1992, 5:00 p.m., at the Tustin Area Senior Center; and the next
regular meeting of the City Council is scheduled for Monday, August
17, 1992, 7:00 p.m., at the Tustin Area Senior Center.

"CITY COUNCIL REGULAR MEETING
CITY OF TUSTIN
AUGUST 3, 1992 - 7:00 P.M.
The City Council meets the first and third Monday of each month at 7:00 p. m.
at the Tustin Area Senior Center, 200 South "C" Street, Tustin.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City of Tustin agenda books located in the Police Department and
the Tustin Public Library. These same books are also provided for public
use at the Senior Center during the Council meeting. Listening devices for
the hearing impaired are available upon request from the City Clerk.
Smoking is prohibited during the Council meeting.
Distribution of Material to City Council: If you have material you wish to
distribute to the City Council regarding an item on the agenda, please give
the material to the City Clerk prior to the meeting. This will allow the
City Council sufficient time to review the material prior to taking action.
INTERVIEWS - At 5:00 p.m., the City Council will conduct interviews to fill
vacancies on the Planning Commission, Parks and Recreation Commission, and
Cultural Resources Committee. These interviews are open to the public.

1. APPEAL OF LARGE FAMILY DAY CARE HOME, LFD 92-002 - 13022 RANCHWOOD
ROAD
On July 13, 1992, the Planning Commission held a public hearing
and approved an application for a large family day care home at
the property located at 13022 Ranchwood Road. On July 16, 1992,
staff received an appeal from the adjacent property owner.
Recommendation: Adopt the following Resolution No. 92-96 as
recommended by the Community Development Department:

The City Council, at a regular meeting on July 20, 1992, held
first reading and introduction of Ordinance No. 1095, proposed
amendments to the Tustin City Code related to food handling
businesses and health service fees.
Recommendation: Open the public hearing, receive input, and have
second reading by title only and adoption of the following
Ordinance No. 1095 as recommended by the Community Development
Department:
ORDINANCE NO. 1095 - AN ORDINANCE. OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 4 OF
THE TUSTIN CITY CODE AS THEY RELATE TO FOOD HANDLING BUSINESSES
AND HEALTH SERVICES FEES
3. LEVY OF ANNUAL ASSESSMENTS FOR THE 1992-93 FISCAL YEAR FOR THE
TUSTIN LANDSCAPE AND LIGHTING DISTRICT
Public Hearing concerning the annual levy of assessments to the
Tustin Landscape and Lighting District and the annexation of
additional territory to the existing district.
Recommendation: Pleasure of the City Council.
4. ADOPTION OF 1992-93 SOLID WASTE COLLECTION ASSESSMENT REPORT
The annual adjustment of the rates for solid waste collection has
three separate components: collection charge, disposal charge and
the Material Recovery Facility (MRF) charge.
Recommendation: Adopt the following Resolution No. 92-97
approving the 1992-93 Solid Waste Collection Assessment Report and
direct the Finance Director to place the new assessments on the
tax role for fiscal year 1992-93 as recommended by the Finance
Department:

CITY OF TUSTIN, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF
SECTION 5473 ET SEQ . OF THE HEALTH AND SAFETY CODE OF THE STATE OF
CALIFORNIA, APPROVING AND ADOPTING A REPORT RELATIVE TO PARCELS OF
REAL PROPERTY RECEIVING SOLID WASTE COLLECTION SERVICES,
DETERMINING THE CHARGES FOR SOLID WASTE COLLECTION TO BE ASSESSED
AGAINST THE RESPECTIVE.LOTS OR PARCELS OF LAND AS THEY APPEAR ON
THE CURRENT ASSESSMENT ROLL

VII. CONSENT CALEND, - All matters listed un Consent Calendar are
considered routine and will be enacted by olac'motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - JULY 20, 1992 REGULAR MEETING
Recommendation: Approve the City Council Minutes of July 20,
1992.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,513,701.40
and ratify Payroll in the amount of $298,113.79.
3. COPY MACHINE LEASE AGREEMENT
Recommendation: Authorize the Police Department to enter into
a 60 -month lease agreement with Xerox Corporation for a copy
machine lease as recommended by the Police Department.
4. AUTHORIZATION TO REQUEST BIDS FOR WATER SCADA SYSTEM
Recommendation: Authorize the Mayor and City Clerk to solicit
bids for a Supervisory Control and Data Acquisition (SCADA)
system for the City's water distribution network as recommended
by the Public Works Department/Water Services Division.-

MASTER PLAN
Recommendation: Award the contract for design services for the
Tustin Sports Park Master Plan to the firm of Anthony and
Langford for a fee not to exceed $70,000 plus reimbursable
expenses as recommended by the Community Services Department.

IX. ORDINANCE FOR ADOPTION
1. ORDINANCE NO. 1093 - AMENDMENT TO CONTRACT WITH PUBLIC EMPLOYEES$
RETIREMENT SYSTEM (PERS)
Ordinance No. 1093 had first reading by title only and
introduction at the July 20, 1992 City Council meeting.
Recommendation: Have second reading by title only and adoption of
the following Ordinance No. 1093 (roll call vote):
ORDINANCE NO. 1093 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AUTHORIZING AN AMENDMENT FOR MISCELLANEOUS
EMPLOYEES TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF
TUSTIN AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC
EMPLOYEES' RETIREMENT SYSTEM
X. OLD BUSINESS
1. MEMORANDUM OF UNDERSTANDING MARINE CORPS AIR STATION, TUSTIN
The Department of Defense Office of Economic Adjustment has
informed the City that they have approved the City's grant request
of $750,000 for preparation of a joint Environmental Impact
Report/Environmental Impact Statement (EIR/EIS) for disposal of

the base 1 ,ect and the City's prepe ion and adoption of a
Specific Plan. One of the conditions o.L the grant is the City's
execution of a Memorandum of Understanding with the Commander,
Marine Corps Air Bases Western Area.
Recommendation: Authorize the City Manager and Assistant City
Manager to execute the subject Memorandum of Understanding as
recommended by the Community Development Department.
2. RED HILL AVENUE, EDINGER AVENUE TO I-5 FREEWAY
At a previous City Council meeting, Councilmember Potts requested
a report relating to the restriping of Red Hill Avenue between
Edinger Avenue and the Santa Ana (I-5) Freeway to accommodate six
travel lanes in each direction.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
XI. NEW BUSINESS
1. REQUEST TO WAIVE REQUIREMENTS TO CONSTRUCT SIDEWALKS AT 2512-2522
CHAMBERS ROAD (CRESTMARK REAL ESTATE AND INVESTMENTS)
Staff has received a letter from Crestmark Real Estate and
Investments requesting the City.waive the requirement for them to
construct a standard sidewalk within the public right-of-way
adjacent to their building, located at 2512-2522 Chambers Road, in
conjunction with tenant improvements.
Recommendation: Deny the request to waive the requirement to
construct sidewalk at 2512-2522 Chambers Road in conjunction with
their tenant improvements as recommended by the Public Works
Department/Engineering Division..
XII. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - JULY 27, 1992
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
July 27, 1992.
2. 1991-92 CAPITAL IMPROVEMENT PROJECTS SCHEDULE/STATUS REPORT
QUARTERLY UPDATE
A graphical chart report of the schedule/status for the 1991-92
Capital Improvement Program as of this fiscal year's fourth
quarter.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
3. AMERICANS WITH DISABILITIES ACT (ADA) TRANSITION PLAN
Pursuant to the Americans with Disabilities Act, the City must
have prepared by July 26, 1992, a Transition Plan containing an
inventory of all public facilities, including sidewalks, handicap

ramps, a; public buildings; an identifying physical
architecture obstacles that may limit access to City programs,
activities, and facilities.
-- Recommendation: Receive and file subject report as recommended by
the Americans with Disabilities Act Task Force.
