SUBJECT: AUTHORIZATION FOR DESTRUCTION OF COMMUNITY DEVELOPMENT
DEPARTMENT RECORDS
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 92-
106 authorizing the destruction of Community Development Department
records pursuant to the authority granted by Sections 34090 and
34090.5 of the Government Code of the State of California.
BACKGROUNDIDISCUSSION
In coordination with the Civic Center Expansion Phase II and as
part of the routine purging of the Department's files, the records
listed in Exhibit "A" attached to Resolution 92-106 have been
determined to no longer be required for the conduct of City
business. Government Code Section 34090 authorizes the head of a
City department, with approval of the City Council by resolution
and the written consent of the City Attorney, to destroy City
records, under his/her charge, without making a copy thereof, after
such documents are no longer required. Examples of those documents
requested for destruction at this time, where copies will not be
made, include items such as department correspondence, Planning
Commission and City Council agendas and payroll records.

RESOLUTION NO. 92-106
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION
OF CERTAIN COMMUNITY DEVELOPMENT DE.WdRTMENT
RECORDS
WHEREAS, except for records affecting title to real
property or liens thereon, court records, records less
than two years old, records required to be kept by
ordinances, or resolutions of the City Council and other
City boards or commissions, Government Code Section 34090
authorizes the head of a City department to destroy any
City record, document, instrument, book or paper, under
this charge, without making a copy thereof, after the
same is no longer required, with the approval of the City
Council, -by Resolution and the written consent of the
City Attorney; and
WHEREAS, the City Council, upon request of the
Director of Community Development, desires to approve
immediate destruction of certain Community Development
Department files as listed in Exhibit "A" attached.
NOW, THEREFORE, BE IT RESOLVED, that the City
Council of the City of Tustin, California hereby approves
the immediate destruction of those items which have been
retained for more than two years identified in Exhibit A.
attached hereto.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the
8th of September, 1992.
