Extension of Temporary Use Permit -92-0 APPLICANT/ OWNER: CALIFORNIA PACIFIC HOMES LOCATION: LOTS 4 AND 5, TRACT 13734 (PALO VISTA) ZONING: PC - EAST TUSTIN SPECIFIC PLAN MEDIUM DENSITY - RESIDENTIAL CATEGORY ENVIRONMENTAL STATUS: THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE PROVISIONS OF SECTION 15301 OF THE _CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: EXTENSION OF A TEMPORARY USE PERMIT FOR A TEMPORARY SALES TRAILER FOR AN ADDITIONAL SIX MONTHS. Recommendation - It is recommended that the Planning Commission approve an extension of Temporary Use Permit 92-004 by Minute Order, subject to the conditions contained in Exhibit A. Motion carried 5-0. 4. Variance 92-005 APPLICANT/ OWNER: DONALD LE JEUNE 440 WEST MAIN STREET TUSTIN, CA 92680 LOCATION: 440 WEST MAIN STREET SINGLE FAMILY RESIDENTIAL (R-1)/ CULTURAL RESOURCES DISTRICT ~ ENVIRONMENTAL STATUS: THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 03) SECTION 15303 PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: TO PERMIT AN ACCESSORY STRUCTURE USED AS GUEST ROOMS TO EXCEED THE MAXIMUM HEIGHT OF 20 FEET AT THE PROPERTY LOCATED AT 440 WEST MAIN STREET Recommendation - It is recommended that the Planning Commission continue this item until the August 24, 1992 meeting of the Planning Commission. Presentation: Becky Stone, Assistant Planner Commissioner Rasparian moved, Rasalek seconded -to approve Variance 92-005 by adopting Resolution No. 3068 revised as follows: Change all instances of 1124 feet, 6 inches" to 1125 feet, 2 inchesso Change all instances of 1123 feet" to 1123 feet, 8 inches1l Page 2, Item d.: change the average height from 1119 feet, 6 inches$' to 1119 feet, 4 inches'l. Change the percentage of roof structure over 20 feet from 1125 percent" to 1126 percents, Part I, Section d, line 12 change the percentage of roof structure below 20 feet from 1175 percent" to 1174 percent's Planning Commission Action Agenda August 24, 1992 Page 4 Motion carried 4-0. REQUEST: AUTHORIZATION TO CONSTRUCT A NEW 16,000 SQUARE FOOT GYMNASIUM AND RELATED SITE IMPROVEMENTS. Recommendation - It is recommended that the Planning Commission take the following actions:l.Approve the Environmental Determination for the project by adopting Resolution No. 3073; and, 2.Approve Conditional Use Permit 92-029 and recommend to the Redevelopment Agency approval of Design Review 92-037 by adopting Resolution No. 3074, as submitted or revised. Motion carried 5-0. Commissioner Weil moved. Le Jeune seconded to approve Conditional Use Permit 92-029 and recommend to the Redevelopment Agency approval of Design Review 92-037 by adopting Resolution No. 3074 as submitted. Motion carried 5-0. REQUEST: TO DETERMINE THAT THE POLE SIGN STRUCTURE AT 13922 RED HILL AVENUE HAS NOT BEEN ABANDONED Recommendation - It is recommended that the Planning Commission adopt Resolution No. 3076 instructing staff to defer enforcement of the City's Sign Code for 13922 Red Hill Avenue until August 9, 1993. Motion carried 5- 0. 7. Status Reports. Received and filed NEW BUSINESS: 8. Sidewalks In Industrial Areas Requested that staff inform City Council that the Planning Commission supports the concept of establishing Assessment Districts for the installation of sidewalks in industrial areas. 9. Commission Term Limitation Planning Commission unanimously decided to recommend to City Council limitation of commission terms to six years (three 2 - year terms) Planning Commission Action Agenda August 24, 1992 Page 6 10. Redevelopment Housing Set -Aside Workshop -September 8. 1992 at 5:30 p.m. Commission was informed of subject workshop. STAFF CONCERNS: 11. Report on actions taken at August 17. 1992 City Council meeting COMMISSION CONCERNS: Commissioner Weil -Requested that Edinger Avenue - Super Street Rail Station be agendized for the September 14th meeting. Commissioner Le Jeune -Requested that staff look at code enforcement on vacant lots more frequently. ADJOURNMENT: Commissioner Weil moved, Le Jeune seconded to adjourn the meeting at 8:28 p.m. Motion carried 5-0.
