The City Council meets the first and third Monday of each month at 7:00 p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited during the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. WORKSHOP - The City Council will conduct a Budget Workshop, 5:00 p.m., at the Tustin Area Senior Center. This workshop is open to the public. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE `I. VOLUNTEER FIREFIGHTER RECOGNITION MONTH V. PUBLIC HEARINGS 1. APPEAL OF CONDITIONAL USE PERMIT 92-025, 440 WEST MAIN STREET The Planning Commission approved Conditional Use Permit 92-025, which authorized an accessory structure used as guest rooms to be moved to an R-1 lot located at 440 West Main Street pursuant to Section 9223b3 of the Tustin City Code. On August 3, 1992, the Community Development Department received an appeal from the property owner to the east of the project site. Recommendation: Uphold the Planning Commission's approval of Conditional Use Permit 92-025 by adopting the following Resolution No. 92-98 as recommended by the Community Development Department: RESOLUTION NO. 92-98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF CONDITIONAL USE PERMIT 92-025, AUTHORIZING THE PLACEMENT OF AN ACCESSORY STRUCTURE USED AS GUEST ROOMS ON AN R-1 LOT LOCATED AT 440 WEST MAIN STREET CITY COUNCIL AGENDA PAGE 1 AUGUST 17, 1992 2. PROPOSED SV -1R AND TRANSFER OF OWNERSHIP --^F COMMUNITY CABLEVISION COMPANY TO( IES MIRROR CABLE TELEVISII Tustin City Code Section 7418 provides that a cable franchise cannot be sold without the prior written approval of the City Council. Recommendation: Pleasure of the City Council. V1. APPROVAL OF MINUTES - AUGUST 3, 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of August 3, 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $778,081.34 and ratify Payroll in the amount of $295,377.98. 3. REJECTION OF CLAIM NO. 92-31 - CLAIMANT, HECTOR TORRES; DATE OF LOSS, 4/3/92; DATE FILED WITH CITY, 7/27/92 Recommendation: Reject subject claim for general damages in the amount of $200,000,000.00 as recommended by the City Attorney. 4. REJECTION OF CLAIM NO. 92-35 - CLAIMANT, GERALD FERRATO; DATE OF LOSS, 3/27/92; DATE_FILED WITH CITY, 7/27/92 Recommendation: Reject subject claim for personal injury damages in the amount of $750,000.00 as recommended by the City Attorney. 5. APPROVAL Al IUTHORIZATION TO UTILIZE 1 ; AB 2766 FUNDS Recommend,,... ion: Approve and authorize the use of $10,330.00 of City AB 2766 funds to offset costs associated with developing an Air Quality component as part of the General Plan Revision Program as recommended by the Community Development Department. VIII. ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 1098 - SECOND RESPONSE TO DISTURBANCE ORDINANCE In order to eliminate some second police responses to the same location, while at the same time recuperating costs, the Police Department is proposing adoption of Ordinance No. 1098. This ordinance will allow the Police Department to bill responsible parties for actual time spent on return calls. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1098: ORDINANCE NO. 1098 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ENACTING REGULATIONS WITH RESPECT TO POLICE RESPONSE SERVICE AT LARGE GATHERINGS I8. ORDINANCES FOR ADOPTION - None X. OLD BUSINESS 1. SPORTS PARR MASTER PLAN TASK FORCE M. At the August 3, 1992 meeting, the City Council awarded the contract for design services for the Sports Park Master Plan. Staff is ready to begin the design process and is asking the City Council to review the Park Design process. Recommendation: Pleasure of the City Council. %I. NEW BUSINESS 1. APPROVAL OF ALTERNATIVE TELECOMMUNICATION SYSTEM This report evaluates and outlines City Hall and Police Department telecommunication options. Recommendation: Authorize the City Manager to execute the Pacific Bell Master Agreement for Provision, Installation and Maintenance of Telecommunications Service; appropriate $43,000.00 from the unappropriated reserve of the Equipment Replacement Fund; and further approve the Pacific Bell Joint Marketing Proposal for Equipment and System Maintenance as recommended by the Finance Department. %II. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - AUGUST 10, 1992 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. POTENTIAL I t OF JOHN WAYNE AIRPORT At the July 20, 1992 City Council meeting, Councilmember Potts requested information regarding the potential sale of John Wayne Airport, which recently had been discussed in local newspaper articles. Recommendation: Receive and file subject report as recommended by the Community Development Department. 3. TUSTIN BUSINESS PROMOTION COMMITTEE In response to Councilmember Potts' request, staff has prepared a status update on the Tustin Business Promotion Committee. Recommendation: Receive and file subject report as recommended by the Community Development Department. 4. WATER RATE STUDY WORKSHOP The Rate Study and Financing Plan will be submitted for review and discussion by the City Council. Recommendation: Set the Water Rate Study and Financing Plan Workshop for Monday, August 31, 1992, at 5:00 p.m. as recommended by the Finance Department. S. FREEWAY CONSTRUCTION STATUS REPORT Report relating to both freeway and local street closures as they pertain to the Tustin area. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 6. INVESTMENT SCHEDULE AS OF JUNE 30, 1992 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. %III. ADJOURNMENT The City Council has scheduled a Town Hall meeting on Tuesday, August 25, 1992, 7:00 p.m., at the Tustin Area Senior Center; and the next regular meeting of the City Council is scheduled for Tuesday, September 8, 1992, 7:00 p.m., at the Tustin Area Senior Center.
