HomeMy WebLinkAboutAGENDA 07-20-92AGENDA CITY COUNCIL REGULAR MEETING CITY OF TUSTIN JULY 20, 1992 - 7:00 P.M. The City Council meets the first and third Monday of each month at 7:00 p.m. at the Tustin Area Senior Center, 200 South "C" Street, Tustin. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City of Tustin agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use at the Senior Center during the Council meeting. Listening devices for the hearing impaired --are available upon request from the City Clerk. Smoking is prohibited during the Council meeting. Distribution of Material to City Council: If you have material you wish to distribute to the City Council regarding an item on the agenda, please give the material to the City Clerk prior to the meeting. This will allow the City Council sufficient time to review the material prior to taking action. _�ORRSHOP - At 5: 00 p.m. , the City Council will hold • a budget workshop at the ustin Area Senior Center. This workshop is open to the public. CALL TO ORDER/PLEDGE OF ALLEGIANCE INVOCATION - The Invocation will be given by Rev. John Hanisch, Red Hill -Lutheran Church. ROLL CALL PROCLAMATION - CALIFORNIA'S NATIVE AMERICANS PUBLIC HEARING 1. LEVY OF ANNUAL ASSESSMENTS FOR THE 1992-93 FISCAL YEAR FOR THE TUSTIN-LANDSCAPE AND LIGHTING DISTRICT Public Hearing to receive testimony concerning the annual levy of assessments to the Tustin Landscape Lighting District and the annexation of additional territory to an existing district. Any protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Recommendation: Open the Public Hearing, receive any testimony from affected property owners, and continue the Public Hearing to the regularly scheduled City Council meeting of August 3, 1992, as recommended by the Public Works Department/Engineering Division. If you wish to address the City Council on any matter, please fill out one of the forms located on the speaker's podium and submit to the City Clerk so that your remarks on the tape recording of the meeting can be attributed to you. When you start to address the City Council, please state your full name and address for the record. A Public Input portion is provided both at the beginning and end of the meeting. VII. CONSENT CALENDAR. - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. I. APPROVAL OF MINUTES - JULY 61 1992 REGULAR MEETING Recommendation: Approve the City Council Minutes of July 61 1992. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,220,136.87 and ratify Payroll in the amount of $303,012.82 3. 1992-93 COUNTY OF ORANGE ANIMAL CONTROL/SHELTER CONTRACT Recommendation: Authorize the Mayor to execute the agreement with the County of Orange to provide Animal Control and Shelter Services to the City of Tustin during fiscal year 1992-93 as recommended by the Finance Department. 4. RESOLUTION NO. 92-92 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO ACCEPTANCE OF OFFERS OF DEDICATION FOR PROPERTY FRONTING ON YORBA STREET BETWEEN FIRST STREET AND IRVINE BOULEVARD Recommendation: Accept the four offers of dedication with the adoption of Resolution No. 92-92 as recommended by the Public Works Department/Engineering Division. S. RESOLUTION NO. 92-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR RE -ROOFING OF WAREHOUSE AND SHOP BUILDINGS AT CITY MAINTENANCE YARD Recommendation: Adopt Resolution No. 92-93 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Field Services Division. 6. RESOLUTION NO. 92-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR THE MODIFICATION OF TRAFFIC SIGNALS AND INTERCONNECT AT VARIOUS LOCATIONS Recommendation: Adopt Resolution No. 92-94 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. RESOLUTION , 92-95 - A RESOLUTION OF 'E CITY COUNCIL OF THE CITY OF TU, -.LN, CALIFORNIA, ACCEPTING .._AKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR SLURRY SEAL PROJECT, 1989-90 FY AND 1990-91 FY Recommendation: Adopt Resolution No. 92-95 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/ Engineering Division. 8. AWARD OF CONTRACT FOR TRAFFIC SIGNAL AND SAFETY LIGHTING INSTALLATION AT WARNER AVENUE AND PULLMAN STREET Recommendation: Award the contract for subject project to Steiny & Company, Inc. in. the amount of $99,894.00 as recommended by the Public Works Department/ Engineering Division. VIII. ORDINANCES FOR INTRODUCTION• 1. ORDINANCE NO. 1095 - PROPOSED AMENDMENT TO TUSTIN CITY CODE RELATING TO FOOD HANDLING BUSINESSES AND HEALTH SERVICE FEES The County of Orange Health Care Agency has requested that the City of Tustin update their codes regarding food handling businesses. Recommendation by the Community Development Department: a. Have first reading by title only and introduction of the following Ordinance No. 1095: ORDINANCE NO. 1095 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 4 OF THE TUSTIN CITY CODE AS THEY RELATE TO FOOD HANDLING BUSINESSES AND HEALTH SERVICE FEES b. Advertise Ordinance No. 1095 for a public hearing on August 3, 1992. 2. ORDINANCE NO. 1093 - AMENDMENT TO CONTRACT WITH THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM Proposed Ordinance No. 1093 will enable the City to amend its contract with the Public Employees' Retirement System to provide the single highest year option for all miscellaneous employees. Recommendation: Have first reading and introduction of the following Ordinance No. 1093: ORDINANCE NO. 1093 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN AMENDMENT FOR MISCELLANEOUS EMPLOYEES TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF TUSTIN AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM I8. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 1094 - VEHICLES IN LOADING ZONES Ordinance No. 1094 had first reading by title only and introduction at the July 6, 1992 City Council meeting. ORDINANCE NO. 1096 - EXPENSES OF COUNCILMEMBERS Ordinance No. 1096 had first reading by title only and introduction at the July 6, 1992 City Council meeting. Recommendation: Have second reading by title only and adoption of the following Ordinance No. 1096 (roll call vote): ORDINANCE NO. 1096 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE REGARDING EXPENSES OF COUNCILMEMBERS X. OLD BUSINESS 1. SETTING INTERVIEW DATES - PLANNING COMMISSION, PARRS AND RECREATION COMMISSION, AND CULTURAL RESOURCES COMMITTEE Report containing applications and resumes of residents interested in serving on the Planning Commission, Parks and Recreation Commission, and Cultural Resources Committee. Recommendation: Set date and time to conduct interviews for vacancies on the Planning Commission, Parks and Recreation Commission, and Cultural Resources Committee as recommended by the City Clerk's Office. 2. AIRPORT STATUS REPORT Report on monitoring of airport issues and attendance at relevant meetings. Recommendation: Receive and file subject report as recommended by the Community Development Department. XI. NEW BUSINESS 1. CREATION OF A BEAUTIFICATION COMMITTEE Councilmember Thomas will make a verbal presentation about this item. Recommendation: Pleasure of the City Council. 2. RESTRIPING RED HILL AVENUE - Mayor Pro Tem Potts had requested a report concerning the feasibility of restriping Red Hill Avenue to three lanes in each direction between Edinger Avenue and the I-5 freeway. Recommendation: Continue this item to the August 3, 1992 City Council meeting as recommended by the City Manager. 4. HOLDING THE MUNICIPAL ELECTION IN JUNE Councilmember Thomas requested that this item be agendized and he will make a verbal report. Recommendation: Pleasure of the City Council. XII. REPORTS I. PLANNING COMMISSION ACTION AGENDA - JULY 13, 1992 All actions __of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of July 13, 1992. 2. CITIZEN COMPLAINT ON LACK OF CROSSWALKS ON YORBA STREET BETWEEN SEVENTEENTH STREET AND SANTA CLARA AVENUE At the July 6, 1992 City Council meeting, Ms. Helen Edgar, a resident of Tustin, expressed concern regarding pedestrian safety now that the existing crosswalk at Medford Avenue and Yorba Street had been removed during a recent slurry seal project. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 3. STATUS REPORT - ALMERIA HOMEOWNERS ASSOCIATION TRAFFIC ISSUES At the June 15, 1992 City Council meeting, the Council directed staff to continue. to coordinate the review of traffic related issues with the Almeria Homeowners Association. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 4. STATUS REPORT - 1992 CONGESTION MANAGEMENT PROGRAM (CMP) LEVEL OF SERVICE UPDATE In accordance with the current Orange County CMP guidelines, the County of Orange is responsible for providing levels of service to Orange County cities for streets designated on the Orange County CMP Highway System; and within the City of Tustin, Jamboree Road, Irvine Boulevard, and Edinger Avenue are identified on the CMP Highway System. SENIOR VOLT ER PROGRAM Mayor Pro Tem Potts had requested that a follow-up report concerning the Police Department's Senior Volunteer Program be agendized at the July 20, 1992 City Council meeting. CLOSED SESSION The City Council will recess to Closed Session to consider personnel matters pursuant- to Government Code Section 54957; and pursuant to Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which has been initiated formally and to which the City is a party. The title of the litigation is Tustin Hills Environmental Alliance v. City of Tustin and the case number is 682333. BVI.
