SHINGLETON, ASSISTANT CITY MANAGER SUBJECT: APPROVAL AND AUTHORIZATION TO UTILIZE CITY AB 2766 FUNDS RECOMMENDATION It is recommended that City Council approve and authorize the use of $10,330.00 of City AB 2766 funds to off -set costs associated with developing an Air Quality component as part of the General Plan Revision Program. BACKGROUND On September 30, 1990, the State Legislature authorized the South Coast Air Quality Management District (SCAQMD) to impose an additional motor vehicle registration fee of two dollars ($2) to finance the .—implementation of transportation measures embodied in the Air Quality ianagement Plan (AQMP) and provisions of the California Clean Air Act. Further, the legislation required the SCAQMD to distribute forty cents ($.40) of every dollar collected to participating cities and counties within the District. Funds must be used solely to reduce pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies necessary for the implementation of State and Regional clean air goals within the City of Tustin. On June 17, 1991, the Tustin City Council adopted Ordinance No. 1073 which formally stated an intent to participate and establish an Air Quality Improvement Trust Fund. It is anticipated that the City will receive about $8,758.95 each calendar quarter. Last December, Council authorized an expenditure of $3,820.93 from the City's AB.2766 fund to finance the conversion of two City vehicles from gasoline to propane. The current unexpended balance is $20,342.55. DISCUSSION The recently adopted 1991 AQMP identifies the preparation and adoption of an "Air Quality Element" as part of a city's general plan as an _air quality implementation measure option. As Council is aware, the Community Development Department is currently in the process of updating and revising the City of Tustin General Plan. As part of that update, the City's General Plan consultant has been required to integrate the - --necessary components of an "Air Quality Element" as part of the City's -evised Conservation/ open Space/ Recreation Element. The component will include City goals and. policies intended to support the 1991 AQMP and encourage vehicle emission reductions.
