with recordation of Tract 13627. 23 G. That the City has reviewed the status of the 24 School Facilities Agreement between the Irvine Company and the Tustin Unified School 25 District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract 26 14576 on School District facilities, and reviewed changes in State law, and finds and 27 determines that the impacts on School District facilities. by approval of this map are 28 adequately addressed. 111 Resolution No. 92-104 Page 2 1 2 J. That the design of the subdivision or the proposed 3 improvements are not likely to cause substantial environmental damage or substantially and avoidably 4 injure fish or wildlife in their habitat. 5 K. That the design of the subdivision or the type of improvements proposed will not conflict with 6 easements acquired by the public =at -large, for access through or use of the property within the 7 proposed subdivision. 8 L. That the design of the subdivision or the types of improvements proposed are not likely to cause 9 serious public health problems. 10 M. That the Final Map is in substantial conformance with the Tentative Map. 11 N. That the project is considered Ministerially Exempt 12 pursuant to Section 15268(B) of the California Environmental Quality Act. 13 II.
